Retroactive Application Of "New Rules" And The Antiterrorism And Effective Death Penalty Act, A. Christopher Bryant
Retroactive Application Of "New Rules" And The Antiterrorism And Effective Death Penalty Act, A. Christopher Bryant
Faculty Articles and Other Publications
For three decades, the application of United States Supreme Court criminal procedure decisions has confused the Court's habeas corpus jurisprudence. In 1999, the Court's decision in Williams v. Taylor might have resolved the ambiguous relationship between the pre-1996 habeas corpus retroactivity decisions - the most significant of which was Teague v. Lane - and the habeas corpus reform provisions of the Antiterrorism and Effective Death Penalty Act of 1996 (AEDPA). Unfortunately, the Williams decision has only engendered further confusion.
Two decades before Teague, the second Justice Harlan proposed an approach to retroactivity questions, arguing that a decision that announced …

The Elegant Simplicity Of Family Preservation Practice Legecies And Lessons, James K. Whittaker
The Elegant Simplicity Of Family Preservation Practice Legecies And Lessons, James K. Whittaker
Journal of Family Strengths
An earlier version of this manuscript was prepared for the Chapin Hall invitational seminar on family preservation, The Chapin Hall Center for Children at the University of Chicago, September 16 & 17, 1999. The author wishes to acknowledge the comments and helpful suggestions of seminar participants-Jacqueline McCroskey, Martha Shirk, Fran Jacobs, John Schuerman, Lee Schorr, Charlotte Booth, Kristi Nelson, Susan Kelly, Frank Farrow, and Susan Notkin. These comments, as indeed many of their prior contributions, have had a seminal effect on my thinking about family preservation services over the years. Clark Peters and other Chapin Hall staff deserve special thanks …

Cooperation Between Law Enforcement And State Hospitals In Warrantless, Nonconsensual Drug Testing Of Maternity Patients Is Unconstitutional Under The Fourth Amendment: Ferguson V. City Of Charleston, Nicholas J. Zidik
Duquesne Law Review
The United States Supreme Court held that a state hospital's policy of drug testing maternity patients without their consent, in conjunction with law enforcement, constitutes an unreasonable search prohibited by the Fourth Amendment to the United States Constitution; the state's interest in deterring pregnant women from drug use does not justify variance from the general rule that official nonconsensual searches are unconstitutional if not executed according to and accompanied by a valid search warrant.

The Broken Safety Valve: Judicial Discretion's Failure To Ameliorate Punishment Under California's Three Strikes Law, Alex Ricciardulli
The Broken Safety Valve: Judicial Discretion's Failure To Ameliorate Punishment Under California's Three Strikes Law, Alex Ricciardulli
Duquesne Law Review
This Article suggests that the power of judges to reduce sentences imposed under California's Three Strikes law has not diminished the severity of punishment meted out under the law. The Article traces the development of California's Three Strikes Law, assesses the importance of judicial discretion in analyzing the constitutionality of the Three Strikes Law, and illustrates the limited nature of judicial power under the law. The Article also analyzes empirical evidence concerning the Three Strikes law to determine that the evidence corroborates the inefficacy of judicial power. The Article concludes that there are only two meaningful ways to alleviate the …

Did you smile at the 2001 Super Bowl at Tampa's Raymond James Stadium? Hope you did because the facial recognition cameras certainly got your smile, applause, disappointment and kisses in that great American sports night. If you missed your 15-second of fame, try it again at the Salt Lake City Winter Olympics. With the use of facial recognition technology at the 2001 Super Bowl and Salt Lake City Winter Olympics, the author seeks to explore the use of this facial recognition technology. He further discusses the constitutionality of it under the Fourth Amendment. In doing so, he analyzes how facial …
