Toward Fair Play: A Decade Of Transformation And Resistance In International Human Rights Advocay In Brazil, James L. Cavallaro Sep 2002

Toward Fair Play: A Decade Of Transformation And Resistance In International Human Rights Advocay In Brazil, James L. Cavallaro

Chicago Journal of International Law

In conferences and panels on human rights practice in Brazil, I often resort to a simplified analogy between soccer matches and international human rights litigation and advocacy, one certain to be understood in the world's premier soccer nation. The analogy concerns the expectations that a player or team brings onto the field at the beginning of any match, and those of a litigant (or attorney) seeking to bring her case before an international human rights oversight body. To begin, I tell the audience that the players expect fair play: that the other team has recognized the competition itself and its …

The New World Of Corporate Lawyering In Japan, Eric Sibbitt Sep 2002

The New World Of Corporate Lawyering In Japan, Eric Sibbitt

Chicago Journal of International Law

Tokyo used to be a sleepy little legal market for most US law firms. There were exceptions of course, but the Tokyo presence of a number of international firms with a Tokyo office amounted to a single partner. In fact, while firms may have made grander claims as to the number of resident lawyers, some Tokyo offices of major international firms comprised nothing more than an ill-attended fax machine and a skeletal secretarial staff supplemented, on an as-rarely-needed basis, by visiting lawyers from other offices. Many of the lawyers that did reside full-time in Tokyo offices spent a significant portion …

Establishing A New Stock Market For Shareholder Value Oriented Firms In Korea, Stephen J. Choi, Kon S. Kim Sep 2002

Establishing A New Stock Market For Shareholder Value Oriented Firms In Korea, Stephen J. Choi, Kon S. Kim

Chicago Journal of International Law

Our proposal in Korea therefore is to start small. We focus on the possibility of introducing more competition by giving firms greater choice within the existing regulatory regime. As an initial, obtainable goal, we propose taking an approach similar to that pursued by the Brazilian Stock Exchange ("Bovespa") to establish a new voluntary section for firms on the KSE satisfying global corporate governance standards. We also explore a second option to introduce competition by allowing some firms to opt out of domestic regulation in favor of the regulatory regime of a foreign country. Such an approach would allow firms the …

The Jurisprudence And Politics Of Forum-Selection Clauses, Erin Ann O'Hara Sep 2002

The Jurisprudence And Politics Of Forum-Selection Clauses, Erin Ann O'Hara

Chicago Journal of International Law

This essay explores the relationship between the courts and the legislature regarding enforcement of forum-selection clauses by using the US experience as its primary example. The US courts' recent vigorous enforcement of forum-selection clauses in international disputes may be overturned by Congress. In fact, the Supreme Court's decision indicating that forum-selection clauses are enforceable under the Carriage of Goods by Sea Act ("COGSA") may soon be legislatively overruled. This essay explores the potential limits on the durability of court decisions to enforce forum-selection clauses and offers some preliminary thoughts on the necessary conditions for long-term enforcement of these contractual provisions. …

Of Yahoos And Dilemmas, Daniel Arthur Laprès Sep 2002

Of Yahoos And Dilemmas, Daniel Arthur Laprès

Chicago Journal of International Law

In the spring of 2000, two French non-profit associations dedicated to fighting anti-Semitism attacked Yahoo! Inc. ('Yahoo") before the French courts for exhibiting images of Nazi symbols on its websites, as well as links to revisionist and anti-Semitic sites. After losing a challenge over the French court's jurisdiction, Yahoo argued that a significant filtering system would be prohibitively expensive. But relying on a report compiled by a panel of internationally renowned experts which showed that a filtering system with an accuracy rate of about 70 percent could be achieved without incurring unreasonable costs, the French judge gave Yahoo until February …

Clausewitz's Center Of Gravity: Changing Our Warfighting Doctrine--Again!, Antulio J. Echevarria Ii Sep 2002

Clausewitz's Center Of Gravity: Changing Our Warfighting Doctrine--Again!, Antulio J. Echevarria Ii

Books, Monographs & Collaborative Studies

The author cuts through the myriad interpretations surrounding the concept and gets back to the original idea as conceived by its author, the Prussian military theorist, Carl von Clausewitz. In going back to the original concept, Lieutenant Colonel Echevarria reveals that Clausewitz intended the center of gravity to function much as its counterpart in the mechanical sciences does, that is, as a focal point. He thus argues, quite persuasively, that the Clausewitzian center of gravity is not a strength, nor a weakness, nor even a source of strength. A center of gravity is the one element within a combatant's entire …

Delays In Primary Vaccination Of Infants Living In Western Saudi Arabia, Fawzia H. Hasanain, Mohammed M. Jan Sep 2002

Delays In Primary Vaccination Of Infants Living In Western Saudi Arabia, Fawzia H. Hasanain, Mohammed M. Jan

Saudi Medical Journal

OBJECTIVE: Vaccination is one of the most cost-effective means of preventing serious infectious diseases. Several studies from developing and developed countries documented considerable delays in the administration of primary vaccinations. Our objectives were to study the circumstances and contributing factors to such delays in order to design preventative measures. METHODS: Parents of consecutive infants seen during a routine vaccination visit at King Abdul-Aziz University Hospital, Jeddah, Kingdom of Saudi Arabia were included prospectively between September 2000 and February 2001. Structured interviews were performed using a 20-item questionnaire. Vaccinations were considered delayed if they took place 4 or more weeks after …

Ascertaining Patient Condition : A Grounded Theory Study Of Diagnostic Practice In Nursing, Kok Long, Joseph Lee Sep 2002

Ascertaining Patient Condition : A Grounded Theory Study Of Diagnostic Practice In Nursing, Kok Long, Joseph Lee

Lingnan Theses

In the past decade, much research has been conducted on the practice nurses engage in diagnosing the clinical condition of patients. Many of the studies suggest that diagnostic practices of nurses in simulation settings follow a hypothetical deductive model that similar to the clinical decision-making or diagnostic reasoning process. A second line of inquiry claims that experience used in conjunction with intuition form the major core of diagnostic practice in nursing. However, these studies either assume nurses are reasoned in a primarily rationalist fashion or offer no conclusive explanations of the details on how intuition directs diagnostic practices. In particular, …

基督教中文聖經性別內包語言研究, Sin Nga So Sep 2002

基督教中文聖經性別內包語言研究, Sin Nga So

Lingnan Theses

Increasing Transparency In Government, Ann Florini Sep 2002

Increasing Transparency In Government, Ann Florini

Research Collection School of Social Sciences

The article focuses on the transparency in the government and investigates how transparency is related directly to achieving and maintaining international peace, by transforming the security relationship between countries. It also examines transparency's indirect role in contributing to legitimate and effective governance and explores the trends in transparency in national politics, international organizations, and environmental management. Information is the lifeblood of both democracies and markets. Without information, citizens have no basis upon which to evaluate their representatives or voice their opinions, and both elections and the very process of representation become a meaningless sham. Without information, the financial markets upon …

Edge And Pollution Effects On Lichen Communities In The Monteverde Area, September 2002, Margaret Beswick Sep 2002

Edge And Pollution Effects On Lichen Communities In The Monteverde Area, September 2002, Margaret Beswick

Monteverde Institute: Tropical Ecology and Conservation

Lichen has been used as a bioindicator of disturbance and pollution effects for over 100 years, however little is known about the relevance of lichen as a bioindicator in the tropics. Increasing fragmentation of tropical forest is leading to increased forest area along exposed edges. Also increased energy consumption is increasing levels of air pollution. Understanding the effects of pollution and edges on lichens in the tropics can have important implications for conservation. In the Monteverde area I tested edge effects and combined edge and pollution effects on lichen communities. A pasture, surrounded by forest, should show edge effects, and …

Effect Of Edge On The Foraging Of Frugivorous Birds And It's Relation To Palm Composition, September 2002, Christie Boser Sep 2002

Effect Of Edge On The Foraging Of Frugivorous Birds And It's Relation To Palm Composition, September 2002, Christie Boser

Monteverde Institute: Tropical Ecology and Conservation

It has been observed that birds are more common in forest habitats then along the edge of pastures. This study investigates the idea that birds forage less frequently in pastures and along forest edges and therefore that fewer seeds are dispersed in pastures than in forest. This would affect forest composition along edges and duration of reforestation. Clay fruits were placed on a gradient from forest to pasture, and the number of “fruits” with peck marks at each distance was recorded. A palm census was done along the gradients to determine if the diversity of palms differed from the edge …

Providing A Way Station: A Study Of The Joint Apna Ghar -The Enterprising Kitchen Program To Provide Employment Services To Immigrant Women Victimes Of Domestic Violence, Center For Urban Research And Learning, Christine George, Rafah Abuinnb

Center for Urban Research and Learning: Publications and Other Works

This report examines an innovative partnership designed to assist the employment needs of immigrant women who are survivors of domestic violence. In late 1999 a partnership was formed between The Enterprising Kitchen (TEK) and Apna Ghar, two organizations that are located in Chicago’s Uptown community. Apna Ghar, which provides services including shelter and counseling to South Asian immigrant women, sought client assistance from TEK, an intensive employment training program for women who are very marginal to the labor force. This report examines the first eighteen months of the partnership in which Apna Ghar referred twelve women to TEK’s training slots. …

A Differential Construct Methodology For Modelling Predictive Cultural Values, Béatrice Boufoy -Bastick Sep 2002

A Differential Construct Methodology For Modelling Predictive Cultural Values, Béatrice Boufoy -Bastick

The Qualitative Report

This paper presents an explanatory model of cultural behaviours, which resulted from a four-year ethnographic study of the different academic attainments in English of indigenous Fijians and the Indo-Fijians in the Fiji Islands. Fiji is a natural laboratory for investigating differential cultural behaviours because of these two culturally distinct main ethnic groups. Their different cultural behaviours were found to serve different values within each culture. A three-construct grounded model of these different values emerged from observations and analyses of these behaviours. These constructs were then de-constructed to define and explain a fourth target construct of their Differential Teaching Behaviours, which …

Caregivers' Experiences Of Informal Support In The Context Of Hiv/Aids, Premilla D'Cruz Sep 2002

Caregivers' Experiences Of Informal Support In The Context Of Hiv/Aids, Premilla D'Cruz

The Qualitative Report

Social support is an important buffer for family caregivers of people living with HIV/AIDS (PLWHIV/AIDS). With limited formal support options, these caregivers have to rely increasingly on informal networks. Yet, accessing this avenue is also fraught with difficulty due to the stigmatising nature of HIV infection. Research in this area is not just not sparse, but focusses largely on sources of support and the circumscribing effects of stigma. To further our understanding, a qualitative study was conducted using various concepts from social support theory. Twelve family caregivers in Mumbai, India, were interviewed, using the in-depth interview method. An iterative, thematic …

Subjectivity In Research: Why Not ? But…, Martin Drapeau Sep 2002

Subjectivity In Research: Why Not ? But…, Martin Drapeau

The Qualitative Report

This article addresses the question of subjectivity in research. In order to facilitate the use of subjectivity in a research context, the author reminds readers of possible procedures as suggested in the literature. Particular attention is given to the idea of peer debriefing. Inspired by psychoanalysis, the author expands on the concept of discussant or debriefer and suggests that by doing so, subjectivity can be better understood. It is suggested that this may actually be fully integrated into a study in order to both better understand the subject under examination as well as the influence of the research mentor and …
