How Does Dipping Into Your Pension Affect Your Retirement Wealth?, Gary V. Engelhardt Jan 2001

How Does Dipping Into Your Pension Affect Your Retirement Wealth?, Gary V. Engelhardt

Center for Policy Research

Although pensions, both public and private, are intended to provide income during retirement, a growing number of American workers receive part or all their employer-provided pensions in the form of a cash settlement, called a lump-sum distribution, when they change jobs. They have many choices of what to do with that money: for example, they can roll it over into an Individual Retirement Account (IRA), spend the money or pay or debt, transfer it to the pension plan of a new employer, or even leave the money with the old employer's pension plan. Policymakers are concerned that workers who spend …

Some New Approaches To Formulate And Estimate Friction-Bernoulli Jump Diffusion And Friction-Garch, Chihwa Kao Jan 2001

Some New Approaches To Formulate And Estimate Friction-Bernoulli Jump Diffusion And Friction-Garch, Chihwa Kao

Center for Policy Research

In this paper we propose a friction model with a Beroulli jump diffusion and a friction with GARCH to examine the exchange rates movements in Taiwan. The proposed model resolves the estimation problem associated with the stepwise movements of observed exchange rates. The specification maintains the desirable economic properties associated with movements in exchange rate returns and is empirically tractable. The AIC apparently favors the model based on Friction-GARCH model.

Geography, Industrial Organization, And Agglomeration Heteroskedasticity Models With Estimates Of The Variances Of Foreign Exchange Rates, Chihwa Kao Jan 2001

Geography, Industrial Organization, And Agglomeration Heteroskedasticity Models With Estimates Of The Variances Of Foreign Exchange Rates, Chihwa Kao

Center for Policy Research

This paper proposes a robust estimation procedure, the bounded influence estimate (BIS), which is robust against departure from the conditional normality of the autoregressive conditional heteroskedasticity (ARCH) models to describe the behavior of exchange rates. First, the BIE identifies the additive outliers (AO, e.g., Fox 1972) caused by abnormal information arrivals which may be triggered by changes in domestic policies and international shocks. Identification of outliers allows us to analyze the major economic and political factors that contribute directly to the dramatic changes in exchange rates. Second, the performance of the BIE is compared with the maximum likelihood estimate (MLE) …

Body Image Distortion In College Females: Effects On Exercise Identity And Commitment, Marie Schroder, Lauren Leslie, Mary Leigh Gregory Jan 2001

Body Image Distortion In College Females: Effects On Exercise Identity And Commitment, Marie Schroder, Lauren Leslie, Mary Leigh Gregory

Modern Psychological Studies

Body image concerns have been related to behavioral aspects of exercise. This study examined the psychological aspect of exercise on role identity. It was hypothesized that college females who overestimated percentage body fat were more likely to identify exercise as an integral self-concept and commit strongly to exercise than correct or underestimators. Twenty-five undergraduate females, never diagnosed with an eating disorder, completed an Exercise Identity Scale and a Commitment to Exercise scale. Body fat was assessed using calipers at three body sites. Body image distortion is prevalent among normal populations but shows no significant relation to exercise identity and commitment. …

Sex: The Defining Variable In Mate Selection, Shirley A. Forbes, Tanacha Brown, Timothy Adams, Lenore Davis Jan 2001

Sex: The Defining Variable In Mate Selection, Shirley A. Forbes, Tanacha Brown, Timothy Adams, Lenore Davis

Modern Psychological Studies

The evolutionary hypothesis of mate selection was tested by combining traits deemed as evolutionarily valued (Cramer, Schaeffer Et Reid, 1996) with pictures showing facial features deemed as physically attractive according to the evolutionary hypothesis (Buss, 1989; Singh, 1995). Traits and pictures not congruent with the evolutionary hypothesis were also presented. Four stimulus persons were presented to ninety-one male subjects and 114 female subjects who were asked to rate their desirability as a mate. The results showed a main effect for stimulus condition, with the physical attractiveness pictures receiving the highest ratings when combined with the valued evolutionary traits, F (3, …

The Marbury Mystery: Why Did William Marbury Sue In The Supreme Court?, Susan Low Bloch Jan 2001

The Marbury Mystery: Why Did William Marbury Sue In The Supreme Court?, Susan Low Bloch

Georgetown Law Faculty Publications and Other Works

In 1801, when William Marbury petitioned the Supreme Court to issue a writ of mandamus ordering Secretary of State James Madison to deliver his commission as justice of the peace, he initiated one of the most important cases in the Court's history. But why did Marbury choose the Supreme Court? Was there a lower federal court that could have granted the writ at the time? The short answer is "yes." Rather than making an unsuccessful attempt to invoke the original jurisdiction of the United States Supreme Court, I have learned that he could have brought his suit in the then …

Accommodating The Public Sphere: Beyond The Market Model, Nan D. Hunter Jan 2001

Accommodating The Public Sphere: Beyond The Market Model, Nan D. Hunter

Georgetown Law Faculty Publications and Other Works

This Essay has two major components. First, in Parts I and II, I describe and critique the Court's opinion in Dale, beginning with an examination of the social origins of scouting, then proceeding to an analysis of Dale. Second, in Parts III and IV, I place the questions raised in Dale in another context in which they belong but are seldom analyzed, that of the jurisprudence of public accommodations laws . . . In conclusion, I join the two major themes by framing Dale's claim as the latest in a series of cases that have invoked an evolving understanding of …

The Bakaly Debacle: The Role Of The Press In High-Profile Criminal Investigations, Julie R. O'Sullivan Jan 2001

The Bakaly Debacle: The Role Of The Press In High-Profile Criminal Investigations, Julie R. O'Sullivan

Georgetown Law Faculty Publications and Other Works

Others have examined why prosecutors or law enforcement agents may be inclined to "leak" information regarding ongoing criminal investigations, documented the rules that govern federal prosecutors' interaction with the press in such circumstances, outlined the difficulties encountered in enforcing those rules, and critiqued the performance of Mr. Starr's office in this regard. In other words, the dynamic as it flows from governmental actors to the press has been scrutinized. I would like to suggest that a more searching examination be conducted of the press's role, and perhaps its responsibilities, in this context. Because I am neither a journalist nor a …

Law, Marriage, And Intimate Commitment, Milton C. Regan Jan 2001

Law, Marriage, And Intimate Commitment, Milton C. Regan

Georgetown Law Faculty Publications and Other Works

Does society have any interest in the stability of marriage per se - that is, apart from any concerns about the impact of divorce on children or financially dependent spouses? Should law try in any way to reinforce an ethic of commitment in marriage as a good in and of itself? . . . Two social trends make this a timely issue. First is the steady erosion of the link between marriage and procreation over the last generation. More married couples do not have children; more children are born outside of marriage. A second trend is the rise of unmarried …

Legislative Constitutional Interpretation, Neal K. Katyal Jan 2001

Legislative Constitutional Interpretation, Neal K. Katyal

Georgetown Law Faculty Publications and Other Works

This is an Essay about "the how" of constitutional interpretation. Much attention has been devoted to the question of how the Constitution is interpreted in courts. Rather little attention has been devoted to the question of how the Constitution is interpreted elsewhere in the government. The Constitution tells us that Congress, the President, and state legislators and courts must adhere to its terms, but it does not tell us how much interpretive power each actor should have, nor does it prescribe rules for each actor to use when interpreting the text. I argue that constitutional interpretation by Congress is, and …

Legal Subjects: The Tropological Construction Of "Woman" In Legal Narratives, Kate Mele Jan 2001

Legal Subjects: The Tropological Construction Of "Woman" In Legal Narratives, Kate Mele

Open Access Dissertations

This dissertation examines the legal narrative as a contemporary discursive structure whose patriarchal operations depend upon the tropological construction of "woman." As gender categories break down, the legal narrative of the 1980s and 1990s provides a forum within which various ideological constituencies encounter, resist, and assimilate one another--in other words, where feminisms meet patriarchy. I argue that "woman" emerges as the material of production through which patriarchal ideology perpetuates itself in the legal narrative. According to Althusser, ideology operates so as to obscure its own operations. If we read his theory through the lens of rhetoricality, where the shifting ground …

Characterization And Fractal Analysis Of Volcanic Particles: A Multidimensional Approach To Interpretation Of Volcaniclastic Deposits, Anton Hanna Maria Jan 2001

Characterization And Fractal Analysis Of Volcanic Particles: A Multidimensional Approach To Interpretation Of Volcaniclastic Deposits, Anton Hanna Maria

Open Access Dissertations

This thesis consists of three studies which focus on characteristics of volcaniclastic particles to gain insight to eruptive and depositional processes involved in their formation. The combination of modal, grain-size, geochemical, and particle-shape analyses results in a multi-dimensional approach to studying volcaniclastic deposits. The first chapters deal with volcanic clasts deposited adjacent to hotspot ocean islands (Gran Canaria and Iceland). Clastic apron sediments can be especially useful, recording a complete geologic history including stages of volcanism absent from the subaerial record. Apron sediments from Gran Canaria, recovered at Site 953 (ODP Leg 157), were examined for insight to hotspot island …

Embedded Impediments To Joint Venture Success: A New Institutional Theory Perspective On Negotiating With Russian Principals, Valentin H. Pashtenko Jan 2001

Embedded Impediments To Joint Venture Success: A New Institutional Theory Perspective On Negotiating With Russian Principals, Valentin H. Pashtenko

Open Access Dissertations

This dissertation challenges the current prevalent view (found in the research literature) that learning does not occur during periods of economic upheaval. In particular, it examines the various types of negotiating behavior that Russian business executives have developed during a period of rapid social change. Using a qualitative methodology, this research project has distilled three different mindsets about negotiating at the bargaining table that Russian business executives have developed. This dissertation then uses a quantitative methodology to examine whether New Institutional Theory (NIT) offers the best possible explanation of why these three executive mindsets have emerged during this time. The …

The Effects Of The Intensity Of Conflict And Commitment On Marketing Channel Partnership Survival, Elizabeth F. Purinton Jan 2001

The Effects Of The Intensity Of Conflict And Commitment On Marketing Channel Partnership Survival, Elizabeth F. Purinton

Open Access Dissertations

The survival of marketing channel partnerships is important to both the buyer and the seller. Dissolution would entail loss of sales and partnership-specific assets, and would require outlay of time, money and effort to find and invest in a new partnership. Unfortunately for both practitioners and academicians, little is known about the maintenance and dissolution of partnerships despite the call for research put forth by Frazier (1983, 1999), Dwyer, Schurr and Oh (1987), and Ping (1993). The intent of this paper is to examine several relationships within partnership dynamics. First, are the roles of commitment and conflict and their potential …

Optimal Estimation Of Nonlinear And Linear Parameters In General Linear Models, Supratim Saha Jan 2001

Optimal Estimation Of Nonlinear And Linear Parameters In General Linear Models, Supratim Saha

Open Access Dissertations

This dissertation primarily concerns maximum likelihood (ML) estimation of linear and nonlinear parameters in some class of general linear models (GLMs). We deal with problems which are directly expressible in GLM as well as the ones in which some manipulation is required to obtain a GLM. It is well known that the joint ML estimation of the linear and nonlinear parameters in a GLM leads to a multidimensional grid search. As closed form solutions do not exist, iterative techniques have been the only resort to avoid a multidimensional grid search. However iterative techniques are not guaranteed to converge. As a …

Free-Standing Due Process And Criminal Procedure: The Supreme Court's Search For Interpretive Guidelines, Jerold H. Israel Jan 2001

Free-Standing Due Process And Criminal Procedure: The Supreme Court's Search For Interpretive Guidelines, Jerold H. Israel

Articles

When I was first introduced to the constitutional regulation of criminal procedure in the mid-1950s, a single issue dominated the field: To what extent did the due process clause of the Fourteenth Amendment impose upon states the same constitutional restraints that the Fourth, Fifth, Sixth and Eighth Amendments imposed upon the federal government? While those Bill of Rights provisions, as even then construed, imposed a broad range of constitutional restraints upon the federal criminal justice system, the federal system was (and still is) minuscule as compared to the combined systems of the fifty states. With the Bill of Rights provisions …

Moral Courage And Civility, William I. Miller

Articles

Here follow some words from the book which, given our lost sense of security and innocence in light of Pearl Harbor II of Sept. 11, 2001, turns out to have a more pressing relevance than it had when I wrote it a couple of years ago.

The Dynamic Analytics Of Property Law, Michael A. Heller Jan 2001

The Dynamic Analytics Of Property Law, Michael A. Heller

Articles

The standard property trilogy of private, commons, and state has become so outdated that it now impedes imagination and innovation at the frontiers of ownership. This essay suggests two approaches - creating new ideal types and synthesizing existing ones - that may help update our static property metaphors. Using these dynamic approaches to property analytics, legal theory can move beyond polarizing oppositions that have made jurisprudential debates unsolvable and rendered concrete problems invisible.

From Miranda To §3501 To Dickerson To...(Symposium: Miranda After Dickerson: The Future Of Confession Law), Yale Kamisar

Articles

Once the Court granted [certiorari in Dickerson] court-watchers knew the hour had come. At long last the Court would have to either repudiate Miranda, repudiate the prophylactic-rule cases [the cases viewing Miranda's requirements as not rights protected by the Constitution, but merely "prophylactic rules"] or offer some ingenious reconciliation of the two lines of precedent. The Supreme Court of the United States, however, doesn't "have to" do anything, as the decision in Dickerson once again reminds us.

Religion And The First Justice Harlan: A Case Study In Late Nineteenth Century Presbyterian Constitutionalism, James W. Gordon Jan 2001

Religion And The First Justice Harlan: A Case Study In Late Nineteenth Century Presbyterian Constitutionalism, James W. Gordon

Faculty Scholarship

In this Article, the Author argues that Harlan's religion and its values informed both his personal and his public life. Harlan's close personal friend, Justice Brewer, once commented on Harlan's personal attachment to the two "fundamental" documents in his life: the Bible and the Constitution. Justice Brewer suggested that Harlan had one hand on the Bible, and the other hand on the Constitution when he went to bed every night. Although it is widely known that Harlan was a religious man, only recently has any scholar paid much attention to this fact. No one has fully described the principles of …

Epilogue, Jennifer L. Levi Jan 2001

Epilogue, Jennifer L. Levi

The First Circuit reversed the district court's order dismissing Lucas Rosa's claim against Park West Bank. The appeals court's reversal seems to be part of an emerging nationwide rejection of cases from the 1970s and 1980s. In these cases courts summarily dismissed sex discrimination claims brought by transgender plaintiffs, no matter how squarely the facts appeared to present a clear-cut case of discrimination based on sex. This created that appeared to be a "transgender" exception to sex discrimination law. Earlier courts ignored what the First Circuit recognized here-that a bank officer who tells an applicant to go home, change, and …

The result, the American Bar Association ("ABA") says, has been a troubling disconnect between the legal profession …

I Was Just Doin' My Duty: The Influence Of Social And Cultural Conceptions On American Participants In The Second World War, Margaret E. Williamson Jan 2001

I Was Just Doin' My Duty: The Influence Of Social And Cultural Conceptions On American Participants In The Second World War, Margaret E. Williamson

Theses, Dissertations and Capstones

As the generation of Americans who fought World War II reached retirement age, a sense of nostalgia about their unforgettable days of fighting a common and undeniably evil enemy began to permeate American popular culture. This perception reinforced the concept of the Allies as the protectors of the world from tyrannical forces and leaders. Such an assessment of the conflict by Americans stemmed from the atrocities committed by Germans against Jews and other minorities. Furthermore, the unexpected attack on American territory by the Japanese justified the sacrifices made by millions of Americans. Nearly sixty years after the initiation of United …

Sexual Harassment Policies And Procedures In South Florida Community Colleges: Perceived Affects On Teaching Learning, Lyn J. Pont

Graduate Student Dissertations, Theses, Capstones, and Portfolios

The purposes of this research were to determine: 1.) if sexual harassment policies, content, communication and subsequent related training, or lack thereof, subject South Florida community colleges to legal risk; and 2.) the perceptions of how sexual harassment policies and procedures affect students and faculty, their interactions, and how students learn and how faculty teaches, being mindful of a possible cultural component.

In determining if the sexual harassment policies and training subjected the colleges to legal risk, a sexual harassment policy and procedural grid was used to analyze the policies in place at all four South Florida community colleges. The …
