Post-Election Litigation In Pennsylvania, Clifford B. Levine, David J. Montgomery

Duquesne Law Review

The Article focuses on the causes and consequences of post-election litigation in Pennsylvania. The Authors conclude that the Pennsylvania Election Code has been strictly construed by Pennsylvania courts out of a reluctance to interfere with, and to promote, the finality of election returns.

Unduly Influenced Trust Revocations, Mark R. Siegel Jan 2002

Unduly Influenced Trust Revocations, Mark R. Siegel

Duquesne Law Review

This article addresses both the will and the revocable trust as vehicles to accomplish gratuitous property dispositions, and analyzes the requisite mental capacity necessary to convey property during life and after death. This article focuses on undue influence in such situations, and the use of constructive trusts as remedial tools to rectify cases of undue influence. The author concludes by proposing that because of the existence of available and adequate probate and trust remedies, trust beneficiaries harmed as a result of undue influence should first resort to the equitable remedy of constructive trusts before being able to pursue a legal …

Probability And Statistics In The Legal Curriculum: A Case Study In Disciplinary Aspects Of Interdisciplinary, Mike Townsend, Thomas Richardson Jan 2002

Probability And Statistics In The Legal Curriculum: A Case Study In Disciplinary Aspects Of Interdisciplinary, Mike Townsend, Thomas Richardson

Duquesne Law Review

This Article provides a general taxonomy for various types of educational interdisciplinarity. The discussion focuses, however, on what is called crossdisciplinary education, using a particular mathematics-based example to illustrate how crossdisciplinary education can be used to ask law students to (re)examine law as a discipline. The Article considers interdisciplinarity and the legal curriculum in the context of probability and statistics, using the well-known jury discrimination case of Castaneda v. Partida as a case study. The Article concludes with some brief observations on the importance of thinking about law as a discipline. This is the third installment of a work in …

Law Talk: Speaking, Writing, And Entering The Discourse Of Law, Susan L. Dejarnatt Jan 2002

Law Talk: Speaking, Writing, And Entering The Discourse Of Law, Susan L. Dejarnatt

Duquesne Law Review

The author suggests talking about the legal writing process with first-year legal research and writing students, as they are learning and actively writing, and advocates for students' experiencing "being the audience" of legal writing, as part of their education. This Article reviews three academic schools of thought regarding the relationship between speech and writing. This Article argues for change in the typical legal writing pedagogy, meaning more student interaction and teacher intervention, to effectively enable students to engage in discourse communities of law.

The Pedagogics Of Play, Jay Mcclure Jan 2002

The Pedagogics Of Play, Jay Mcclure

Proceedings of the 18th National Conference on the Beginning Design Student

Teachers should emphasize the importance of play to a student's development, noting their individual talents they need to explore, tryout, take apart and investigate which is fundamental to learning. Design fundamental programs should develop pedagogies that guide student's play into progressive learning experiences in the essentials of form, mathematics, geometry, and creativity.

Relative Solar And Auroral Contribution To The Polar F Region: Implications For National Space Weather Program, Michael David, Jan Josef Sojka, Robert W. Schunk, R. Heelis

All Physics Faculty Publications

When plasma in the polar cap F region becomes highly structured, patches, irregularities, and scintillations of HF signals may be observed. The topic of this paper is not the mechanism for structuring or distributing the plasma but rather the source of the plasma. By understanding the plasma source we gain insight into the specification and forecasting of ionospheric structures and irregularities as required for space weather applications. The two major sources of polar cap F region plasma are the solar EUV radiation and the auroral precipitation. The region over which solar EUV production occurs is readily modeled. In contrast, the …

The Educational Pipelinie For Women In Biology: No Longer Leaking?, Louise Luckenbill-Edds Jan 2002

The Educational Pipelinie For Women In Biology: No Longer Leaking?, Louise Luckenbill-Edds

ADVANCE Library Collection

Describing the past 30 years of progress toward gender equity in science, one observer wrote: "Although optimistic about future prospects, I must also point out some daunting toads and serpents lurking in the gardens of science. These challenge the rising generation of young scientists to be no less intrepid [that past activists who catalyzed change]" (Herschbach 1999, p. 66). The failure of the sciences to attract and retain women has meant a loss of diversity, as well as a loss of talent and creativity, that impoverishes research viewpoints and limits effective communication of science with diverse sectors of society.

Environmental Assessment : Middle Salt Creek Canyon Access Plan Canyonlands National Park, Utah, National Park Service, U.S. Department Of The Interior, Canyonlands National Park

Canyonlands Research Bibliography

Salt Creek is the largest drainage in the Needles district of Canyonlands National Park. The creek supports one of the most important riparian ecosystems in the park. It is also the heart of the Salt Creek National Register Archeological District, the area with the highest recorded density of archeological sites in the park. A tributary canyon contains the spectacular Angel Arch, a well-known geologic formation that for many years has been a destination point for park visitors. In 1998 the U.S. District Court for the State of Utah ruled, in a lawsuit filed by the Southern Utah Wilderness Alliance, that …

Safeguarding Species, Languages, And Cultures In The Time Of Diversity Loss: From The Colorado Plateau To Global Hotspots, Gary Paul Nabhan, Patrick Pynes, Tony Joe

Canyonlands Research Bibliography

Hotspots of biodiversity have become priority areas for land conservation initiatives, oftentimes without recognition that these areas are hotspots of cultural diversity as well. Using the Colorado Plateau ecoregion as a case study, this inquiry (1) outlines the broad geographic patterns of biological diversity and ethnolinguistic diversity within this ecoregion; (2) discusses why these two kinds of diversity are often influenced by the same geographic and historic factors; and (3) suggests what can be done to integrate traditional ecological knowledge of indigenous peoples into multicultural conservation collaborations.

Synthesis And Chemistry Of Naphthalene Annulated Trienyl Iron Complexes: Potential Anticancer Dna Alkylation Reagents, Traci Means Jan 2002

Synthesis And Chemistry Of Naphthalene Annulated Trienyl Iron Complexes: Potential Anticancer Dna Alkylation Reagents, Traci Means

Inquiry: The University of Arkansas Undergraduate Research Journal

Iron complex chemistry that opens a new door to the medicinal and pharmaceutical worlds is the aim of this research. Specifically, ortho-quinone methide moieties are intermediates in several antitumor drugs and have been identified as bioreductive alkylators of DNA. In our research, a class of iron compounds has been targeted to resemble these quinone methides. It is hoped that these new compounds could be modified to provide a window of opportunity toward the discovery of a selective mode of drug delivery. We have focused our efforts on generating a reactive transition metal complexed 5-membered ring analog of o-quinone methide based …

Predicting Oral Reading Miscues, Jack Mostow, Joseph Beck, S. Vanessa Winter, Shaojun Wang Jan 2002

Predicting Oral Reading Miscues, Jack Mostow, Joseph Beck, S. Vanessa Winter, Shaojun Wang

Kno.e.sis Publications

This paper explores the problem of predicting specific reading mistakes, called miscues, on a given word. Characterizing likely miscues tells an automated reading tutor what to anticipate, detect, and remediate. As training and test data, we use a database of over 100,000 miscues transcribed by University of Colorado researchers. We explore approaches that exploit different sources of predictive power: the uneven distribution of words in text, and the fact that most miscues are real words. We compare the approaches’ ability to predict miscues of other readers on other text. A simple rote method does best on the most frequent 100 …

Workflow Quality Of Service, Jorge Cardoso, Amit P. Sheth, John A. Miller

Kno.e.sis Publications

Workflow management systems (WfMSs) have been used to support various types of business processes for more than a decade now. In ecommerce processes, suppliers and customers define a binding agreement or contract between the two parties, specifying quality of service (QoS) items such as products or services to be delivered, deadlines, quality of products, and cost of service. Management of such QoS directly impacts success of organizations participating in e-commerce. Organizations operating in modern markets require an excellent degree of quality of service management. Products and services must be available to customers with well-defined specifications. A good management of quality …

Shannon Research Press

This study had four major purposes. First, the study developed and used scales to measure the strength and coherence of students', teachers', and scientists' views, beliefs and attitudes in relation to science, technology and society (STS). Second, the factors which influenced the development of strong and coherent views on STS by students, were examined. Third, the study investigated whether male and female students differed in the strength and coherence of their views on STS. Fourth, structured group interviews with teachers provided information for the consideration of the problems encountered by teachers and students in the introduction of STS courses.

Supreme Court Voting Behavior: 2000 Term, Richard G. Wilkins, Scott Worthington, Carter K. F. Chow, Sarah K. L. Chow

UC Law Constitutional Quarterly

This Study, the fifteenth in a series, tabulates and analyzes the voting behavior of the United States Supreme Court during the 2000 Term. The analysis is designed to determine whether individual Justices and the Court as a whole are voting more "conservatively," more "liberally," or about the same when compared with past Terms. This Term's survey shows mixed results, but suggests slight liberal movement for the Court as a whole, following last Term's conservative voting trend. The Court voted more liberally in six of the ten categories of the Study this Term compared to last Term. However, the strength of …

Acoustic Remote-Sensing Of Reef Benthos In Broward County, Florida (Usa), Ryan P. Moyer, Bernhard Riegl, Richard E. Dodge, Brian K. Walker, David S. Gilliam Jan 2002

Acoustic Remote-Sensing Of Reef Benthos In Broward County, Florida (Usa), Ryan P. Moyer, Bernhard Riegl, Richard E. Dodge, Brian K. Walker, David S. Gilliam

Marine & Environmental Sciences Faculty Proceedings, Presentations, Speeches, Lectures

Benthic assemblages of variable density cover three progressively deeper ridges that parallel the Broward County, Florida, coast. An acoustic bottom classification survey using QTCView5 with a 50 kHz transducer showed different acoustic classes on the shallow reef-ridge and the two deeper reef-lines, which both showed the same acoustic signature. Ground-truthing showed that the differences in acoustic signature corresponded to different benthic assemblages: nearshore hardgrounds had low live cover and were dominated by algae covering substrate, the two deeper reef-ridges had the same acoustic signature and similar benthic assemblages (dominated by sponges and gorgonians). The QTCView5 was also able to differentiate …

On Quadrature Rules Associated With Appell Polynomials, Gabriella Bretti, Matthew He, Paolo E. Ricci

Mathematics Faculty Articles

A quadrature rule using Appell polynomials and generalizing both the Euler-MacLaurin quadrature formula and a similar quadrature rule, obtained in Bretti et al [15], which makes use of Euler (instead of Bernoulli) numbers and even (instead of odd) derivatives of the given function at the extrema of the considered interval, is derived. An expression of the remainder term and a numerical example are also enclosed.

Small-Angle Neutron Scattering Of Soot Formed In Laminar Premixed Ethylene Flames, Hai Wang, Bin Zhao, Barbara E. Wyslouzil, Kiril A. Streletzky Jan 2002

Small-Angle Neutron Scattering Of Soot Formed In Laminar Premixed Ethylene Flames, Hai Wang, Bin Zhao, Barbara E. Wyslouzil, Kiril A. Streletzky

Physics Faculty Publications

We used small-angle neutron scattering (SANS) to measure soot development in one-dimensional, laminarpremixed flames. Scattering spectra were collected for two sooting ethylene/oxygen/argon flames at six positions above the burner surface. A detailed analysis of the scattering signals yielded the basic properties of the soot size distributions as a function of position. The experiments demonstrate that SANS can be used to extract spatially resolved, quantitative information about incipient soot formation and growth with better particle size resolution than light scattering and extinction.

Thermal Hysteresis In The Charge-Density-Wave Transition Of Lu5rh4si10, C. S. Lue, Y. K. Kuo, F. H. Hsu, H. H. Li, H. D. Yang, Petru S. Fodor, Lowell E. Wenger Jan 2002

Thermal Hysteresis In The Charge-Density-Wave Transition Of Lu5rh4si10, C. S. Lue, Y. K. Kuo, F. H. Hsu, H. H. Li, H. D. Yang, Petru S. Fodor, Lowell E. Wenger

Physics Faculty Publications

We report the detailed studies of resistivity, magnetic susceptibility, heat capacity, thermal conductivity, and thermoelectric power on the charge-density-wave (CDW) material Lu5Rh4Si10 in the vicinity of its transition temperature T0 ∼ 147 K. Pronounced thermal hystereses loops between heating and cooling cycles have been observed in all measured quantities, making this system very unique as compared to other isostructural compounds such as Lu5Ir4Si10. The thermal hysteresis features in Lu5Rh4Si10 are attributed to the presence of metastable states arising from pinning of the CDW phase to impurities. In addition, the measured physical quantities are magnetic field independent up to 8 T, …

O' Big Brother Where Art Thou?: The Constitutional Use Of Facial-Recognition Technology, 20 J. Marshall J. Computer & Info. L. 471 (2002), Susan Mccoy

UIC John Marshall Journal of Information Technology & Privacy Law

How to balance the protection of personal privacy and security in light of the use of facial recognition technology? The author argues that the use of facial recognition technology does not violate individual's Fourth Amendment rights to privacy. First, there is no reasonable expectation of privacy in public places. Second, the database used only contains the identities of known criminal and terrorists. Third, facial recognition technology only facilitates existing methods of screening and comparing mug shots of known criminals on the street. With these arguments, the author proposes suggestions to legislations that cover facial recognition or other biometric technologies. In …
