This important conference (the fourth in a series) addresses higher education in “natural resources.” Indeed, most participants are affiliated with programs, departments, schools, or colleges of natural resources and/or related professional terms such as conservation, forestry, wildlife biology, range science, and park management. By professional standards, these areas of study and practice are relatively young. However, the words we use to describe them (and ourselves) are a century or more old. Gifford Pinchot was America’s first professional forester, and he coined the word “conservation” early in his career (or so he writes in his book, Breaking New Ground). The Conservation …

This Article explains the role that local governments have assumed in protecting the environment, explores the means by which they have obtained their authority to do so, and discusses how this enhanced municipal role should influence environmental and land use policy at the federal and state level. Part II reviews federal efforts to control nonpoint source pollution, and identifies the constraints on federal action. Among these constraints is the national understanding that the power to control the private use of land is a state prerogative, one that has been delegated, in most states, to local governments. We review the literature published in academic, non-law journals on environmental justice and environmental racism, focusing on the literature relevant to the environmental justice movement in the United States. In the overview we define major concepts: environment, justice, race and racism. We discuss major trends in the literature and in the movement and current issues and debates, including risk assessment, GIS mapping, and community-based research and campaigns. Annotations are provided for over 100 publications. The Ogoni are a minority ethnic people who live in the Western Niger Delta Region of southern Nigeria. During the 1970s, Ogoniland, or the Ogoni Nation, became part of the Rivers State of Nigeria. There are approximately 500,000 Ogoni who represent less than 0.05 percent of Nigeria's 100 to 120 million people. The population density of this region equals 1,233 people per square mile, making it one of the most densely populated areas of Nigeria. Reliable information about the origin of the Ogoni is limited. Archaeological and oral historical evidence suggests that the Ogoni have inhabited the area for over …

In the past twenty years, the legal academy has become quite interdisciplinary in its ambitions and methods. It is therefore natural that scholars in other disciplines-particularly the social scienceswould want to assess the quality of work being done by legal scholars, as Epstein and King have done. At the same time, given the extent to which joint degree holders and otherwise academically trained individuals have moved into legal teaching, it would be surprising if the quality of legal research-particularly empirical research-had not improved dramatically over time, with its tools becoming more sophisticated, the questions it addresses becoming better conceived, and …

We Americans are people of the journey. From boats across the Atlantic by way of Pilgrim quest, to the holocaust of the middle passage, to classic travelogues such as On the Road or Travels with Charley (in Search of America}, the stamp of the mythic journey seems to be indelibly planted on our national psyche. And as we all know, journeys have several staple elements: anticipation, consumption of a variety of foods at exorbitant prices, wrestling with a roadmap, and children in the back crying, "Are we there yet?" A quintessentially American component to the journey, however, is the postcard.

Earning Deference: Reflections On The Merger Of Environmental And Land-Use Law, Michael Allan Wolf

The bedrock notion that courts should, in the overwhelming majority of cases, defer to lawmakers is currently under attack in the nation's courts, commentary and classrooms. Leading the way are several United States Supreme Court Justices who, in cases involving the Commerce Clause, the Takings Clause and Section Five of the Fourteenth Amendment, are much more willing than their immediate predecessors to second-guess the motives and tactics of elected and appointed officials at all levels of government. Nearly one hundred years ago, W.E.B. DuBois predicted that the problem of the 20th century would be the problem of the color line. Were he writing today, DuBois might well conclude that in the U.S., the problem of the coming century will be the problem of the color-bind. Although Americans arguably remain "the most 'race-conscious' people on earth," our national conversation about "race" now stands at an impasse. Environmental Justice In An Era Of Devolved Collaboration , Sheila R. Foster

Environmental decision-making is undergoing a profound shift. Traditional forums and processes are being displaced by mechanisms emphasizing local, "place-based" decision-making. These emerging decision-making mechanisms are orchestrated through collaborative processes featuring stakeholders from both the public and private sectors. This transformation is evident in a number of recent governmental initiatives, including those by the Environmental Protection Agency ("EPA"), most notably its Community-Based Environmental Protection ("CBEP") initiative. Other federal agencies, particularly those with land or species management responsibilities, have similarly advocated a greater role for local decision-makers and collaborative problem-solving. This Article examines the points of convergence and divergence between devolved collaboration …
