Speech Or Opinion? Two Objects Of First Amendment Immunity, Jeremy J. Ofseyer Jan 2002

Speech Or Opinion? Two Objects Of First Amendment Immunity, Jeremy J. Ofseyer

Utah Law Review

There is a widespread sense in scholarly circles that First Amendment jurisprudence is riddled with conflict and confusion. Many observers lament that the United States Supreme Court's doctrinal framework for adjudicating free speech cases is deeply incoherent. The eminent First Amendment scholar Thomas Emerson wrote pessimistically in 1966: "No one concerned with freedom of expression in the United States today can fail to be alarmed by the unsatisfactory state of First Amendment doctrine.... [N]o really adequate or comprehensive theory of the First Amendment has been enunciated, much less agreed upon."

Raising Cultural Awareness In The Elementary Classroom Through African-American Children's Literature, Kirsten Seebeck Jan 2002

Raising Cultural Awareness In The Elementary Classroom Through African-American Children's Literature, Kirsten Seebeck

Graduate Research Papers

This research project topic was selected because of the need for raised cultural awareness in elementary classrooms, as indicated in current research findings. I chose African-American literature because in this region of the United States, Iowa in particular, the classrooms tend to be largely homogenous. Children who are from African-American descent find themselves to be in the minority in their classroom settings.

These children are not seeing many other children like themselves in their school community. It is therefore important that they see themselves in the literature shared within this community, in order to help them to relate to their …

Motivation And Mandatory Standardized Testing: Utilizing The School Counselor As Consultant, Liaison, Trainer, And Advocate, Trent Taylor

Graduate Research Papers

Since the publication of "A Nation at Risk" in 1983, the emphasis on using standardized testing has dramatically increased (Burke & Lombardi, 1998). Political candidates at all levels are using the issues of accountability and testing in campaign advertisements and as focal points to attack opponents. Today, hundreds of thousands of achievement and aptitude tests are administered each year in educational settings (Hood & Johnson, 1997).

Literature Review : Using Humor With Children, Carol J. Aswegen Thornhill Jan 2002

Literature Review : Using Humor With Children, Carol J. Aswegen Thornhill

Graduate Research Papers

The purpose of this paper is to explore and review the literature on humor, particularly as it relates to interactions with children. Often adults, whether they are parents or teachers, devalue the use of humor in dealing with children. Research supports that humor is a beneficial component of social interactions, especially with children. Studies have shown that children are receptive to humor beginning at very young ages, and that their sense of humor is developed and finely tuned as they mature. Findings show that by using humor in social situations, stress levels can be de-escalated, defensive reactions are reduced--which in …

All students need a safe and nurturing environment to receive a quality education. Principals should treat students as individuals judged by their character and learning style as well as their capabilities. To be an effective administrator and to establish a strong foundation, the principles of the Iowa Standards for School Leaders (ISSL) are used as guides. I will discuss each of the ISSL principles and explain how they influence my philosophy of educational leadership.

Afterword: The Linkage Problem – Comments On Five Texts, John H. Jackson Jan 2002

Afterword: The Linkage Problem – Comments On Five Texts, John H. Jackson

Georgetown Law Faculty Publications and Other Works

The problem of linkage between "non trade" subjects and the World Trade Organization is certainly one of the most pressing and challenging policy puzzles for international economic relations and institutions today. It is extensively and harshly debated by political leaders and diplomats, at both the national and the international levels of discourse, and is one of several issues that derailed the WTO Third Ministerial Conference in Seattle in late 1999. It also posed problems for the Fourth Ministerial Conference in Doha, Qatar, in November of 2001, and it threatens to derail the successful functions of the WTO itself. With the …

After/Word(S): 'Violations Of Human Dignity' And Postmodern International Law, Barbara Stark

Hofstra Law Faculty Scholarship

"Never again!" was the crie de coeur of the world leaders after World War II. "Never again" would they tolerate death camps, mass graves, or other crimes against humanity. Several genocides later, however, the phrase has become ironic. Innumerable international as well as national laws have been enacted, but they have failed to stop the carnage. This was the subject of a recent symposium in the American Journal of International Law, which assembled some of the leading minds in international law to analyze the problem from seven different perspectives. Postmodern International Law (PIL) was not among them.

Demographic Factors In East Asian Regional Integration, Geoffrey Mcnicoll Jan 2002

Demographic Factors In East Asian Regional Integration, Geoffrey Mcnicoll

Poverty, Gender, and Youth

The Remapping Asia project, to which this paper is a contribution, investigates broad spatial changes in the ways that East Asia’s political and social life are organized and economies operate. Such changes are attributable to planned action of governments, firms, and other organized groups and to the unorganized but in some measure predictable behavior of myriad families and individuals. The project’s particular interest is in processes of regionalization-both through the deliberate construction of political institutions and through the largely unplanned emergence of regional affiliations and identities. Demographic factors play a potentially significant part both in promoting and in impeding regional …

Narrative, Meaning Making And Personal Development: Teachers' Storied Experience In Montessori, Steiner And Other Primary Classrooms, Gayle C. Ward Jan 2002

Narrative, Meaning Making And Personal Development: Teachers' Storied Experience In Montessori, Steiner And Other Primary Classrooms, Gayle C. Ward

Theses

This study explored how narrative was being used to foster meaning-making in Montessori, Steiner, Government and Catholic schools. In-depth interviews of twelve teachers from the four educational settings were used to collect the teachers' stories that comprised the data on narrative use. NUD*IST software was employed to organise data and to focus on emerging concepts through data analysis. A wide spectrum of narrative uses related to meaning making was revealed. These varied understandings support using narrative to foster insight on three levels relating to several theoretical views of narrative and its importance.

PERSPECTIVE: All we are and everything we do is a spiritual matter because we live in the context of God's presence, purpose, and power. In all we are, think, say, and do in this course, individually and collectively, we should seek to be conscious of God's constant and pervading presence. We should also consciously and consistently seek God's purpose for us in this course. We need to be open, receptive, and responsive to the power of the Holy Spirit at every level of this course as the mediator of God's presence and the actualizer of God's purposes. We must bathe …

In addition, attention is given to thinking, valuing and living biblically by learning how to apply Scripture to life and ministry. This course seeks …

Communicating About Aids-Changes In Understanding And Coping With Help Of Language In Urban Kagera, Tanzania, Aldin Mutembei, Maria Emmelin, Joe Lugalla, Lars Dahlgren Jan 2002

Communicating About Aids-Changes In Understanding And Coping With Help Of Language In Urban Kagera, Tanzania, Aldin Mutembei, Maria Emmelin, Joe Lugalla, Lars Dahlgren

Institute for Educational Development, East Africa

Faced with the problems of HIV/AIDS, people have to find ways to communicate around them. The aim of this paper is to mirror changes over time in the Kagera people's social cognition regarding HIV/AIDS, using their own language as a tracer of this process. Focus group discussions and personal and group interviews conducted during 1992 to 1995 in urban Bukoba, Kagera, constitute the basis for an analysis of metaphorical expressions in use since 1985. Pronounced uncertainty is later transformed into a deeper understanding of the pandemic and an increased disposition to cope with the situation. Knowledge about the socio-linguistic expressions …

Constructing A Common Ukrainian Identity: An Empirical Study, Igor Khrestin '02 Jan 2002

Constructing A Common Ukrainian Identity: An Empirical Study, Igor Khrestin '02

Res Publica - Journal of Undergraduate Research

In National Identity, a seminal study concerning nations and national identity, Anthony Smith defines national identity as "a named human population sharing common myths and symbols, historical memories, a mass, public culture, a common economy and common legal rights and duties for all members (Smith 1991, p.14)." According to Smith, these components are absolutely necessary for a nation to function. However, does this definition apply to the experience of all nations? Are there particular historical, geopolitical, or social factors that have shaped the development of a common national identity?
