A Ghost In Europe: Right-Wing Extremism And Its Metamorphoses, Raluca Viviana Stireanu Jan 2002

A Ghost In Europe: Right-Wing Extremism And Its Metamorphoses, Raluca Viviana Stireanu

Masters Theses

The main assumption of this thesis is that fascism is not an historical feature, nor a geographical one. The premises for the rise of fascism are beyond time and space; it can develop anywhere, anytime, in a certain context and under some conditions. These context and these conditions are to be explained and described in this thesis. I will compare the features of fascism in inter-war Europe with those of neo-fascism, and I will also compare the features of Eastern European fascims with those of the Western Europe; the main reason for these comparisons is that it was argued that …

A Study Of The Hill Cumorah: A Significant Latter-Day Saint Landmark In Western New York, Cameron J. Packer Jan 2002

A Study Of The Hill Cumorah: A Significant Latter-Day Saint Landmark In Western New York, Cameron J. Packer

Theses and Dissertations

Early Church member W. W. Phelps wrote, "Cumorah...is well calculated to stand in this generation, as a monument of marvelous works and wonders" (Latter-day Saints' Messenger and Advocate, November 1835, 2:221). With a stately monument of the Angel Moroni cresting its summit, and a yearly pageant commemorating salient events associated with the coming forth of the Book of Mormon, it is fulfilling the exact role that Phelps envisioned. However, the general population of the Church is relatively unfamiliar with the history of this significant Latter-day Saint landmark. The following thesis is an in depth study and documentation of certain historical …

Clarence Thomas The First Ten Years: Looking For Consistency, Mark Niles Jan 2002

Clarence Thomas The First Ten Years: Looking For Consistency, Mark Niles

Faculty Articles

Dean Niles describes his observation and impression of the first ten years of Clarence Thomas’ judgeship. While Dean Niles admits that his own views are more liberal than Clarence Thomas’, he was not initially concerned about those differences. But as the days, weeks and years passed, notwithstanding Dean Niles’ early stoicism, serious concerns about the candidate, and later the Justice, began to arise. These concerns were not based on Justice Thomas' beliefs or ideology, but on a growing set of inconsistencies that began to arise between some of his beliefs and actions. With all due respect to a man who …

Marriage And Belonging, Ann Laquer Estin Jan 2002

Marriage And Belonging, Ann Laquer Estin

Michigan Law Review

Marriage is a quintessentially private institution. Justice Douglas put the point this way in 1965, writing for the Supreme Court in Griswold v. Connecticut: "We deal with a right of privacy older than the Bill of Rights - older than our political parties, older than our school system. Marriage is a coming together for better or for worse, hopefully enduring, and intimate to the degree of being sacred. It is an association that promotes a way of life, not causes; a harmony in living, not political faiths; a bilateral loyalty, not commercial or social projects. Yet it is an association …

Racial Disparities And The Political Function Of Property, Spencer A. Overton Jan 2002

Racial Disparities And The Political Function Of Property, Spencer A. Overton

GW Law Faculty Publications & Other Works

Race theorists have noted that racial discrimination has shaped the existing distribution of economic resources, and have used this observation to justify reparations, to defend affirmative action, and to call for other legal changes that would improve the socioeconomic status of people of color. This Article takes the theorists' observation further. Property has a political function. Racially discriminatory allocation rules not only impose economic and social harms upon people of color, but also impair the ability of these people to engage in political expression and participation through structures such as the privately financed campaign finance system.

The Globalization Of Jurisdiction, Paul Schiff Berman Jan 2002

The Globalization Of Jurisdiction, Paul Schiff Berman

GW Law Faculty Publications & Other Works

This Article begins by surveying the myriad ways that increasing globalization of communication, travel, and trade, and in particular the rise of the Internet, have forced judges and legal scholars to "adapt" traditional rules for legal jurisdiction to the new economic and social environment. For example, if a person posts content online that is legal where posted but illegal in some place where it is viewed, can that person be subject to suit in the far-off location? How should the International Shoe "minimum contacts" test account for online contacts? Is online activity sufficient to make one "present" in a jurisdiction …

The Cultural Life Of Capital Punishment: Surveying The Benefits Of A Cultural Analysis Of Law, Reviewing Austin Sarat, 'When The State Kills: Capital Punishment And The American Condition', Paul Schiff Berman Jan 2002

The Cultural Life Of Capital Punishment: Surveying The Benefits Of A Cultural Analysis Of Law, Reviewing Austin Sarat, 'When The State Kills: Capital Punishment And The American Condition', Paul Schiff Berman

GW Law Faculty Publications & Other Works

Austin Sarat's 'When the State Kills' seeks to explore the interrelationship between capital punishment and American culture. Utilizing scholarly approaches drawn from sociology, literary criticism, cultural studies, and political science, Sarat illuminates the ways in which the official legal regime of capital punishment creates, reflects, and reinforces broader cultural attitudes about crime and punishment. Moreover, he argues that the destructive long-term cultural consequences of the death penalty provide a reason for abolition over and above any criminological or doctrinal arguments against the practice.

Thus, 'When the State Kills' not only offers a powerful intervention in the ongoing death penalty debate, …

Current Issues In The Changing Roles And Practices Of Community Economic Development Lawyers, Susan R. Jones Jan 2002

Current Issues In The Changing Roles And Practices Of Community Economic Development Lawyers, Susan R. Jones

GW Law Faculty Publications & Other Works

This Article, part of a symposium entitled "Lawyering for a New Democracy," explores current issues related to the changing roles of public interest lawyers engaged in Community Economic Development (CED) in a new democracy. After discussing current issues and trends in CED practice, the author concludes that CED is inherently privatized and is becoming more so with the national emphasis on economic self-sufficiency. The author provides lessons from law school clinical practice of enhanced strategic collaborations and highlights current trends and issues involving technology, leadership development, community organizing, asset accumulation, and social capital. Furthermore, leadership development and community organizing are …

Property In Writing, Property On The Ground: Pigs, Horses, Land, And Citizenship In The Aftermath Of Slavery, Cuba, 1880-1909, Rebecca J. Scott, Michael Zeuske Jan 2002

Property In Writing, Property On The Ground: Pigs, Horses, Land, And Citizenship In The Aftermath Of Slavery, Cuba, 1880-1909, Rebecca J. Scott, Michael Zeuske

Articles

In the most literal sense, the abolition of slavery marks the moment when one human being cannot be held as property by another human being, for it ends the juridical conceit of a "person with a price." At the same time, the aftermath of emancipation forcibly reminds us that property as a concept rests on relations among human beings, not just between people and things. The end of slavery finds former masters losing possession of persons, and former slaves acquiring it. But it also finds other resources being claimed and contested, including land, tools, and animals-resources that have shaped former …

A Case Analysis Of Three Middle-School Boys Who Have Down Syndrome And Have Been In Regular Education Classes Since Preschool, Eileen Frances Luddy Jan 2002

A Case Analysis Of Three Middle-School Boys Who Have Down Syndrome And Have Been In Regular Education Classes Since Preschool, Eileen Frances Luddy

Dissertations

This study investigated the experiences of three middle-school boys who have Down syndrome and have always attended regular education classes.

Despite the existence of policies and initiatives in support of inclusive education, research on the implementation of inclusive practices in middle schools is sparse.

This study is organized in nine chapters. A review of literature revealed that significant research conducted during the past decade supports the practice of including students with disabilities in regular education and the benefits of inclusion outweigh the benefits of separate instruction.

A case study approach investigated the phenomenon covering contextual conditions surrounding the experiences of …

The Early Bronze Age Ceramic Assemblage From Tell Ta'annek, Palestine, Mark S. Ziese Jan 2002

The Early Bronze Age Ceramic Assemblage From Tell Ta'annek, Palestine, Mark S. Ziese

Dissertations

The problem

Greenberg has recently stated that isolating temporal ceramic indicators for the Early Bronze II-III periods is "one of the thorniest issues in the archaeology of Palestine" (2000: 183). Part of theproblem stems from the homogenous nature of ceramic assemblages from Early Bronze Age Palestine; part of it stems from a continued lack of published information. Both of these issues are addressed by this study. Excavations at Tell Ta`annek between 1963 and 1967 unearthed the remains of a multi-period site, including the residues of an Early Bronze II-III fortified settlement. It is purposed here to isolate that portion of …

Grazing Management And Plant Community Composition On Bodmin Moor, Gavin Stewart Jan 2002

Grazing Management And Plant Community Composition On Bodmin Moor, Gavin Stewart

School of Geography, Earth and Environmental Sciences Theses

The research presented in this thesis was focused on aspects of the dynamic response of upland vegetation to grazing, to allow evaluation of the suitability of Countryside Stewardship (CS) management for the rehabilitation of dwarf-shrub cover in the upland landscape of Bodmin Moor. Initial chapters review the ecological character of Bodmin Moor, grazing management and vegetation in upland habitats, and succession in relation to grazing. Chapter Five provides the first extensive and detailed phytosociological investigation of the vegetation of Bodmin Moor-providing a baseline for further work. It also examines the spatial distribution of the plant communities in relation to environmental …
