State Eligibility Rules Under Separate State Schip Programs--Implications For Children's Access To Health Care, Sara Rosenbaum, Anne Rossier Markus
Health Policy and Management Issue Briefs
This Policy Brief is the fourth in a series of reports1 issued by the George Washington University Center for Health Services Research and Policy that examine the design of separately-administered State Children’s Health Insurance Programs (SCHIP) that is, programs that operate directly under the authority of the federal SCHIP statute rather than expansions of state Medicaid programs.2 These Policy Briefs also consider the implications of states’ design choices for children’s access to health care.

Mission To Assess Future Sustainable Options Of The Lao Uxo Trust Fund And The Uxo Lao Mine Action Programme, Robert Keeley, Alison Allcock, Thongdeng Singthilath, Marty Kongsaysy
Global CWD Repository
This report sets out some ideas for scoping the contamination problem in Lao PDR and suggests ways by which priority areas could be identified. This leads to means by which long, medium and short term strategic action plans could be developed and an exit strategy for international assistance established. This report then identifies two options for reconstructuring the UXO program that address stakeholder concerns.

Introduction To Comparative Constitutionalism, Martha C. Nussbaum
Introduction To Comparative Constitutionalism, Martha C. Nussbaum
Chicago Journal of International Law
Comparative constitutionalism is an area of legal scholarship with a long history, and it has long been an area in which legal scholars collaborate with scholars in other disciplines, such as political science, philosophy, and sociology. Recently, as globalization has fostered closer relations among nations and as international treaties and agreements have played an increasing role in many nations' understanding of their domestic legal traditions, the need to study constitutional issues comparatively has come to seem even more urgent and the interdisciplinary collaboration involved even more fruitful and exciting. The symposium on Comparative Constitutionalism centers on Mark Tushnet's article, State …
Between Liberalism And Social Democracy: A Comment On Tushnet, Iris Marion Young
Between Liberalism And Social Democracy: A Comment On Tushnet, Iris Marion Young
Chicago Journal of International Law
I construct Professor Tushnet's article as offering an account of societies on a legal continuum. At one end lies the classical liberal state. Here the legal system articulates a thin set of background rules that regulate the market transactions through which goods are distributed. Courts enforce rules against force, fraud, and breach of contracts. By means of police power courts have some discretion to identify forms of force, fraud, or breach of contract not explicitly articulated by legislated code. In the classical liberal state, courts also strike down laws that intentionally deprive a class of people of goods they would …
Introduction - International Regulatory Harmonization, Andrew T. Guzman
Introduction - International Regulatory Harmonization, Andrew T. Guzman
Chicago Journal of International Law
Because we live in a world of national laws and international business activity, the regulation of a single transaction can be affected by several different legal regimes. Within domestic systems, even if sub-units such as the states of the United States exist, there is a central government authority that can regulate such transactions. In the international arena, the problems are more difficult. There is no supranational authority able to impose international standards; attempts at harmonization must overcome greater differences in culture and legal tradition; and national lawmakers are often resistant to any form of international rulemaking. How, then, should international …

Competitiveness : Perceptions, Reflections And Directions, D K Banwet, Kirankumar Momaya, Himanshu Kumar Shee
Competitiveness : Perceptions, Reflections And Directions, D K Banwet, Kirankumar Momaya, Himanshu Kumar Shee
IIMB Management Review
Competitiveness has gained importance as a subject of study during the last decade or so. The initial stimulus came during the eighties when the US experienced an economic decline. As American firms started losing ground all over the world in significantly important industries such as automobile, shipbuilding, electronics and steel, researchers began focussing attention on country and industry level competitiveness. Given India’s low and declining ranking in the Global Competitiveness Report and the World Competitiveness Yearbook, it is imperative that academics, industrialists and policy makers make a serious study of the factors that drive competitiveness at all levels, and take …
Trips And Ipr : The Heart Of The Matter, T N Srinivasan
Trips And Ipr : The Heart Of The Matter, T N Srinivasan
IIMB Management Review
T N Srinivasan, currently Samuel C Park Jr Professor of Economics, Yale University and special advisor to the World Bank, raised the three issues which he feels are at the heart of the debate over TRIPS and IPR — Are patents necessary for innovation? What is the best way to provide life saving drugs to the poor at a price they can afford? What is the best way to minimise the cost of production of these drugs? There is the fundamental assumption in the utilitarian view that most IPR regimes subscribe to, that by granting a patent you are going …
