Perpetuating Stigma: Client Identity In Disability Rights Litigation, Laura L. Rovner Jan 2001

Perpetuating Stigma: Client Identity In Disability Rights Litigation, Laura L. Rovner

Utah Law Review

In returning to the question of whether and how lawyers can represent clients in disability rights cases in ways that are more congruent with how at least some of these clients self-identify, I find that part of the answer depends, necessarily, on what it is the client is seeking to achieve through a lawsuit in the first place. To the extent that the client's main objective is not an award of compensatory damages, there may be greater opportunity for the client's voice and story to be presented in a (relatively) unfiltered way. For a client whose primary goal is a …

Religion And Spirituality In Counseling : A Multicultural Perspective, Linda G. Culbertson Jan 2001

Religion And Spirituality In Counseling : A Multicultural Perspective, Linda G. Culbertson

Graduate Research Papers

As the counseling profession moves into the 21st Century a greater emphasis is being placed on multicultural and spiritual issues. It is difficult to see how the two entities can be separated. When counselors ignore that a client is Muslim, Jewish, Hindu, or Christian with the unspoken assumption that religion is irrelevant .to their issues, this may jeopardize the forming of an effective therapeutic relationship (Burke, et al., 1999). Knowledge of religion and spiritual beliefs of ethnic groups can help professionals provide care that is culturally specific and sensitive to the beliefs of the individual (Bibbins, 2000).

An Instructional Project Using Physical Knowledge Activities As A Catalyst To Develop Children's Literacy Skills In A Constructivist Preschool Classroom, Patricia A. Wehr

Graduate Research Papers

This instructional project planned and integrated literacy within physical knowledge activities for young children based on International Reading Association, National Research Council and National Association for the Education of Young Children guidelines. The project presented children with a variety of ramps and other physical knowledge activities. Children's engagement was preserved through digital pictures. The children utilized these pictures to individually construct stories orally and in script. Instruction for three dimensions of emergent literacy was provided: concepts about print, phonemic awareness, and reproduction of the child's correctly printed signature. As the project progressed, the activities and the stories grew in complexity. …

Marijuana Dependence And The Efficacy Of Various Theoretical Treatment Approaches, Leah J. Weber Jan 2001

Marijuana Dependence And The Efficacy Of Various Theoretical Treatment Approaches, Leah J. Weber

Graduate Research Papers

Marijuana is the most commonly used illicit drug in this country (Meyers, 1996), with 40% of the adult population having tried it at least once. Senay (1998) indicated that 9.1 percent of individuals who have ever tried marijuana become dependent. Those who use more than a few times weekly are estimated to be at a considerably higher risk of developing dependence, possibly as much as 20 to 30 percent higher (Denning, 2000).

The Portrayal Of Stepfamilies In Young Adult Literature, Cynthia Buck Tuttle Jan 2001

The Portrayal Of Stepfamilies In Young Adult Literature, Cynthia Buck Tuttle

Graduate Research Papers

This study used content analysis of a selected sample of 25 contemporary young adult fiction books published between 1990-2000, to determine if stepfamilies are portrayed accurately. Contemporary American families are less likely to endure as a traditional biological household. Novels read by young adults may not reflect these new realities. Findings indicate that in a majority of the titles stepparents are portrayed positively and they gave their stepchild time and flexibility to adapt to the stepfamily situation. Findings also revealed that the biological relationship was not more important than the marital relationship. There was insufficient data to prove that the …

A "New" Theory Of Management, Andrew Sikula Sr., Kurt Olmosk, Chong W. Kim, Stephen Cupps

Management Faculty Research

This article presents a "new" theory of management for the new millennium: "new" not because singularly the ideas are recent, but because the combination of these older ideas collectively is novel. To some extent, this article represents the reestablishment of previously existing employment ethics that for various and sundry reasons lapsed into disuse in the past several decades. This article discusses employee relations ethics (ERE) in terms of an ERE credo and a set of assumptions. The modern millennium mission states that all organizations (public and private) should primarily be employee centered, not owner or administrator controlled, customer or client …

Re-Interpreting The Effect Of Rights: Career Narratives And The Americans With Disabilities Act, David Engel, Frank W. Munger Jan 2001

Re-Interpreting The Effect Of Rights: Career Narratives And The Americans With Disabilities Act, David Engel, Frank W. Munger

Articles & Chapters

This article examines how the employment rights guaranteed by the Americans

with Disabilities Act (ADA) affect the careers of individuals with disabilities. The

article draws on in-depth interviews with sixty adults who provided extended life

story narratives, describing early family and educational experiences and later

experiences with employment. Their detailed accounts offer insights into the

sometimes subtle role rights play in peoples lives and careers. Relatively few

rights violations actually lead to explicit or formal invocations of the law. The

effect of the ADA on careers can be profound but is primarily indirect or

symbolic. Moreover, other factors affect the …

Protecting The Performers: Setting A New Standard For Character Copyrightability, Mark Bartholomew Jan 2001

Protecting The Performers: Setting A New Standard For Character Copyrightability, Mark Bartholomew

Journal Articles

Copyright law protects expressions of ideas, but not the idea itself. Legal disputes over characters arise in the continuum between an idea for a character that has not been expressed at all, and an idea that has been given complete form and shape. The inconsistent common law tests developed to assess character copyrightability demonstrate the difficulty in pinpointing where the dividing line between an undeveloped idea and a sufficiently expressed character should be set. This Article offers a new paradigm for determining character copyrightability, particularly in the case of characters shaped through live performance, that tracks the Hegelian concept of …

A Study Of The Superintendency Supply Issue For Public Education In Arkansas, Virginia L. Abernathy

Theses and Dissertations

The purpose of this study was to determine the replacement pool for the projected upcoming superintendent vacancies in Arkansas' public schools. The study sought to determine the number of public school administrators holding a superintendency license and who want to become superintendent in the state of Arkansas during the next five years. In addition, the study addressed factors that encouraged or discouraged applicants in seeking a superintendency position. The sample consisted of the 421 principals and central office administrators who currently held a superintendency license. Only 174 individuals indicated an interest in seeking a superintendency position during the next five …

Crossing Methodological Boundaries: Assessing Visitor Motivations And Support For Management Actions At Yellowstone National Park Using Quantitative And Qualitative Research Approaches, William T. Borrie, Wayne A. Freimund, Mae A. Davenport, Robert E. Manning Jan 2001

Crossing Methodological Boundaries: Assessing Visitor Motivations And Support For Management Actions At Yellowstone National Park Using Quantitative And Qualitative Research Approaches, William T. Borrie, Wayne A. Freimund, Mae A. Davenport, Robert E. Manning

Society and Conservation Faculty Publications

Winter use of Yellowstone National Park has given rise to a complex of management issues, including rapid growth in recreation demand, environmental impacts of snowmobiling, and a string of litigation against the National Park Service (NPS) designed to both protect park resources and maintain public access (Sacklin et al. 2000). The intertwined character of these problems suggests that none can be resolved independently of the other, that policy must be comprehensive in nature, and that many sources of knowledge may be required to effect their resolution.

Impact Of Family Process And Status Variables On Student Academic Achievement, Jennifer L. Meyer Jan 2001

Impact Of Family Process And Status Variables On Student Academic Achievement, Jennifer L. Meyer

Graduate Research Papers

Numerous studies have underscored the strong contributions families make to their children's academic achievement (e.g., Christenson & Buerkle, 1999; Conoley, 1987; Henderson & Berla, 1994). The purpose of the study was to examine the influence of parental involvement and the relationship between family-process and status variables and their impact on student academic achievement. Results indicated when parents and schools establish collaborations and work in conjunction to encourage learning, student academic achievement is enhanced. Furthermore, non-cognitive behavior such as attitudes about school, maturation, self-concept, and behavior are enhanced when parents/families are more involved. Other benefits of close family and school collaboration …

The Relationship Between Competitive State Anxiety And Athletic Performance In Female Volleyball Players, Tsui-Feng Yeh Jan 2001

The Relationship Between Competitive State Anxiety And Athletic Performance In Female Volleyball Players, Tsui-Feng Yeh

Graduate Research Papers

The present study investigated the relationship between competitive state anxiety and athletic performance in female volleyball players. The sample consisted of two volleyball teams (N = 13) with a mean age of 15.54 years (SD = 0.66). Participants included 16 year olds and younger in the Amateur Athletic Union (AAU) volleyball tournament. Thirty minutes prior to the volleyball competition, all subjects were administered the modified Competitive State Anxiety Inventory-2 (CSAI2) (Martens et al., 1990). The findings revealed no significant relationship between competitive state anxiety intensity or interpretation and player's performance. However, there was a significant positive correlation between cognitive anxiety …

A Review Of The Research Literature Pertaining To The Effects Of Student Nutrition Upon Cognitive And Behavioral Performance In The Classroom In Support Of Nutritious Snack Interventions During The School Day, Patricia Annette Winblade

Graduate Research Papers

Many educators know from anecdotal experience that when students are hungry or undernourished, they tend to be irritable, apathetic, and lethargic. They often have little energy and have difficulty concentrating. All of these factors can interfere with learning as well as initiate inappropriate classroom behavior. This study reviews the available body of published research pertaining to the effects of nutrition upon cognitive and behavioral performance in the classroom. Specifically, the purpose of this study was to describe the effects of proper and improper nutrition of students on cognitive and behavioral performance in the context of examining the need for and …

Group Contingencies And Classroom Applications, Eric Weichers Jan 2001

Group Contingencies And Classroom Applications, Eric Weichers

Graduate Research Papers

Group contingency is a method of behavior control which is usually used unknowingly on a daily basis in the classroom. And more than likely, its result was success. So why is it that so few teachers use group contingencies as a formal intervention? One possibility is a lack of understanding concerning the principles involved. Another possibility is an erroneous belief that it is a difficult intervention. It may be the lack of knowledge concerning the power of a group contingency. Whatever the reason, group contingencies are not often employed by teachers as formal interventions.
