Practicing "In The Interests Of Justice" In The Twenty-First Century: Pursuing Peace As Justice, Carrie Menkel-Meadow

In these comments I suggest that in our current world, both international and domestic, practicing "in the interests of justice" includes-indeed, should give great priority to-the "peace-seeking" and "problem solving" aspects of lawyering. I continue to see this as counter-cultural to the more common practices of lawyers who are argumentative, persuasive and articulate debaters, who believe fervently and vigorously that seeking justice, on behalf of a client or cause, means advocating for and "winning" a legal claim. To the contrary, seeking peace for parties (and, indeed, nation-states) in conflict, searching for consensus solutions to seemingly intractable public policy and legal …

In my view, whether or not Article III is written as members of a new constitutional convention might write it, there is nothing more fundamental to the way our entire judicial system operates (including in many ways, although indirectly, our state courts) than federal judges being as independent as law can make them. Perhaps I suffer from Burkean skepticism about reform of long-standing institutions, or perhaps I am merely a supporter of the status quo. This was a difficult project to undertake for a number of reasons. First of all, for various reasons it became expeditious to self-publish, and that is a bit of a nightmare. Second, there is little in the Lutheran Church-Missouri Synod to which it may be compared. Thus, any doctrinal comparison to pre-existing teachings might be problematic in some places. According to Professor Christopher Eisgruber, judicial review of the sort embedded in United States constitutional practice is a practical mechanism for implementing the Constitution's commitment to self-government. "The justices ... make a distinctive contribution to representative democracy" because they are "better positioned [than elected officials] to represent the people's convictions about what is right." Judges can articulate "a conception of justice with which Americans in general [can] plausibly identify themselves. "

A Multidimensional Analysis Contrasting Youthful Nonoffenders, Sex Offenders, Violent Offenders, And Status Offenders., Nick Sava Yackovich

Graduate Theses, Dissertations, and Problem Reports (ETD)

This study involved a comparison of 75 adolescent participants divided into four groups. Members of three of the groups were adjudicated delinquent: sex offenders, violent (nonsexual) offenders, and status offenders. A group of nonffenders was also used as a control group. The groups were compared using a contrast analysis of four dependent variables: self-concept, sexual history, cognitive distortions, and alexithymia. Findings of this study reveal a significant relationship with the presence of alexithymia among the offending sample when compared to the nonoffenders. Also evident is a greater self-concept score among the nonoffenders when contrasted with the offenders. Another significant comparison …

The use of pedagogical skills such as critical element knowledge, error detection skill, and feedback precision are deemed necessary by researchers in creating effective teachers. However, most studies have examined these skills independently rather than studying them as a process. The purpose of this study was to determine the effect of a 1-week intervention program on the feedback giving process. Specifically, the study examined (1) PETE students knowledge of critical elements, (2) the ability to detect errors from a video performance, and (3) the precision of feedback following such an observation on 12 movement skills. Integrated biomarkers of physiologic and genetic damage in sperm are needed to identify factors that affect male fertility and influence a father's risk of producing abnormal progeny. Offspring studies show a preferential paternal origin for heritable structural chromosomal abnormalities, presenting the need for methods to efficiently detect structural chromosomal abnormalities in human sperm. This dissertation breaks new conceptual ground toward the understanding of paternally transmitted genetic disease by adapting FISH technology to detect human sperm that carry chromosomal breaks and partial chromosomal duplications and deletions and by integrating state-of-the-art biomarkers of semen quality including computer-assisted sperm analysis (CASA).
