Making Sense Of Pretext: An Analysis Of Evidentiary Requirements For Summary Judgment Litigants In The Fifth Circuit In Light Of Reeves V. Sanderson Plumbing Prodcuts, And A Proposal For Clarification., Eric S. Riester

Although the United States Supreme Court in Reeves v. Sanderson Plumbing Products, Inc. attempted to clarify the summary judgment landscape of Title VII employment discrimination cases, lower courts in the Fifth Circuit are still without guidance. Under Reeves, direct proof of discrimination is not required to defeat a motion for summary judgment as long as the circumstantial evidence allows a reasonable inference of discrimination. The required strength of the circumstantial evidence, however, remains a major issue in the Fifth Circuit. Since Reeves, the Fifth Circuit has not stated a uniform summary judgment standard, nor has it answered how much circumstantial …

This article argues for attending to the perspectives of those most directly affected by, but least often consulted about, educational policy and practice: students. The argument for authorizing student perspectives runs counter to U.S. reform efforts, which have been based on adults’ ideas about the conceptualization and practice of education. This article outlines and critiques a variety of recent attempts to listen to students, including constructivist and critical pedagogies, postmodern and poststructural feminisms, educational researchers’ and social critics’ work, and recent developments in the medical and legal realms, almost all of which continue to unfold within and reinforce adults’ frames …

Neglected Issues In Research On In-Home Services In Child Welfare: Final Report, Julia H. Littell, Leslie B. Alexander, Heather Girvin, William W. Reynolds

This study considers several previously unexamined issues that affect the delivery and outcomes of intensive, in-home services for families of abused and neglected children. In this report, we present new, empirical data on parents' and other primary caretakers' readiness for change, their alliances (working relationships) with in-home services caseworkers, and the nature and extent of their substance use. we look at these issues--and at caretakers' tendencies to give socially desirable responses--in relation to change over time in caretaker and family functioning, housing and economic conditions, social support, child well-being, the recurrence of child maltreatment, and out-of-home placement.

Abraham Lincoln understood judicial activism. For Lincoln, the paradigm of the unrestrained Supreme Court was the decision in Dred Scott v. Sandford. Lincoln saw the "illegitimacy" of Dred Scott not in that the Supreme Court had overturned an act of Congress. It was, rather, that the Supreme Court, in the guise of making a legal decision, instead made a political decision. Even worse, it was a political decision that sought to redefine the polity in fundamental, constitutional terms. As you know our primary focus today is on the Sulzer knee and hip replacement class action. My remarks are intended to place this fascinating and innovative case in the larger context of the many issues that we all face as participants in our modern civil justice system. I am going to do this by briefly refreshing your recollection as to the procedural requirements for modern class actions, describing the ongoing controversy surrounding use of these procedures, and touching on reform efforts currently underway. Advances in combinatorial chemistry have provided the pharmaceutical industry with innumerable lead compounds that could potentially serve as therapeutic agents. One of the challenges in the further development of such compounds is to rapidly, yet inexpensively, distinguish those that have undesirable effects such as genotoxicity. Thus, a simple biological assay that would permit the identification of potential DNA mutagens, and be adaptable to high-throughput technologies would be cost effective in screening such lead compounds. The current methods use the Ames and SOS tests involving prokaryotic organisms, while systems that utilize mammalian cell culture and/or animal testing are time-consuming and expensive. …

The purpose of this project was to design classroom Literacy Centers incorporating the Washington State Essential Academic Learning Requirements that promote emergent literacy skills in primary level children. Using Literacy Centers to enhance a child's ability to read, write, listen, and communicate is the focus of this project. The centers are intended to be a hands-on and authentic method of learning for young children. The review of relevant literature shows that this option provides positive experiences in a primary level classroom. Adaptable center plans are included as well as management and assessment suggestions.
