Court Review: Volume 39, Issue 2 - Firearms And Domestic Violence: A Primer For Judges, Darren Mitchell, Susan B. Carbon Jul 2002

Court Review: Volume 39, Issue 2 - Firearms And Domestic Violence: A Primer For Judges, Darren Mitchell, Susan B. Carbon

Court Review: Journal of the American Judges Association

Firearms and domestic violence are a deadly combination. As the examples on the following page show, abusers who gain access to firearms pose a lethal threat both to those they have abused and to the wider community. Even where laws exist to disarm abusers and prevent them from purchasing new firearms, absent effective implementation of the laws—by judges, as well as by others in the civil and criminal justice system— survivors of domestic violence and the broader community continue to remain at risk of death or serious injury.

Death Through Administrative Indifference: The Prison Litigation Reform Act Allows Women To Die In California's Substandard Prison Health Care System, Amy Pétre Hill Jul 2002

Death Through Administrative Indifference: The Prison Litigation Reform Act Allows Women To Die In California's Substandard Prison Health Care System, Amy Pétre Hill

UC Law SF Journal on Gender and Justice

California's prison system, the nation's largest, developed a health care policy that is deliberately indifferent to the medical needs of women while still spending significantly more per prisoner for health care than other large states. However, the Prison Litigation Reform Act of 1996 interacts with California's prison administrative law to prevent women inmates from seeking emergency injunctive relief from the federal courts. Legal and legislative tools can be used at the federal and state level for short- and long-term reform of the California Department of Correction's health care system to stop the needless deaths of California's female inmates. Ultimately, courts …

The Bush Military Tribunals: Where Have We Been? Where Are We Going?, Eric M. Freedman

Hofstra Law Faculty Scholarship

On November 13, 2001, President George W. Bush issued the military order "Detention, Treatment, and Trial of Certain Non-citizens in the War Against Terrorism." One of its provisions authorizes the trial by military commission of any non-citizen as to whom the president determines "that there is reason to believe that such individual ... has engaged in, aided or abetted, or conspired to commit, acts of international terrorism, or acts in preparation therefor, that have caused, threaten to cause, or have as their aim to cause, injury to or adverse effects on the United States, its citizens, national security, foreign policy, …

Privacy And The Post-September 11 Immigration Detainees: The Wrong Way To A Right (And Other Wrongs), Sadiq Reza

In forthcoming work, I argue that this common-law privacy right should indeed attach to individuals arrested for or suspected of crime.9 I also argue that support for the right exists in a variety of judicial, statutory, and other sources, and that legislation to formally protect the right is warranted and constitutional. The reasoning is simple: being publicly named in connection with criminal allegations is stigmatizing, and the resultant personal harm-social, professional, emotional, other-lasts, and is difficult to justify when it is visited upon someone who is acquitted of the charges or against whom the charges are dismissed. Equally troubling is …

Analysis Of States Gun Control Restrictions, Xiaofeng Cheng Jun 2002

Analysis Of States Gun Control Restrictions, Xiaofeng Cheng

USF Tampa Graduate Theses and Dissertations

This thesis analyzes the policy effects of several state gun control restrictions in the United States. The study employs the data of gun related crimes and gun control restrictions from Statistical Abstract of Criminal Justice Handbook through five years (from 1995 to 2000). Although many scholars have studied previously gun control policy effects on crimes, they always focus on the total violence level and ignore to compare the policy effects of different gun control laws. The present study examines intensively gun related crimes and compares several gun control policies.

Pooled data is employed to access the effects of gun control …

This report summarizes the findings of a study conducted using data collected by the Louisville Division of Police between January 15, 2001 and December 31, 2001. These data resulted from 48,586 interactions between law enforcement officers and citizens during traffic-related contacts.

Information was collected about the driver, the officer, and the stop event. Driver demographics included race, sex, age, residency, license number, and vehicle registration. The only information collected about the officer was officer badge number. Finally, data collected about the stop event include the date, time of day, reason for stop, activities during the stop, number of passengers, and …

Don't Worry... It [Corn] Won't Kill You: The Starlink Crisis, Kelly J. Price Jun 2002

Don't Worry... It [Corn] Won't Kill You: The Starlink Crisis, Kelly J. Price

Honors Theses

What would you do ... if someone told you that the food you just ate was not safe for human consumption? In 1999, consumers across the nation were faced with this fear and began to second-guess the food they had been accustomed to eating for years. After Kraft Foods' Taco Bell taco shells were recalled in September for containing traces of StarLink corn, a genetically modified corn hybrid not approved for human consumption, consumer confidence in U.S. corn by-products decreased and manufacturer credibility dwindled (Aventis stops, 2000). People wanted to know who to blame for the apparent food contamination problem. …
