The Supreme Court's recent decision in Zelman v. Simmons-Harris appears to clear the way for a wide variety of educational and charitable choice plans. In this decision, the Court upheld against Establishment Cause Challenge a formally neutral school choice program that encompassed a wide variety of options in the public and private sector, including private sectarian schools. The Court reasoned that, when the government makes aid available to a broad class of recipients without regard to their religious or non-religious affiliation, and when the recipients have a genuine choice as to whether to obtain that aid from a religious or …

Using the Student Characteristics: Iowa Test of Basic Skills (ITBS) composite national percentile scores, repeating fourth grade, spring third grade Developmental Reading Assessment (DRA) scores, socioeconomic status, race, gender, and preschool attendance and the School Characteristics: teacher degree level, teacher experience, teacher professional development, and school Title I status, this study employed a stepwise multiple regression analysis to determine the best predictors of fourth grade scores on the Louisiana Educational Assessment Program for the 21st Century (LEAP 21). Squeezing The Juice® Out Of The Washington Redskins®: Intellectual Property Rights In "Scandalous" And "Disparaging" Trademarks After Harjo V. Pro-Football Inc., Cameron Smith

In Harjo v. Pro-Football Inc., the Trademark Trial and Appeal Board cancelled the federally registered trademarks THE WASHINGTON REDSKINS, REDSKINS, and REDSKINETIES after finding them to be disparaging matter under section 2(a) of the Lanham Act. Pro-Football has appealed the Board's decision to the U.S. District Court for the District of Columbia. This Note argues that Harjo's adoption of the "substantial composite" standard for analyzing disparaging trademarks potentially ignores the majority of the implicated group members' viewpoints and promotes section 2(a) trademark cancellations. Primarily derived from a March 2001 conference held in Regina, Saskatchewan, these essays present diverse perspectives on various connections between First Nations and Metis peoples and the Canadian Plains. Designed to create a more holistic perspective, the conference and this companion book used a wide variety of presentational formats to capture the diversity of past and present connections between Aboriginal Peoples and the prairies. Court Review: Journal of the American Judges Association

The judicial decision-making process is not one for which resolution arises from counting, measuring, or weighing. Rather, the courtroom is a field for debate about the interpretation and application of values as embodied in or reflected by the law. Decisions reached in court are judgments and not mathematical conclusions in that the inherently contestable nature of the issues at stake precludes an outcome that is selfevident to all. The twenty-first century presents opportunities, as well as limitations, for the American Indian Nations of the Great Plains. Opportunities include enhanced economic development activities (e.g., casino gambling, telecommunications, and high-tech industries) and innovative tribal programming such as language immersion programs made possible through enhanced self-governance initiatives. Limitations include familiar scripts that perpetually threaten tribal sovereignty and chronically underfunded annual appropriations for Native American health, housing, and social service programs.

The Ponca Tribe of Nebraska, terminated in 1965 and restored to federally recognized status in 1990,1 embraces these challenges by exploring the limits of self-governance, economic development opportunities, and cultural …

The human impulse for attribution symbolizes the linkage between an author and her creative work. In many countries, authors are afforded a right of attribution as part of a broader doctrine known as moral rights. The United States, however, does not adequately protect moral rights. This Article focuses exclusively on the right of attribution as one component of the moral rights doctrine. Initially, it examines the connection between copyright law and the right of attribution and establishes the inadequacy of the current copyright law as a means of safeguarding the right of attribution. Economics Working Papers

The Ottoman government obtained current information on the empire's sources of revenue through periodic registers called tahrir defterleri. These documents include detailed information on tax-paying subjects and taxable resources, making it possible to study the economic and social history of the Middle East and Eastern Europe in the fifteenth and sixteenth centuries. Although the use of these documents have been typically limited to the construction of local histories, adopting a more optimistic attitude toward their potential and using appropriate sampling procedures can greatly increase their contribution to historical scholarship. On Apology And Consilience, Erin Ann O'Hara, Douglas Yarn

Washington Law Review

This Article joins the current debate about the proper relationship between apology and the law. Several states are considering legislation designed to shield apologies from the courtroom, and mediators are increasing their focus on the importance of apologies. The article develops an evolutionary economic analysis of apology that combines the tools of economics, game theory, and biology to more fully understand its role in dispute resolution. When the analysis is applied to the uses of apology before and at trial, a more sophisticated understanding of the relationship between apology and the law emerges.

The following is my attempt to assess the plausibility and desirability of different levels of Pan-Africanism from the perspectives of Africans and Diasporans. I use historical, cultural and social considerations from both perspectives in my assessment. The observations by the author took place in Ghana between August and November of 2002. Observations from American culture are from the author's experience as an African-American.

The Holy, Non-Christic Biblical Subtexts In Superman: The Movie (1978) And Superman Ii (1981), Anton K. Kozlovic

Journal of Religion & Film

The sacred-secular parallels between Jesus Christ and Kal-El/Clark Kent/Superman in Superman: The Movie (1978) and Superman II (1981) were explicated previously in JR&F. Despite the persuasive Christic subtext, the richness of the biblical parallels within these two SF films did not stop with just an alien Messiah. Further engineered biblical correspondences existed that complemented the Christic subtext and uprated the overall sanctity of the filmic narratives. Three areas of holy infranarratives were identified and explicated pertaining to: (a) divine figurations, (b) blessed parents, and (c) holy associates. Further research into this exciting field was recommended.
