Prescription drug expenditures make up less than 10 percent of total personal health care expenditures in the United States, but over the last decade the amount that Americans spend on prescription drugs has grown much faster than any other component of personal health care. For example, between 1999 and 2000, hospital care costs rose about 5 percent, physicians and clinical services 6 percent, while prescription drug expenditures climbed more than 17 percent. In dollar amounts, prescription drug expenditures doubled, from $61 billion to $122 billion, between 1995 and 2000. Is this an unwarranted expense that needs to be controlled, or …

The recent development of geographic information systems (GIS) provides new avenues for analysing spatial patterns in insect populations. Field survey data, along with GIS and statistical models were used to predict the distribution of Chilo partellus (Swinhoe) (Lepidoptera: Crambidae) and Cotesia flavipes Cameron (Hymenoptera: Braconidae) in Ethiopia. The results obtained suggested that the distributions of Ch. parlellus and Co. flavipes were affected by rainfall and temperature. The predicted distributions of Ch. parlellus and Co. flavipes were similar. Validation of predicted values is discussed. © 2002 ICIPE.

The efficacy of neem kernel cake powder water extract (NKCP-WE) and Dipel 2x (Bacillus thuringiensis var. kurstaki) in controlling the diamondback moth (DBM), Plutella xylostella Linn. (Lepidoptera: Yponomeutidae), on cabbage was evaluated in screenhouse experiments. All concentrations of NKCP-WE tested were larvicidal and plants treated with 25 and 50 g/l NKCP-WE retained larvicidal activity for up to 2 weeks after application. The efficacy of 25 and 50 g/l NKCP-WE and 0.5 g/l Dipel 2x was compared by observing DBM development on the treated plants and yields of those plants. The demographic statistics of the ladybird Exochomus flaviventris Mader (Coleoptera: Coccinellidae) were investigated under laboratory conditions on the cassava mealybug, Phenacoccus manihoti Matile-Ferrero (Homoptera: Pseudococcidae), reared on four host plants with different levels of antibiotic resistance to the mealybug: two cassava (Manihot esculenta Crantz, Euphorbiaceae) varieties, Incoza and Zanaga, Faux-Caoutchouc (FC) (hybrid of M. esculenta x M. glaziovii Muel. Arg.) and water weed (Talinum triangulare Jack, Portulacacae). Preimaginal mortality, mean oviposition time and total fecundity of female ladybirds were strongly affected by the host plant even though there was no linkage with antibiotic resistance. A strain of diamondback moth (DBM), Plutella xylostella (L.) (Lepidoptera: Plutellidae), adapted to peas was detected in 1999 in the export vegetable growing area south of Lake Naivasha in the Rift Valley Province of Kenya. The pea strain (DBM-P) was compared in laboratory studies to the normal crucifer strain (DBM-C). Whereas DBM-P performed comparably well on kales and peas, the cabbage strain (DBM-C) suffered heavy mortality on peas. Out of the 250 DBM-C first instars, only six reached adult stage on pea. The influence of banana weevil, Cosmopolites sordidus (Germar)(Coleoptera: Curculionidae), population density on oviposition rates and larval survivorship was studied in the laboratory at the Kawanda Agricultural Research Institute in Uganda. This study was undertaken to elucidate the relationship between density-dependent factors and rates of banana weevil increase in the field. Oviposition substrates (corm pieces) were offered to a range of densities of weevils maintained in buckets. Mean oviposition rates per female at densities of 10, 20 and 40 females per bucket were 29, 37 and 53%, respectively, lower than that at a density of 5 females. Law and policy implications of the precautionary principle in the field of marine environmental protection are explored in this paper in a three-part analysis. First, seven slippery aspects of the precautionary principle are highlighted, including confusion in terminology, definitional variations, definitional generalities, the spectrum of precautionary measures available, ongoing philosophical tensions and competing socioeconomic interests, debate over who should be responsible for making precautionary decisions, and limited interpretation by international tribunals. After reviewing the tricky nature of the precautionary principle/approach, such as confusion over terminology and the spectrum of precautionary measures available, the article through a four-part format describes Canadian initiatives and efforts to implement the precautionary principle/ approach in ocean and coastal management. First, Canada's general steps to adopt the precautionary principle are discussed including caselaw developments and the limited embracing of precaution in environmental impact assessment review and strategic planning processes. This article focuses on ethics problems related to hourly billing by analyzing the results of a survey of 1000 randomly selected associates in Texas firms who (1) had been licensed for ten or fewer years as of June 1999, and (2) worked in private law firms with more than ten attorneys (the Associate Survey). This article addresses the need for firm managers to clarify how and what their attorneys should bill. In a series of lectures at Harvard University, Professors Lani Guinier and Gerald Torres posited that people of color are the "miner's canary" in American society. Guinier and Torres argue that pursuing color blindness policies is dangerous because it ignores racial differences that affect every aspect of our society. The practice of pain management has not kept pace with the many medical advances that have made it possible for physicians to ameliorate most pain. This Article analyzes the principle of "trademark exhaustion" or "first-sale rule" in the European Union (EU), with particular attention to the language and different interpretations of Article 7(1) of the First Council Directive 89 104 EEC of December 21, 1988. Traditionally, most jurisdictions define the extent of trademark exhaustion as either "national" or "international" exhaustion, depending on whether the rights granted by a mark are considered exhausted only in the domestic territory or also in foreign jurisdictions. Subsequent histories have been apart of Texas case citation since the turn of the century. For most of that time, the information for subsequent histories was gleaned from paper sources, including the Texas Subsequent History Tables and Texas Shepard's Citations. The subsequent history information available to practitioners from these sources was limited by the controlled set of notations used by legal publishers. With the advent of electronic sources, this set of notations has become inadequate. The lesson of DDT's rise and fall is that property rights play a critical role in checking public policy abuses. Respect for property rights requires public actors to obtain property owners' consent before they take actions (e.g. pesticide spraying) that affect the property owners. When property rights are respected, spillover impacts are minimized. Public policies imposed without consent, even if done with good intentions, may produce bad effects. Those effects may result in the policy being rightly abandoned, but may also spur other policies that produce more bad effects. A full account of the judicial influence on Social Security disability programs would require a book-length, perhaps even encyclopedia-length, treatise and would take us far afield from our present concern. This article focuses narrowly on the activities of Legal Services attorneys, mental health reformers, and children's advocates. Although mental health reformer groups are only one of many antipoverty organizations involved in advocacy efforts on behalf of the disabled poor, they have been among the most persistent, the most active, and the most successful in using a litigation strategy to achieve their larger policy goals.
