Bioterrorism, Public Health, And International Law, David P. Fidler

In this article, I contemplate the potential impact of the anthrax attacks on various areas of international law that affect public health-namely, the international law on the use of force, arms control, terrorism, global infectious disease control, human rights, trade in goods, and the protection of intellectual property rights. In addition, I make observations about how the recent bioterrorism may affect the direction and content of global public health efforts. In the end, my analysis generates more questions than answers, but the potential impact of the bioterrorist attacks on international law and global public health is so serious that even …

Direct And Indirect Shadow Price And Cost Estimates Of Nitrogen Pollution Abatement, Saleem Shaik, Glenn A. Helmers, Michael R. Langemeier

The implication of treating environmental pollution as an undesirable output (weak disposability) as well as a normal input (strong disposability) on the direct and indirect shadow price and cost estimates of nitrogen pollution abatement is analyzed using Nebraska agriculture sector data. The shadow price of nitrogen pollution abatement treated as an undesirable output represents the reduced revenue from reducing nitrogen pollution. In contrast, the shadow price of nitrogen pollution abatement treated as an input reflects the increased cost of reducing nitrogen pollution. For the 1936-97 period, the estimated shadow price and cost of nitrogen pollution abatement for Nebraska ranges from …

Few studies have compared the suitability of different artificial reef construction materials in terms of their efficacy in acquiring diverse faunal assemblages. We compared the fishes associated with 12 co-located reefs constructed of limestone quarry boulders, concrete-gravel aggregate, or concrete-tire aggregate (four of each substrate) in 7 m of water, 200 m offshore Miami Beach, Florida, USA. All 12 reefs were deployed 100 m apart the same day in two lines of six. The four quarry stone reefs consist of a pile of 50 boulders each. In his book, Free Speech, "The People's Darling Privilege": Struggles for Freedom of Expression in American History, Professor Michael Kent Curtis documents the political struggles over free speech rights that took place between the ratification of the Bill of Rights in 1791 and the adoption of the Fourteenth Amendment in 1868. Professor Curtis looks to these early free speech fights to help define the contours of contemporary speech rights. In this review, Professor Mark A. Graber discusses Professor Curtis's contribution to constitutional history, and the implications of The People's Darling Privilege for constitutional theorists

Locating Postmodern Epistemology, Organizational Structure And Postcolonial Workers In The Knowledge Rhizome, Viren Mascarenhas

The three excerpts from Amitav Ghosh's novels find the main characters speculating about the relationship between organizational structures, epistemology and knowledge production. In the first excerpt, Arjun tells Dinu that he does not believe that the colonial bureaucracy known as the British Anny will continue to exist if the policy of separating Indian and British officers persists. Anticipating the problems created from Indians holding leadership positions, he doubts that the British Anny "can go on." Reflecting on the growing prominence of public health in world politics and international law, the Chicago Journal of International Law has chosen to devote attention to the dynamic relationship that exists between public health and international law today. This symposium provides a glimpse of the scope and diversity of areas in which international law and public health intersect, but it does not exhaust the public health/international law discourse. First Amendment Liberalism As Global Legal Architecture: Ascriptive Groups And The Problems Of The Liberal Ngo Model Of International Civil Society, Benedict Kingsbury

The growing sense that there exists, or ought soon to exist, an international civil society has begun to inspire among its participants and proponents a quest for a more complete articulation of normative principles, perhaps even a kind of constitution, to guide the future development of such a society and to build a sense of coherence and solidarity among its adherents. In this short essay I will argue first that an operational code resembling First Amendment liberalism has been the de facto guide in the construction of international civil society, and second that this code encourages voluntaristic non-governmental organizations ("NGOs") …

In recent years, the public image of charitable organizations has been harmed by highly publicized cases of executive theft of charitable assets. While the federal government has responded by requiring public disclosure of financial information and by imposing intermediate sanctions on insiders receiving excessive benefits, the best place to detect or prevent theft of charitable assets is at the board level. In many cases, charitable organizations could have prevented theft of assets by ensuring that standard procedures, designed to prevent and detect such thefts, were in place. International legal regulation is required either to protect humans from potential harm-an interest all governments share-or to protect proprietary or financial interests of significance to international commerce-a concern of governments supportive of the business interests of individuals or corporations under their jurisdiction. What international law there is in this field appears to respond to these two sets of often conflicting concerns. I will begin with the assumptions underlying the specific instruments of international law that address genetic manipulation and then focus on the human rights implications of these technologies. It is now well documented that over the past forty years, participation in civic organizations has declined across-the-board. All factors indicate that society is more fragmented today than in the nineteenth century. In response, various political and legal theorists have called for a return to a republican—as opposed to our current liberal—conception of freedom. The Uniform Trust Code (200) (“UTC”) is the first effort by the National Conference of Commissioners on Uniform State Laws to provide the states with a comprehensive model for codifying their law on trusts. This Article provides an overview oft eh UTC, describes how it reponds to recent developments in American trust practice, and describes how its enactment would change the trust law prevailing in most American states.
