The Correction Of Wrongful Convictions: A Comparative Perspective, Lissa Griffin
The Correction Of Wrongful Convictions: A Comparative Perspective, Lissa Griffin
Elisabeth Haub School of Law Faculty Publications
This Article analyzes the different modes in which two facially similar adversarial systems remedy wrongful convictions. Part I briefly examines the origins of wrongful convictions in both England and the United States. Part II describes the appellate processes in the two countries for correcting wrongful convictions. Part III addresses the processes for correcting wrongful convictions after the appellate processes have been completed. Part IV critiques the English process and examines whether aspects of that process may be carried over to the United States.
Faith In Justice: Fiduciaries, Malpractice & Sexual Abuse By Clergy, Zanita E. Fenton
Faith In Justice: Fiduciaries, Malpractice & Sexual Abuse By Clergy, Zanita E. Fenton
Michigan Journal of Gender & Law
This article argues that perpetrators of sexual misconduct should not be granted refuge from the potential consequences of their actions by mere affiliation with a religious institution. Part I of this article examines the theories of malpractice and breach of fiduciary duty, and determines the appropriate cause of action for sexual misconduct and ascertains their capacities to withstand First Amendment scrutiny. Determining the cause of action is essential to the evaluation of the potential constitutional challenges. Part II demonstrates that sexual misconduct by clergy is well outside First Amendment constraints. It examines both the Free Exercise and Establishment Clauses, and …
A Suggestion On Suggestion, Richard D. Friedman, Stephen J. Ceci
A Suggestion On Suggestion, Richard D. Friedman, Stephen J. Ceci
Law Quadrangle (formerly Law Quad Notes)
The following essay is adapted from "The Suggestibility of Children: Scientific Research and Legal Implication" (86.1 Cornell Law Review 33-108 [November 2000]) and appears here with permission of the publisher.
The vulnerabilities of young children have far-reaching implications for the juvenile and criminal justice systems. Arguably, these vulnerabilities may affect how an investigator should interview the child; whether her hearsay statements should be admitted; whether expert evidence concerning her vulnerability should be admitted; and whether a criminal conviction based principally on her testimony should be allowed.

Secondary Legal Sources: A Selected Subject Bibliography Of Treatises, Looseleaf Services And Form Books Seventh Edition, Thomas G. Oatmen
Law Library Publications
This bibliography, now in its seventh edition, is a subject arrangement of selected English language treatises, looseleaf services and form books in the University of Michigan Law Library, current through 2001.
The goal of the bibliography is to list books that provide a starting point for legal research in major areas of American law. It includes only works published since 1990 or those kept current via looseleaf or other supplementation. Books that are kept up-to-date by some sort of supplementation are indicated by a hyphen following the publication date, e.g., "1949-". The bibliography excludes casebooks, journals, popular works and encyclopedias. …

The Relation Of Acculturation, Criminal History, And Social Integration Of Mexican American And Non -Mexican Students To Assaults On Intimate Partners, Ignacio Luis Ramirez
The Relation Of Acculturation, Criminal History, And Social Integration Of Mexican American And Non -Mexican Students To Assaults On Intimate Partners, Ignacio Luis Ramirez
Doctoral Dissertations
Studies that have compared intimate partner violence among Mexican Americans and Non-Mexican Whites have found conflicting results. The results can be grouped into three categories, those that found Mexican Americans have higher assault rates, those that found Mexican Americans have lower assault rates, and those that found no differences between both ethnic groups. This study analyzed a sample of 348 college students to examine the role that Mexican ethnicity and acculturation into Anglo American society by Mexican Americans plays in predicting intimate partner violence. Additionally, the role of criminal history and integration into society were analyzed to understand their unique …
The Business Of Running A Law School, John H. Garvey
The Business Of Running A Law School, John H. Garvey
Scholarly Articles
I confess that as a faculty member I gave little thought to the business of running a law school. Deans do not have that luxury. Someone has to pay attention to things like the budget, payroll, physical plant, purchasing, admissions, career services, and (most important of all) the kind and quality of service that we provide to students in the classroom. Stated abstractly, we are a nonprofit business that provides a service to about 800 customers each year, and we, like all businesses, have to balance our books. From a business point of view the most interesting challenge we face …

To Improve the Academy: A Journal of Educational Development
Faculty often believe that if they do not publish, they will perish. Faculty developers can respond to this need by helping faculty increase their scholarly productivity. Research shows that faculty are more productive if they write for 15-30 minutes daily, organize their writing around key sentences, and get extensive feedback on drafts. This article evaluates a program hosted on two campuses that aimed at supporting 115 faculty achieve these goals. Throughout the program, participants kept records of time they spent writing and the number of pages they wrote and at the end of the program, they were surveyed. These data …
Courts As Watchdogs Of The Washington State Initiative Process, Kenneth P. Miller
Courts As Watchdogs Of The Washington State Initiative Process, Kenneth P. Miller
Seattle University Law Review
This Article describes the high rate at which courts have invali- dated Washington initiatives and then explores why this is so. The Article suggests that it is initiative lawmaking's Populist orientation—with respect to both its unfiltered majoritarian processes and its often—constitutionally suspect substance-that makes initiatives vulnerable to legal attack.

Crime Victims' Rights: Critical Concepts For Animal Rights, Douglas E. Beloof
Crime Victims' Rights: Critical Concepts For Animal Rights, Douglas E. Beloof
Animal Law Review
It is simultaneously intimidating and presumptuous to make observations about a movement that one is not intimately involued in. I am not an animal rights scholar. However, I am in the dignity recognition business. As a legal advocate and academic, I work to promote the dignity of human victims of crime. I have written the only casebook for law students about crime victims law, consult with Congress about crime victim law, and advise attorneys and victim organizations around the country. I also lwt·e considerable experience in taking movements and moving them into practical operations within prosecutors' offices; for example, in …
When Can A State Be Sued?, William W. Van Alstyne
When Can A State Be Sued?, William W. Van Alstyne
Faculty Scholarship
In her Popular Government article "When You Can't Sue the State: State Sovereign Immunity" (Summer 2000), Anita R. Brown-Graham described a series of recent decisions in which a sharply divided U.S. Supreme Court barred individuals from suing states for money damages for certain violations of federal law, such as laws prohibiting discrimination against employees because of their age. In the response that follows, William Van Alstyne argues that this barrier to relief is neither unduly imposing nor novel. The debate over the significance of these decisions is likely to continue. In February 2001, in another case decided by a five-to-four …

An Assessment Of The Icc Statute, Roy S. Lee
An Assessment Of The Icc Statute, Roy S. Lee
Fordham International Law Journal
The large number of signature States together with the current speed of ratification from various regions of the world seems to indicate the general acceptance of the treaty; many of the problems first identified have since been clarified and resolved. It seems reasonable to expect the Rome Statute to come into operation as early as next summer. While it is necessary to ensure effective criminal investigation and prosecution to counter serious human rights violations, we need also to develop additional ways and means for addressing the root causes that led to violations and impunity. Justice is important but justice alone …

The Back-Door To Prison: Waiver Reform, "Blended Sentencing," And The Law Of Unintended Consequences, Marcy Rasmussen Podkopacz, Barry C. Feld
Articles
The Minnesota innovation, "Extended Jurisdiction Juvenile Prosecution (EJJ)," allowed judges simultaneously to impose a delinquency disposition and an adult criminal sentence, the execution of which the judge stayed pending successful completion of the delinquency sentence. Podkapacz and Feld analyze the implementation of Minnesota's new EJJ blended sentencing law in Hennepin County, the largest metropolitan county in the state.
