'Can We Go Home Now?' Expediting Adoption And Termination Of Parental Rights Appeals In Ohio State Courts, Susan Wawrose Jan 2002

'Can We Go Home Now?' Expediting Adoption And Termination Of Parental Rights Appeals In Ohio State Courts, Susan Wawrose

School of Law Faculty Publications

Two years ago, the Ohio Supreme Court amended its rules and those of Ohio's intermediate appellate courts in order to fast-track appeals of cases involving termination of parental rights ("TPR") and adoption of minor children. Three of Ohio's twelve appellate districts already had local rules to expedite or accelerate these types of appeals, but in some districts, the amended rules established procedures that were entirely new.

The major impetus behind the court's amendments to the rules was to move children out of foster care and into permanent adoptive homes more quickly. Further, by amending the rules of the intermediate appellate …

A Government For The People, Rebecca L. Brown

University of San Francisco Law Review

This essay proceeds in two parts. The first half presents the authors understanding of the major steps in Eisgruber's argument. The second half of this essay will be devoted to discussing both the most troubling aspect of Eisgruber's account, in my view, and its most valuable contribution to a better polity. Both center around his pervasive reliance on the concept of moral judgment.

The Enigma Of Stigma: A New Environmental Contamination Challenge Facing Canada's Judiciary, Jodie Hierlmeier Jan 2002

The Enigma Of Stigma: A New Environmental Contamination Challenge Facing Canada's Judiciary, Jodie Hierlmeier

Dalhousie Journal of Legal Studies

Would you buy previously contaminated property? The average citizen, given the choice between property with no history of contamination and one with prior environmental problems (even if they have been remediated), will instinctively choose the former over the latter. This is the phenomenon known as stigma. The recent case, Tridan Developments Ltd. v. Shell Canada Products Ltd. marks the first time that Canadian courts have squarely addressed the issue of stigma with the trial judge awarding damages for the diminution in property value over and above the costs of remediation for a contaminated property on the basis of stigma. The …

Workshop On Assistance To Landmine Survivors And Victims In South-Eastern Europe, Cisr

Global CWD Repository

The “Workshop on Assistance to Landmine Survivors and Victims in South-Eastern Europe: Defining Strategies for Success” held in Ig, Slovenia July 1-2, 2002 was a unique forum to address the existing gaps in services and possible solutions for filling these gaps for mine victims assistance (MVA) in the region. This workshop was initiated by the International Trust Fund (ITF) Board of Advisors, who determined there was a need to bring donors together with those working for MVA.

The goal of the workshop was “to identify possible strategies and venues for regional resourcing, cooperation and coordination in the field of landmine …

The Availability Heuristic In Judgments Of Research Findings: Manipulations Of Subjective Experience, Michele A. Shams Jan 2002

The Availability Heuristic In Judgments Of Research Findings: Manipulations Of Subjective Experience, Michele A. Shams

All Volumes (2001-2008)

Previous studies have demonstrated that what is easy to call to mind will influence judgments. The impact of a person's subjective experience was tested for its influence on judgments of social psychological research findings. Eighty three college students generated examples of 40 research findings. Students subsequently judged the ease with which the examples came to mind and the probability of experiencing similar examples. Students then evaluated the obviousness and importance of and their interest in the research outcomes. Students also provided demographic information and indicated their previous knowledge in psychology. In the current study, the ease with which examples of …

Baseline Study Of The Hooded Pitcher Plant (Sarracenia Minor): Its Utility As An Indicator Species Of Freshwater Wetland Habitats, Dawn Beaulac, Justin Walguamery, Ryan Meyer

All Volumes (2001-2008)

The hooded pitcher plant, Sarracenia minor, is an important member of bog and seepage savanna communities of the southeastern United States. Unfortunately these wetland communities have been damaged and are disappearing at an alarming rate. The goal of this study was to collect baseline data, which will be ultimately used to develop a model of the survivorship, growth rate, morphology and population dynamics of four populations of Sarracenia minor. The model will assess the effects of several environmental factors on changes in the morphology and population dynamics of S. minor on the UNF campus. Measurements on the survival, …

Using Benford's Law To Detect Fraud In The Insurance Industry, Meredith Maher, Michael D. Akers Jan 2002

Using Benford's Law To Detect Fraud In The Insurance Industry, Meredith Maher, Michael D. Akers

Accounting Faculty Research and Publications

Benford's Law is the mathematical phenomena that states that the first digits or left most digits in a list of numbers will occur with an expected logarithmic frequency. While this method has been used in industries such as oil and gas and manufacturing to identify fraudulent activity, it has not been applied to the health insurance industry. Since health insurance companies process a large number of claims each year and these claims are susceptible to fraud, the use of this method in this industry is appropriate. This paper examines the application of Benford's Law to four health insurance companies located …

Destination Marketing Organization Visitor Information And The Representation Of Parks, Lynn M. Jamieson, Barbara A. Masberg Jan 2002

Destination Marketing Organization Visitor Information And The Representation Of Parks, Lynn M. Jamieson, Barbara A. Masberg

Visions in Leisure and Business

The relationship between the marketing efforts of destination management organizations and the accuracy and efficiency of the marketing efforts with respect to parks are a tedious and inconsistent one. This study extended the work of Masberg and Jamieson by reporting the results of a quantitative analysis of the representation of parks in visitor information. In a study of the representation of parks in tourism collateral materials, it was found that information about parks is inconsistently addressed. A quantitative analysis of park roles and scope showed that approximately 10 out of 324 packets represented parks thoroughly and accurately. An effectiveness guide …

Adaptation Of The Team Problem Solving Assessment Tool For Teambuilding Applications, Timothy R. Borton, David L. Groves Jan 2002

Adaptation Of The Team Problem Solving Assessment Tool For Teambuilding Applications, Timothy R. Borton, David L. Groves

Visions in Leisure and Business

Team building is popular with business, organizations and universities because of its ability to improve performance through group's processes. Even though teambuilding is commonly used by businesses, there are few tools that measure the effectiveness of teambuilding quantity. One author suggests that there is a large amount of anecdotal evidence that teambuilding is effective, but quantity measures of teambuilding related to the outcomes it produces exists. The purpose of this project was to adapt the Team Problem Solving Assessment Tool (TPSAT) by Armando J. Rotondi for teambuilding events. A Delphi approach was used with content experts to modify the instrument.
