Law Schools As Legal Education Centers, Martin H. Belsky Jan 2002

Law Schools As Legal Education Centers, Martin H. Belsky

Akron Law Faculty Publications

Legal education in the early twentieth century was divided into three concurrent paths-study at one of the "elite" law schools, consisting of mostly full-time students already possessing a college degree; study at one of the other mostly part-time practice based schools; and a course of study with a practitioner/mentor outside of formal educational institutions. ... Graduation was a serious event, as students were already thinking about passing the bar exam. ... Some of the reasons that law schools can deliver legal education to elementary and secondary students, obviously apply to junior college, college, and non-law school graduate and professional education …

Intergroup Rivalry, Anti-Competitive Conduct And Affirmative Action, Michelle Adams Jan 2002

Intergroup Rivalry, Anti-Competitive Conduct And Affirmative Action, Michelle Adams

Articles

Significant research in social science describes racial inequality as grounded in notions of group identity and group conflict. Sociologists and social psychologists who study discrimination and prejudice have moved away from theories that explain prejudice solely as a problem of individual perception, and toward theories that view individual cognitive processes as related to group membership. While present social science yields no consensus view, there is a striking emphasis in the current literature on group identity theories as "powerful determinants of behavior." These theories, which stress the importance of prejudice as a group-based phenomenon and focus on "social-structural theories of group …

Using The Pervasive Method Of Teaching Legal Ethics In A Property Course, Thomas L. Shaffer Jan 2002

Using The Pervasive Method Of Teaching Legal Ethics In A Property Course, Thomas L. Shaffer

Journal Articles

The first-year introductory course in property law is about all that is left of the traditional black-box curriculum. It is where beginning law students cope with and despair of the arcana of English common law; where, with more detachment than, say, in the torts course, analysis of appellate opinions is what "thinking like a lawyer" means, with no more than peripheral and begrudging attention to modem legislation and administrative law; where legal reasoning is a stretching exercise and initiatory discipline. And, incidentally, surviving bravely the rude invasion of teachers of public law, it is where a teaching lawyer can point …

Empirical Work In Family Law, Margaret F. Brinig Jan 2002

Empirical Work In Family Law, Margaret F. Brinig

Journal Articles

Until fairly recently, researchers have not done much theoretical work on the subject of family law. Although the move towards theoretical work is a positive one, unfortunately, most of the latest reforms in family law have been uninformed by empirical studies. Furthermore, the few empirical studies that have been conducted are replete with intractable problems.

In this essay, Margaret Brinig discusses some of the problems researchers have encountered in their attempts to conduct empirical work in the area of family law. For example, most researchers have used state cross-sectional data for their experiments. Reliance on this type of data can …

New Voices In The Tradition: Medieval Hagiography Revisited, Marie Anne Mayeski Jan 2002

New Voices In The Tradition: Medieval Hagiography Revisited, Marie Anne Mayeski

Theological Studies Faculty Works

The author argues for the use of hagiographical texts to expand the evidence for the theological tradition, precisely during the early Middle Ages when more obvious sources are wanting. Her thesis is that there is sound basis for reading the lives of the saints through the lens of doctrinal theology. After giving this evidence, she then exemplifies the value of such a reading by an ecclesiological analysis of Rudolf of Saxony’s life of St. Leoba, a companion of St. Boniface.]

The Promise Of A Post-Genocide Constitution: Healing Rwandan Spirit Injuries, Adrien Katherine Wing, Mark Richard Johnson Jan 2002

The Promise Of A Post-Genocide Constitution: Healing Rwandan Spirit Injuries, Adrien Katherine Wing, Mark Richard Johnson

Michigan Journal of Race and Law

This Article hopes to extend Critical Race Theory's social construction of race theory by emphasizing ethnicity as well as race. The Rwandans are undoubtedly within the so-called "Black race." Historically, they have also been socially constructed as consisting of different races and ethnicities, even though many scholars and Rwandans do not see ethnic, much less racial, distinctions. Some of these Rwandans who did see such differences participated in the genocide.

The Place Of Dietary Practices In The Lives Of Older Women, Lisa Marie Curch Jan 2002

The Place Of Dietary Practices In The Lives Of Older Women, Lisa Marie Curch

University of Kentucky Doctoral Dissertations

Studies have supported the benefits of positive dietary behaviors in preventing or reducing morbidity and extending longevity, as well as the psychosocial function of dietary practices for quality of life. Research is needed though on the dietary behaviors of elders in general and older women in particular, for whom gender affects lifelong dietary patterns. Health behavior theory has typically focused on psychological factors, to the neglect of sociocultural processes. This investigation utilized a life course perspective, enhanced by social interactionist elements, to address aspects of development and change in behavior neglected by health behavior theories, such as temporal dimensions and …

Review Of Timothy S. Laniak, Shame And Honor In The Book Of Esther, Sidnie White Crawford Jan 2002

Review Of Timothy S. Laniak, Shame And Honor In The Book Of Esther, Sidnie White Crawford

Department of Classics and Religious Studies: Faculty Publications

This book, a study of the anthropological categories of “shame” and “honour” in the Book of Esther, represents an excellent new contribution to the field of Esther studies. It is new because, as Laniak observes, the significance of the categories of “honour” and “shame” have diminished in the modern west (p. 1), and contemporary readers of the Book of Esther may be unaware of the operation of these categories on the plot and characters of the book. Laniak’s book, a basically unrevised form of his 1997 Harvard Divinity School dissertation, sheds important light on this neglected aspect of the Book …

Impact Of Transformational Leadership On Follower Development And Performance: A Field Experiment, Taly Dvir, Dov Eden, Bruce Avolio, Boas Shamir Jan 2002

Impact Of Transformational Leadership On Follower Development And Performance: A Field Experiment, Taly Dvir, Dov Eden, Bruce Avolio, Boas Shamir

Department of Management: Faculty Publications

In a longitudinal, randomized field experiment, we tested the impact of transformational leadership, enhanced hy training, on follower development and performance. Experimental group leaders received transformational leadership training, and control group leaders, eclectic leadership training. The sample included 54 military leaders, their 90 direct followers, and 724 indirect followers. Results indicated the leaders in the experimental group had a more positive impact on direct followers' development and on indirect followers' performance than did the leaders in the control group.

Detection Of Giardia Duodenalis Antigen In Coprolites Using A Commercially Available Enzyme-Linked Immunosorbent Assay, Marcelo Luiz Carvalho Gonçalves, Adauto Araújo, Rosemere Duarte, Joaquim Pereira Da Silva, Karl Reinhard, Françoise Bouchet, Luis Fernando Ferreira

Karl Reinhard Publications

The objective of this experiment was to assess the utility of a commercially available enzyme-linked immunosorbent assay (ELISA) kit for diagnosis of giardiasis in archaeological human remains. The kit, a monoclonal antibody assay, is used to detect the presence of Giardia-specific antigen 65 (GSA65) in human feces. We utilized the assay in ancient fecal material. The material included desiccated feces found in mummies or in archaeological sites, and sediments from latrines. A total of 83 specimens, previously examined microscopically for parasites, were examined. The ELISA detected 3 positive samples, dated to about 1200 AD, 1600 AD, and 1700 AD. …

Multidisciplinary Coprolite Analysis, Karl Reinhard, Dennis R. Danielson, Mark Daniels, Sérgio Augusto De Miranda Chaves Jan 2002

Multidisciplinary Coprolite Analysis, Karl Reinhard, Dennis R. Danielson, Mark Daniels, Sérgio Augusto De Miranda Chaves

Karl Reinhard Publications

Coprolite analysis, as reviewed by Reinhard and Bryant (1992), contributes unique and detailed information regarding diet and parasitic disease. We present here an analysis of dietary components of coprolites from Bighorn Cave using macroscopic remains, pollen concentrations, and phytoliths. In addition, we analyzed Bighorn Cave coprolites for evidence of parasitic organisms, especially intestinal worms. Such analyses of coprolites have become important methods for reconstructing past dietary and medicinal practices. Pollen concentration and phytolith quantification techniques have recently been developed, but until this report no known attempt has been made to synthesize pollen, macroscopic, and phytolith data from a single coprolite …

Implications Of Water Supply For Indigenous Americans During Holocene Aridity Phases On The Southern High Plains, Usa, Warren W. Wood, Stephen Stokes, Julie Rich Jan 2002

Implications Of Water Supply For Indigenous Americans During Holocene Aridity Phases On The Southern High Plains, Usa, Warren W. Wood, Stephen Stokes, Julie Rich

United States Geological Survey: Staff Publications

Springs in the 40 to 50 large lake basins (>15 km2) on the southern portion of the Southern High Plains (SHP) were active during periods of aridity in the Holocene when there may have been human habitation of the area. Eolian erosion of the lake floors and lunette accretion occurred as groundwater levels declined in response to decreased groundwater recharge. The declining lake floor associated with eolian erosion allowed groundwater evaporative discharge to continue, thus maintaining a groundwater gradient toward the lake. This hydrologic condition was favorable for a relatively continuous spring discharge to the lake, independent …

You Are Likely To Be Eaten By A Grue: How Computer Games Are Consuming Modern Culture, Douglas Alexander

Theses

Computer games represent an area of untapped, unappreciated potential in the human-computer relationship. Having long been considered "low culture" and unworthy of scholarly attention, the focus on games is intensifying as the field of ludology emerges. The first game was created forty years ago, and since then games have branched out from their traditionally young male user base and gained popularity with both adults and females. Violence in and addiction to games remain controversial topics, but the threat posed by games fades a bit in comparison to the fascinating insights they give us into literature, art, and cinema. Their cultural …
