The Influence Of Light Intensity Of The Moon On The Calling Behavior Of The Common Pauraque (Nyctidromus Albicollis) During Moonlit And Twilight Hours, September 2002, Kristin Bondo
Monteverde Institute: Tropical Ecology and Conservation
A study of the Common Pauraque (Nyctidromus albicollis) was conducted in an area of Costa Rica that has a pronounced dry season. The mean frequency of calls per minute, number of consecutive minutes of calls, and starting times of vocalizations at dusk were recorded. The mean frequency of Common Pauraque calls per minute, number of consecutive minutes of calls, and maximum number of calls per minute were not direct functions of percent moon face illumination, (Regression, R2 = 0.064, p = 0.1366; Regression, R2 = 0.257, p = 0.0269; Regression, R2 = 0.095, p = 0.2286) respectively. This suggests that …

Palatability And Anti-Predation Strategies In Costa Rican Butterflies, September 2002, Genevieve Mauro
Palatability And Anti-Predation Strategies In Costa Rican Butterflies, September 2002, Genevieve Mauro
Monteverde Institute: Tropical Ecology and Conservation
Butterflies have evolved morphological and behavioral characteristics that are thought to inhibit predation. This study ties wing characteristics, flight patterns and speeds, and activity patterns of butterflies with their palatability. Wing loading, wing toughness, scale density, flight speed, sporadicity, wing flaps, and behaviors such as feeding, resting, flying, and chasing were all compared for palatable species and unpalatable species of butterflies in Costa Rica. Palatable butterflies were found to have faster flight and higher sporadicity than unpalatable butterflies. No significant trends were found with wing loading, wing toughness, or scale density. Also, three species that differ in natural history and …
Factors Affecting Arthropod Loads On Nectivorous Phyllostomatidae, September 2002, Jason Majewski
Factors Affecting Arthropod Loads On Nectivorous Phyllostomatidae, September 2002, Jason Majewski
Monteverde Institute: Tropical Ecology and Conservation
Bats are known to host a wide range of both parasitic and non-parasitic arthropods on or around the pelage and wing membranes. The purpose of this study is to assess these macro and microscopic arthropod communities living on nectivorous bats, in an attempt to find patterns of arthropod load frequencies between sexes and among species. Bats were mist-netted at the Monteverde Hummingbird Gallery, for seven nights, with a total of 86 individuals examined from six different species. Macroparasites were counted and recorded; microparasites were then extracted from the bat by means of Scotch tape and aspiration. Analysis of Variance showed …
Heterogeneity Of Lycopodium Clavatum Patches And The Distribution And Herbivory Strategy Of Notodontid Moth Larvae And Their Ichneumonid Parasites, September 2002, Brad J. Oberle
Monteverde Institute: Tropical Ecology and Conservation
In this study, a novel system in which a notodontid moth larva (Family Notodontidae) uses Lycopodium clavatum (Family Lycopodiaceae), a cosmopotlitainly distributed clubmoss, as a hostplant. The larva and itself is host to no fewer than three parasitoid wasp species, including two ectoparasites, one of which is from the Ichneumonid genus Netelia. Distribution of larvae and damage to reproductive structures by larvae within the L. clavatum population are explained in terms of potential resource preference by the larvae. Larvae do not exhibit any measurable preference for reproductive structures with a given number of stobili, a character known to be associated …

An Analysis Of Three Methodologies In Determining Family Biotic Index (Fbi) Values For Benthic Macroinvertebrates In The Tropics, September 2002, Victor J. Rini
Monteverde Institute: Tropical Ecology and Conservation
The use of living organisms to assess water quality is a century old approach (Cairns and Pratt 1993). Widespread use of this method of evaluation has been common in North America and Europe (Metcalf 1989), yet it has not been applied in the Tropics. Here I present a test and alternatives to Hilsenhoff’s (1977, 1982, 1987) methodology for assigning Family Biotic Index values (a measure of pollution tolerance) to macroinvertebrates in a tropical premontane moist/wet forest (Holdridge 1967). Samples of benthic macroinvertebrates were taken from seven streams in the Monteverde, Costa Rica area. Hilsenhoff’s methodology as well as two others …

Nafta's Investment Protections And The Division Of Authority For Land Use And Environmental Controls, Vicki Been
Nafta's Investment Protections And The Division Of Authority For Land Use And Environmental Controls, Vicki Been
Pace Environmental Law Review
This paper discusses the way investor protections in international trade agreements may affect the division of power over environmental and land use regulation among federal, state, and local governments in the United States. It explores how national governments could pass the costs of takings compensation required by such investor protections on to the local and state governments, and analyzes other responses a national government might have to compensation awards. Professor Been predicts that domestic property owners will use investor protections in international trade agreements to argue for more expansive takings protections under the Fifth Amendment. Professor Been concludes with a …

Earning Deference: Reflections On The Merger Of Environmental And Land-Use Law , Michael Allan Wolf
Pace Environmental Law Review
Professor Wolf suggests that there is a brooding omnipresence over local government efforts to protect the environment; that omnipresence is the idea of regulatory takings. Professor Wolf emphasizes that local governments need to earn deference. Since the decision in Village of Euclid v. Ambler Realty Co., local governments have been acting in a "Euclidean zone of comfort" when implementing traditional land-use regulations. However, he suggests that local governments may be acting outsides of that zone when they enact environmental regulations and that there is a rich history of negative decisions concerning local environmental regulations. Professor Wolf then offers three strategies …

The Quiet Revolution Redux: How Selected Local Governments Have Fared , David L. Callies
Pace Environmental Law Review
Professor David Callies notes two significant trends since "the Quiet Revolution" and "The Taking Issue" were written in the early 1970's: (1) local land use controls have not "withered away" and many local governments are increasingly able to regulate the use of land through better plans and planning, and more sophisticated local ordinances (including environmental controls); (2) federal courts have reentered the regulatory takings arena, striking down several regional and state-wide land use controls on constitutional grounds. For both reasons, he suggests that local land use controls are an excellent arena to regulate development of all but the truly state-wide …

We combine the theory of inside-source/inside-detector x-ray fluorescence holography and Kossel lines/x ray standing waves in kinematic approximation to directly obtain the phases of the diffraction structure factors. The influence of Kossel lines and standing waves on holography is also discussed. We obtain partial phase determination from experimental data obtaining the sign of the real part of the structure factor for several reciprocal lattice vectors of a vanadium crystal.

Short-range antiferromagnetic correlations have been studied in the layered compounds (PPh4) [FeIIFeIII(ox)3] and (NBu4) [FeIIFeIII(ox)3] by neutron polarization analysis and Mössbauer spectroscopy. Polarized neutron diffraction profiles obtained between 2 and 50 K on (d20-Pph4) [FeIIFeIII(ox)3] show no magnetic Bragg scattering; the lack of such scattering indicates the absence of long-range magnetic order. However, a broad asymmetric feature observed at a Q of ca. 0.8 Å-1 is attributed to two-dimensional short-range magnetic correlations, which …

Pay Equity: A Fundamental Human Right, Margot Young
Pay Equity: A Fundamental Human Right, Margot Young
All Faculty Publications
This paper undertakes the limited task of determining what interpretive consequences, if any, might flow from the removal of federal pay equity provisions from their current location in the Canadian Human Rights Act and placement of such provisions in their own stand-alone legislation. Part of the interpretive stance courts currently bring to their consideration of the federal pay equity provisions reflects the placement of these provisions within federal human rights legislation. Courts have held that human rights legislation has a special nature or quasi-constitutional status. This status results from the fundamental character of the values the legislation expresses and the …
Unloved: Tort In The Modern Legal Academy, John C.P. Goldberg
Unloved: Tort In The Modern Legal Academy, John C.P. Goldberg
Vanderbilt Law Review
In The Idea of Private Law, Ernest Weinrib makes an arresting claim. He says that private law-by which he means primarily the law of contract, restitution, and especially tort-is "just like love."'
Even members of a discipline devoted to analogies may be forgiven for not immediately perceiving the point of this one, particularly if we focus on the private law of tort. Few law students would mistake negligence, defamation, or battery for love, and if they did, their professors might be concerned for their well-being. Likewise, it is difficult to recall another law professor writing of love and tort in …

The Navlab group at Carnegie Mellon University has a long history of development of automated vehicles and intelligent systems for driver assistance. The earlier work of the group concentrated on road following, cross-country driving, and obstacle detection. The new focus is on short-range sensing, to look all around the vehicle for safe driving. The current system uses video sensing, laser rangefinders, a novel light-stripe rangefinder, software to process each sensor individually, and a map-based fusion system. The complete system has been demonstrated on the Navlab 11 vehicle for monitoring the environment of a vehicle driving through a cluttered urban environment, …

Nanopowdered alloys of Pd100-xFex, with x=4, 6, 8, and 12, have been prepared by ultrasound assisted electrochemistry. The composition of the individual particles, as determined by x-ray fluorescence, and the bulk composition, as determined by atomic absorption, are in agreement within experimental error. Transmission electron microscopy indicates that the nanopowders consist of agglomerates of small grains with a radius of approximately 5 nm, a radius which is confirmed by the broadening of the reflections in the x-ray powder diffraction patterns. X-ray fluorescence analysis of individual grains indicates a homogeneous distribution of palladium and iron throughout the …
