The Beach Zone: Using Local Land Use Authority To Preserve Barrier Islands , Jessica Vantine, Tiffany B. Zezula Sep 2002

The Beach Zone: Using Local Land Use Authority To Preserve Barrier Islands , Jessica Vantine, Tiffany B. Zezula

Pace Environmental Law Review

This article is an exploration of the barrier island's unique landform and the solution to its protection. By using Fire Island, a critical barrier island off the coast of Long Island, New York, as a case study, this article attempts to offer a paramount solution, "the beach zone." The authors begin by discussing the natural processes of the barrier islands, focusing on tidal cycles, sea level rising, and periodic storm surges, which threaten development on them. They illustrate the dynamic nature of the barrier islands that often make them unsuitable for permanent development. To date, the primary focus of both …

New Loopholes Or Minor Adjustments? A Summary And Evaluation Of The Small Business Liability Relief And Brownfields Revitalization Act, Joel A. Mintz Sep 2002

New Loopholes Or Minor Adjustments? A Summary And Evaluation Of The Small Business Liability Relief And Brownfields Revitalization Act, Joel A. Mintz

Pace Environmental Law Review

This article is both a summary and an evaluation of these recent Comprehensive Environmental Response, Compensation and Liability Act ("CERCLA") amendments. It will begin by recounting the key modifications to the Superfund Act's liability provisions, which have been affected by the Small Business Liability Relief and Brownfields Revitalization Act. It will then treat the statute's new funding mechanisms for revitalizing brownfield areas. Finally, it will assay the merits of the Act as an alteration of the longstanding liability precepts of CERCLA and as a financing measure for extending the scope of brownfields redevelopment.

Missed Opportunities: California Energy Fears, New York Energy Policy And The New York Power Authority's New York City Turbine Projects, John L. Parker, James Malatras Sep 2002

Missed Opportunities: California Energy Fears, New York Energy Policy And The New York Power Authority's New York City Turbine Projects, John L. Parker, James Malatras

Pace Environmental Law Review

In this article, the authors argue that the actions taken by several state agencies have demonstrated the need for improved energy policy. This article illustrates that Article X of the Public Service Law, as well as the current State energy system of production and distribution, is seriously flawed and that deregulation has not been good for the consumer or the environment. This article shows that this system has brought New York to its current situation-the building of numerous plants without a comprehensive or rational energy plan, and a push for distributed generators, increasing pollution of the State's air, water, and …

Transformation Concepts For National Security In The 21st Century, Williamson Murray Dr. Sep 2002

Transformation Concepts For National Security In The 21st Century, Williamson Murray Dr.

Books, Monographs & Collaborative Studies

This book represents some of the thinking by students at the U.S. Army War College, considering the nature and direction of transformation. They consider how the transformed joint services of the United States should employ force in the 21st century. The services are exploring concepts such as Effects Based Operations and Rapid Decisive Operations to move swiftly and strike vigorously to secure victory in the coming decades. At the same time the nation and its armed forces are developing new concepts of homeland security to defend the country in the war on terrorism. Officers who participated in the Advanced Strategic …

Niobrara National Scenic River, 1985-2000: Old Arguments, New Compromises, James A. Roeder Sep 2002

Niobrara National Scenic River, 1985-2000: Old Arguments, New Compromises, James A. Roeder

Student Work

In May 1991, President George H. Bush signed into law the Niobrara Scenic River Designation Act, which gave federal scenic-river designation to a 70-mile stretch of this northern-Nebraska river. The successful effort to protect this river was a protracted, often acrimonious battle, pitting Nebraska neighbors against each other. Interested parties found themselves on opposing sides of a seemingly insurmountable divide, either believing that this river resource should be given federal protection to preserve it unimpaired for future generations, or arguing that the local people should be allowed to determine the fate of “their” river without federal interference. The twentieth century …

Chemistry and Biochemistry Faculty Research

We combine the theory of inside-source/inside-detector x-ray fluorescence holography and Kossel lines/x ray standing waves in kinematic approximation to directly obtain the phases of the diffraction structure factors. The influence of Kossel lines and standing waves on holography is also discussed. We obtain partial phase determination from experimental data obtaining the sign of the real part of the structure factor for several reciprocal lattice vectors of a vanadium crystal.

Polarized Neutron Diffraction And Mössbauer Spectral Study Of Short-Range Magnetic Correlations In The Ferrimagnetic Layered Compounds (Pph₄) [FeIiFeIii(Ox)₃] And (Nbu₄) [FeIiFeIii(Ox)₃], Simon G. Carling, Dirk W. Visser, Dimitri Hautot, Ian D. Watts, Peter Day, Jürgen Ensling, Phillip Gütlich, Gary J. Long, Fernande Grandjean

Chemistry Faculty Research & Creative Works

Short-range antiferromagnetic correlations have been studied in the layered compounds (PPh4) [FeIIFeIII(ox)3] and (NBu4) [FeIIFeIII(ox)3] by neutron polarization analysis and Mössbauer spectroscopy. Polarized neutron diffraction profiles obtained between 2 and 50 K on (d20-Pph4) [FeIIFeIII(ox)3] show no magnetic Bragg scattering; the lack of such scattering indicates the absence of long-range magnetic order. However, a broad asymmetric feature observed at a Q of ca. 0.8 Å-1 is attributed to two-dimensional short-range magnetic correlations, which …

Reduced Reproductive Effort In Male Field Crickets Infested With Parasitoid Fly Larvae, Gita R. Kolluru, Marlene Zuk, Mark A. Chappell Sep 2002

Reduced Reproductive Effort In Male Field Crickets Infested With Parasitoid Fly Larvae, Gita R. Kolluru, Marlene Zuk, Mark A. Chappell

Biological Sciences

Some populations of the field cricket Teleogryllus oceanicus are parasitized by the phonotactic fly Ormia ochracea. Flies locate crickets by their song and deposit larvae onto them. The larvae develop inside the cricket for 1 week before killing the host upon emergence. The reproductive compensation hypothesis predicts that parasitized crickets should increase their reproductive effort during the initial stages of infestation to offset the loss of fitness resulting from their shortened life span. An alternative hypothesis predicts that parasitized crickets will decrease reproduction, either because they are unable to reproduce or because selection acting on the parasitoid favors decreased …

Pay Equity: A Fundamental Human Right, Margot Young Sep 2002

Pay Equity: A Fundamental Human Right, Margot Young

All Faculty Publications

This paper undertakes the limited task of determining what interpretive consequences, if any, might flow from the removal of federal pay equity provisions from their current location in the Canadian Human Rights Act and placement of such provisions in their own stand-alone legislation. Part of the interpretive stance courts currently bring to their consideration of the federal pay equity provisions reflects the placement of these provisions within federal human rights legislation. Courts have held that human rights legislation has a special nature or quasi-constitutional status. This status results from the fundamental character of the values the legislation expresses and the …

Unloved: Tort In The Modern Legal Academy, John C.P. Goldberg Sep 2002

Unloved: Tort In The Modern Legal Academy, John C.P. Goldberg

Vanderbilt Law Review

In The Idea of Private Law, Ernest Weinrib makes an arresting claim. He says that private law-by which he means primarily the law of contract, restitution, and especially tort-is "just like love."'

Even members of a discipline devoted to analogies may be forgiven for not immediately perceiving the point of this one, particularly if we focus on the private law of tort. Few law students would mistake negligence, defamation, or battery for love, and if they did, their professors might be concerned for their well-being. Likewise, it is difficult to recall another law professor writing of love and tort in …

Networking And Foreign Direct Investment Activity, Bruce A. Blonigen, Rossitza B. Wooster Sep 2002

Networking And Foreign Direct Investment Activity, Bruce A. Blonigen, Rossitza B. Wooster

Economics Faculty Publications and Presentations

We conduct an empirical investigation into whether networking effects affect foreign direct investment (FDI) activity. Using bibliographical information on CEOs’ birth and education locations, we are able to identify changes from U.S. to foreign-connected CEOs that occurred in U.S. manufacturing firms of the S&P 500 from 1992 through 1997. Robust to a variety of specifications, we find that a U.S. firm’s switch from a U.S.- to a foreign-connected CEO leads to substantial increases in the firm’s proportion of its assets and sales that are in foreign markets. In fact, our preferred specification indicates that foreign asset and sales proportions increase …

Morphologic And Magnetic Properties Of Pd₁₀₀₋ₓfeₓ Nanoparticles Prepared By Ultrasound Assisted Electrochemistry, Maribel Guzman, Jean Luc Delplancke, Gary J. Long, Jacques P. Delwiche, Marie Jeanne Hubin-Franskin, Fernande Grandjean

Chemistry Faculty Research & Creative Works

Nanopowdered alloys of Pd100-xFex, with x=4, 6, 8, and 12, have been prepared by ultrasound assisted electrochemistry. The composition of the individual particles, as determined by x-ray fluorescence, and the bulk composition, as determined by atomic absorption, are in agreement within experimental error. Transmission electron microscopy indicates that the nanopowders consist of agglomerates of small grains with a radius of approximately 5 nm, a radius which is confirmed by the broadening of the reflections in the x-ray powder diffraction patterns. X-ray fluorescence analysis of individual grains indicates a homogeneous distribution of palladium and iron throughout the …

Equal Protection Incorporation, Michael C. Dorf Sep 2002

Equal Protection Incorporation, Michael C. Dorf

Cornell Law Faculty Publications

In order to preserve a broad field of play for legislative and administrative action, courts do not subject most state action to exacting scrutiny under the Equal Protection Clause. For half a century, the principal exception has consisted of so-called suspect and semi-suspect classifications. Although the Supreme Court has articulated criteria for identifying such classifications, standing alone, none of these criteria is satisfactory, nor has the Court found any principled means of combining them. This Article proposes a judicial reading of the Equal Protection Clause, "equal protection incorporation", that roots the process of identifying suspect and semi-suspect classifications in constitutional …
