In the last forty years, many new solo and chamber pieces have been written for the trombone which involve elements of a theatrical nature, including lighting, make-up, costume, stage direction, dialogue/narration, sound effects, props, and audience interaction. It is difficult for a trombonist searching for music to discern a piece's theatrical nature by its listing in most catalogs. This document has attempted to solve that problem by gathering pieces that share these elements into an annotated collection. Nearly 200 pieces were discovered through contacts made with individual trombonists, composers, and publishers around the world. Of these, over sixty were acquired …

The focus of this article is the proper treatment in a chapter 7 or 11 bankruptcy proceeding of the federal income tax incurred by a corporate debtor for the year in which the bankruptcy petition is filed, the so-called "straddle-year." Bankruptcy law requires that the straddle-year income tax be apportioned between the pre-petition and post petition portions of the year for priority purposes. Yet, neither the relevant statutes nor the reported cases provide a principled method of apportionment. Despite the progress of the last three decades, the American public and even feminists remain caught in a web of ambivalence and contradictory attitudes and beliefs about battered women. Are battered women traumatized victims who suffer at the hands of their individual abusers and from the systemic failures of a male-dominated culture? Are they, therefore, unable to save themselves or their children? In contrast, are these women survivors who manage to protect themselves as best they can under uniquely difficult circumstances? Evaluation Of The Implementation Of Hot Pour Sealants And Equipment For Crack Sealing In Indiana, David R. Ward

This study was initiated as an implementation effort that would monitor, assist with and report on a new maintenance activity involving the trial use of hot pour crack sealant. Work associated with this new activity was qualitatively assessed over a period of several years. INDOT began by purchasing six oil-jacketed melters that were distributed to various sub-districts. Previous INDOT research indicated using hot pour sealant might save on labor expense because it lasted significantly longer than the current emulsion. Random observations were made of various sub-district crews using hot pour sealant and the results were reported to appropriate personnel. Inspections …

The articles in this symposium issue of the American Bankruptcy Institute Law Review attempt to analyze some of the major effects that the 1999 revision of Article 9 of the Uniform Commercial Code will have on bankruptcy law and bankruptcy practice. It is a hazardous activity to attempt to predict in advance the impact of new legislation. That problem is exacerbated when the new law is as extensive and complicated as the revised Article 9. The Indiana Department of Transportation (INDOT) is increasingly committed to the Pavement Management System. For this reason, updated simple pavement performance prediction models with the least number of explanatory (independent) variables are required to predict the performance of various pavement types for future planning of rehabilitation or replacement. In Indiana, the two main pavement types are jointed concrete pavement (JCP) and bituminous pavement (BIT). 1999 and 2000 year data were used to develop regression models for different pavement types for the Interstate and Non- Interstate Roads systems. What is the role of contract law in remedying breach? The question of the appropriate legal remedy, specific performance versus money damages, has provided adequate fodder for three decades of debate in the law and economics discourse. In the legal discipline at large, the topic has spurred centuries of debate, as illustrated by Oliver Wendell Holmes's famous line: “The only universal consequence of a legally binding promise is, that the law makes the promisor pay damages if the promised event does not come to pass.” Holmes's approach to contractual remedy would evolve during the latter half of the twentieth century …

Two of the most talked-about crimes of the year, the ILoveYou computer worm and the denial of service attacks on Yahoo, eBay, and ETrade, suggest that a new form of crime is emerging: cybercrime. Thousands of these crimes occur each year, and the results are often catastrophic; in terms of economic damage, the ILoveYou worm may have been the most devastating crime in history, causing more than $11 billion in losses.

There is a chance that Bush v. Gore may begin a process of laying a more attractive and realistic foundation for constitutionalism than the Official Story provides. The very fact that the Court is not politically independent and that it could not settle the matter in a disinterested, apolitical fashion might set us down a path toward a more mature version of constitutional law. The politically tendentious character of the Coon's reasoning demonstrates that our core constitutional commitments are subject to political manipulation. In this brief Comment I make two points. First, the subconstitutional doctrines appear to have the advantage of allowing elected lawmakers to pursue whatever course they wish, as long as they satisfy the requirements of these subconstitutional doctrines. In practice, however, what appears to be a provisional invalidation based on subconstitutional law turns out to be - and, indeed, might be expected at the moment of decision to be - a final, unrevisable decision. Further, courts might strategically deploy these sub constitutional doctrines to avoid the sting of the charge that they are foreclosing legislative choice while effectively doing so. …

Each year, the Bernstein Lecture features an outstanding antitrust scholar. The Fifth Bernstein Lecturer, Eleanor Fox, fits comfortably in that mold. Professor Fox has forged a distinguished career as teacher and scholar at New York University School of Law. In recent years, she has lectured and written extensively on the globalization of antitrust and has served as a consultant on antitrust issues for transition governments in Eastern Europe. Effect Of Water Temperature On Growth Of Hatchery Reared Black Sea Turbot, Scophthalmus Maximus (Linnaeus, 1758), Temel Şahi̇n

Turkish Journal of Zoology

A rearing experiment was carried out to examine the effect of water temperature on the growth of the Black Sea turbot, Scophthalmus maximus, at ambient temperature (mean 15.2±0.6°C), 18, 20, 22 and 24°C with fish of 34.4±9.9 g initial body weight. The experiment lasted 30 days and the fish were fed to satiation three times a day with a commercial pelleted diet. Survival rates starting with the control group were 100, 83.4, 68.4, 3.4, and 1.7%, respectively. Although the mean weights of the groups were very similar at the beginning of the experiment, they had become markedly varied by the …
