The Facilitator - An Open Source Effort To Support Multiobjective Decision Making, P. Heilman, Greg Davis, Paul Lawrence, Jerry L. Hatfield, John Huddleston

International Congress on Environmental Modelling and Software

Multiobjective Decision Support technology has matured to the point where new efforts should incorporate components of existing systems, rather than build everything from scratch. To help such efforts, the Java source code to a multiobjective decision support system called “The Facilitator” has been revised and released under the Mozilla Public License. This open source effort will be of interest to three groups. First, anyone needing a tool for multiobjective decision support can use the Facilitator. Users familiar with Java can now see how actions in the Facilitator are implemented or modify the user interface. Second, the open source approach might …

Unmasking The Presumption In Favor Of Preemption, Mary J. Davis

Law Faculty Scholarly Articles

It is inescapable: there is a presumption in favor of preemption. Historically, the Supreme Court has said differently-that, rather, there is a presumption against preemption. There is no such presumption any longer, if, indeed, there ever really was one. Preemption doctrine has been exceedingly puzzling in the last decade, but when one recognizes that the Court's doctrine not only favors preemption, but presumes it, preemption doctrine is not a puzzle at all.

Contradictions, Open Secrets And Feminist Faith In Enlightenment, Heather Lauren Hughes

Many feminists target ignorance of domestic violence as the main reason for judicial resistance to decisions that would punish abusers and redress battered women's harms. But feminist demands to educate courts - to create, for example, a reformed tort law system in which courts understand and take into account the complex situation of battered women litigants - seek an epistemological grounding from which to adjudicate the intractable contradictions in both legal discourse and cultural discourse about women. Domestic violence continues to co-exist with public condemnation of such violence by feminists and some lawmakers. Domestic violence is an open secret in …

There is a case that has piqued my interest in recent years. Lakin v. Postal Life & Casualty Co., is a relatively simple story of two men whose paths crossed in Kansas City, Missouri, more than forty years ago. One was a down-in-the-luck drifter, and the other a con-artist who made his living by taking advantage of others. These two men would be long forgotten but for the fact that their final interactions during a hunting trip near Pleasant Hill, Missouri, raised some insurance law issues that ultimately made their way to the Missouri Supreme Court. Treaties In Collision: The Biosafety Protocol And The World Trade Organization Agreements, Sabrina Safrin

In the event of a conflict between the requirements of the Biosafety Protocol, a multilateral agreement governing the trade in genetically modified organisms, and the requirements of the General Agreement on Tariffs and Trade and associated agreements (collectively WTO Agreements), which treaty's requirements prevail? This question lies as the legal heart of the perceived conflict between trade globalization and environmental protection. This issue is particularly timely given the present trade dispute between the United States and European Union over the European Union’s restrictions on the importation of genetically modified agricultural commodities.
