Conservative Or Constitutionalist?, Gary S. Lawson Oct 2002

Conservative Or Constitutionalist?, Gary S. Lawson

Faculty Scholarship

The persistence of the question posed by the editors of this journal demonstrates that legal conservatives have an identity crisis. In large measure, that crisis is an artifact of the ambiguity in the term "legal conservative." I use the term roughly to mean someone who believes in a variant of original meaning for interpreting constitutions and statutes' and who views the common law as a device for securing social coordination within a spontaneous order-all overlaid with a strong respect for the Anglo-American, Rule of Law tradition. As definitions go, this is pretty imprecise. There is no single meaning for original …

The Aminopeptidase From Aeromonas Proteolytica: Structure And Mechanism Of Co-Catalytic Metal Centers Involved In Peptide Hydrolysis, Richard C. Holz Oct 2002

The Aminopeptidase From Aeromonas Proteolytica: Structure And Mechanism Of Co-Catalytic Metal Centers Involved In Peptide Hydrolysis, Richard C. Holz

Chemistry Faculty Research and Publications

Enzymes containing multi-metal active sites are central to numerous biological processes and, consequently, characterization of their structure and function is a problem of outstanding importance. One of the least-explored groups of enzymes is the hydrolases that contain dinuclear metal centers. These enzymes play key roles in carcinogenesis, tissue repair, and protein degradation processes. In addition, some of these enzymes can catalyze the hydrolysis of phosphorus(V) compounds found in nerve gases and agricultural neurotoxins. The determination of detailed reaction mechanisms for these enzymes is required for the design of highly potent, specific inhibitors that can function as potential pharmaceuticals. Hydrolytic enzymes …

Market Failure And Intellectual Property: A Response To Professor Lunney, Wendy J. Gordon

Faculty Scholarship

Professor Lunney's piece in this volume is interesting enough that I forgive him for misportraying my own work. In this short reply I will clarify my position, and then examine both the place of my market failure argument and the place of some of Professor Lunney's arguments within the future of Intellectual Property scholarship as a whole.

Convictions Of Innocent Persons In Massachusetts: An Overview, Stanley Z. Fisher Oct 2002

Convictions Of Innocent Persons In Massachusetts: An Overview, Stanley Z. Fisher

Faculty Scholarship

Scholars documenting the incidence and causes of wrongful convictions in the United States have focused on cases arising all across the country. Because reform of the practices that lead to such errors of justice must largely take place on the state level, there is value in examining wrongful convictions in particular jurisdictions. This article attempts to identify and briefly describe all known cases of conviction of innocent persons in Massachusetts from 1800 to the present time. Part I discusses the criteria for identifying "the innocent." For the purpose of gaining support for needed reforms in the law, the most persuasive …

The Effects Of An Induced Negative Mood State On Ground- Based Learning In Student Pilots, Angela Sophia Wendell Oct 2002

The Effects Of An Induced Negative Mood State On Ground- Based Learning In Student Pilots, Angela Sophia Wendell

Master's Theses - Daytona Beach

The United States Department of Transportation and the Federal Aviation Administration's Aviation Instructors Handbook (D.O.T.) (1999) emphasizes that aviation students must maintain a healthy and positive state of mind in order to succeed at learning. Factors such as worry, lack of interest, physical discomfort, and anxiety are all listed as obstacles to a student's ability to learn successfully during flight instruction. In addition, numerous studies support the idea that a negative mood state will have a detrimental effect on learning. This study attempts to investigate the effects of an induced negative mood state on ground- based learning in student pilots.

Analysis Of The Aboriculture Industry Safety Culture From The Standpoint Of Injures, Illnesses, Employee Response, And Industry Standards, Joshua T. Mcclenahan

Doctoral Dissertations and Master's Theses

The author researched 215 recorded injuries and illnesses to all field employees between January 1, 1991 and July 1, 2002 at an arboricultural company in California. Detailed interviews were conducted with each of the 38 field employees to determine employee perceptions of safety training, management, communication, and personal discomfort to provide a clearer picture of the company safety program. This information was correlated with the tree worker claims and industry standards to determine the effectiveness of the safety program based on employee discomforts and claim related descriptive statistics. The claims' tabulations show that back strains are the most prominent injuries …

The Fourth Amendment In The Hallway: Do Tenants Have A Constitutionally Protected Privacy Interest In The Locked Common Areas Of Their Apartment Buildings?, Sean M. Lewis

Michigan Law Review

One afternoon, a police officer spots a man driving a Cadillac through a run·down neighborhood. His interest piqued, the officer decides to follow the vehicle. The Cadillac soon comes to rest in front of an apartment building, and the driver, Jimmy Barrios-Moriera, removes a shopping bag from the trunk and enters the building. The moment Barrios-Moriera disappears within the doorway, the officer sprints after him because he knows that the door to the apartment building will automatically lock when it closes. He manages to catch the door just in time and rushes in. Barrios-Moriera is already halfway up a flight …

Use Of Distal Protection Device For Percutaneous Intervention In Native Coronary Arteries, Kenneth Ka-Hing Lam, Shu-Kin Li Oct 2002

Use Of Distal Protection Device For Percutaneous Intervention In Native Coronary Arteries, Kenneth Ka-Hing Lam, Shu-Kin Li

Journal of the Hong Kong College of Cardiology

Microembolization of particulate debris during percutaneous coronary intervention (PCI) will lead to various degree of microvascular obstruction, terminating in no-reflow phenomenon observed angiographically. Different methods, including angiography, non-invasive imaging, and assays of myocardial injury markers, have been used for detection of occurrence of microvascular obstruction. The prevalence of, and the adverse prognosis associated with microvascular obstruction have led to the concept and application of distal protection for coronary interventions. While its value has been confirmed in saphenous vein grafts intervention, data is now growing to support use of distal protection devices in native coronaries. Findings from a local registry that …

Proposal To Reform The Like Kind And Involuntary Conversion Rules In Light Of Fundamental Tax Policies: A Simpler, More Rational, And More Unified Approach, Fred B. Brown Oct 2002

Proposal To Reform The Like Kind And Involuntary Conversion Rules In Light Of Fundamental Tax Policies: A Simpler, More Rational, And More Unified Approach, Fred B. Brown

All Faculty Scholarship

Almost from the beginning of the federal income tax, the law has contained two nonrecognition provisions that have undergone relatively little change: the like kind rule and the involuntary conversion rule. Commentators have questioned the policy grounds for the like kind rule in general, and for some of its particular features, such as the exchange requirement. Congress and its staffers have also noted the complexity caused by certain aspects of the rule and have enacted or proposed remedial changes in this regard. The involuntary conversion rule also contributes to the complexity of the tax system given the fact-intensive analysis that …

An Inquiry Into The Application Of A Curriculum Chart In Science Education, Karen R. Fuller Oct 2002

An Inquiry Into The Application Of A Curriculum Chart In Science Education, Karen R. Fuller

Masters Theses

When a teacher decides how to teach science to the classroom of individuals, the fist consideration to make is how to best meet the needs of the students. It is important to know what their prior knowledge is. A science curriculum chart would work like a checklist where the teachers would write when the student learned a science topic and how they succeeded in learning the science concept. The chart would also show education standards and benchmarks met.

The author surveyed West Michigan teachers, K-12, in order to determine if they would value the use of the chart. The teacher …

Asi1, A Gene Encoding A Novel Leucine Zipper Protein, Is Induced During Development Of The Macronucleus In Tetrahymena, Rupa A. Udani, Kathleen M. Karrer

Biological Sciences Faculty Research and Publications

Sexual reproduction in the ciliate Tetrahymena follows a complex developmental program involving the sequential regulation of dozens of genes. Genes that are up-regulated during post-zygotic development in Tetrahymena were isolated by subtractive hybridization. Anlagen stage induced gene 1 (ASI1) encodes a 2.8 kb transcript that contains a single intron and is induced during macronuclear development. ASI1 is a single copy gene in both the micronucleus and the macronucleus. It encodes a 95 kDa conceptual protein with a leucine zipper near the amino terminus

The Répertoire De Vedettes-Matière De L’Université Laval Library 1946-1992: Francophone Subject Access In North America And Europe, Robert P. Holley

School of Information Sciences Faculty Research Publications

In 1946, the Université Laval in Quebec City, Quebec, Canada, started using Library of Congress Subject Headings (LCSH) in French. To do so, the librarians created an authority list in French, Répertoire de Vedettes-matière (RVM), whose first published edition appeared in 1962 (the first edition appeared with the title Répertoire des Vedettes-matière). Since then, RVM has had increasing importance in providing support for subject access in francophone countries around the world as other libraries, first in Canada and then in Europe, either adopted RVM, often with some modification, for subject access or used it as a resource for creating French …

Structural Analysis Of Audit Evidence Using Belief Functions, Hai Lu, Hai Lu Oct 2002

Structural Analysis Of Audit Evidence Using Belief Functions, Hai Lu, Hai Lu

Research Collection School Of Accountancy

This article performs two types of analysis using Dempster-Shafer theory of belief functions for evidential reasoning. The first analysis deals with the impact of the structure of audit evidence on the overall belief at each variable in the network, variables being the account balance to be audited, the related transaction streams, and the associated audit objectives. The second analysis deals with the impact of the relationship (logical "and" and "algebraic relationship") among various variables in the network on the overall belief. For our first analysis, we change the evidential structure from a network to a tree and determine its impact.

Draft Of The Integrated Studies Of Educational Technology: A Formative Evaluation Of The E-Rate Program, Michael J. Puma, Duncan D. Chaplin, Kristen M. Olson, Amy C. Pandjiris

Department of Sociology: Faculty Publications

Although the United States is a leader of the technological revolution, there are segments of American society—particularly the poor, minorities, and the geographically isolated—for whom access to computers and the Internet is significantly lower. The E-Rate, created by Congress as part of the Telecommunications Act of 1996 (Public Law 104-104), is a federal program that seeks to bridge this “digital divide” by supporting broader public access to the new digital technology at public and private nonprofit educational institutions. The availability of such public access points has been found to reduce economic and racial disparities, and some research suggests that when …

Defining And Customizing Tagmemic Interaction For Historic House Museum Websites: A Study Of Effective Learning Design For Museum Educators, Julie Jenkins Strohkorb Oct 2002

Defining And Customizing Tagmemic Interaction For Historic House Museum Websites: A Study Of Effective Learning Design For Museum Educators, Julie Jenkins Strohkorb

English Theses & Dissertations

Educational multimedia tools that are marketed most successfully usually are described as "interactive" learning resources. The word interactive broadly suggests a host of positive learning experiences - student-driven inquiry, audio-visual support of ideas, and critical thinking or decision-making opportunities. However, the term interactive often is used loosely, and begs for a more concrete definition. This study defines multimedia interactivity as a give-and-take relationship between a technology tool and its human user. Technology itself is not interactive, but technology can be designed and developed to enhance an interactive experience. This study looks at the problem of defining such a nebulous term, …
