United States V. Coon: The End Of Detrimental Reliance For Plea Agreements?, David Aram Kaiser Jan 2001

United States V. Coon: The End Of Detrimental Reliance For Plea Agreements?, David Aram Kaiser

UC Law Journal

Increasingly, defendants enter into proposed plea agreements that require pre-plea cooperation with the authorities. In such a situation, the defendant acts in reliance on the proposed plea agreement. However, unlike civil contracts, there is no universally recognized principle by which the defendant can enforce the terms of a proposed agreement should the government withdraw the offer before the defendant enters a guilty plea in court. Because plea agreements are a unique hybrid of contract law and criminal procedure, it remains unclear which constitutional protections apply to them. This Note analyzes United States v. Coon, a leading federal case concerning detrimental …

The Right To Kill In Cold Blood: Does The Death Penalty Violate Human Rights, Alan Ryan Jan 2001

The Right To Kill In Cold Blood: Does The Death Penalty Violate Human Rights, Alan Ryan

Cleveland State Law Review

The essence of the argument is this: all punishment must be inflicted in cold blood; whatever damage we do to others not in cold blood is not punishment but self-defense or revenge; what we have a right to inflict in cold blood is a question of the rules of just social cooperation and especially the justice of the sanctions required to sustain those rules; it is here argued that the fundamental principle is that we may inflict whatever punishment is necessary to deter wrongdoing and not disproportionate to the offence; I do not dismiss 'pure' retribution as a goal of …

Influence Of Media And Technology: Changing Roles And Responsibilities, Terry Gilbert Jan 2001

Influence Of Media And Technology: Changing Roles And Responsibilities, Terry Gilbert

Cleveland State Law Review

High profile cases are therefore media driven. What happens in the courtroom is a reflection of the attitudes of the larger society. Such was the case then and it is the case now. From the cases of Lizzy Borden, the Lindburgh kidnapping, O.J. Simpson, and Sheppard, anyone who thinks justice is completely blind to the influences of popular opinion is blind themselves. All too often justice is a function of political culture. The courtroom is nothing but a vehicle to carry out the popular will, often with lynch mob mentality. Despite the attempts to control this phenomenon, and certainly the …

The Yugoslav Truth And Reconciliation Commission: A Shaky Start, Jelena Pejic Jan 2001

The Yugoslav Truth And Reconciliation Commission: A Shaky Start, Jelena Pejic

Fordham International Law Journal

The purpose of this Essay is to examine the establishment of the Yugoslav Truth and Reconciliation Commission and to draw some early conclusions on whether it will be capable of rendering the facts that I would so desperately like my uncle to face. The first part will deal with the need for a Truth and Reconciliation Commission, while the second part will outline and then comment on its basic documents. The assumption is that the reader is basically familiar with the work of similar commissions around the world and the text will therefore not attempt to repeat the literature on …

Part II presents country specific examples of extraterritorial legislation against the sexual exploitation of children. Part III sets forth a model of extraterritorial legislation against child sex tourism as well as non-legislative steps that countries should take in response to child sex tourism. Finally, Part III recommends changes that the United States should adopt to more effectively address child sex tourism.

The Effect Of Domestic Violence On Welfare Use, Employment And Mental Health: A Quantitative And Qualitative Analysis., Taryn Patricia Lindhorst Jan 2001

The Effect Of Domestic Violence On Welfare Use, Employment And Mental Health: A Quantitative And Qualitative Analysis., Taryn Patricia Lindhorst

LSU Historical Dissertations and Theses

This dissertation is an empirical policy analysis which investigates the effect of domestic violence on a woman's welfare status, employment, and mental health within the context of new policies instituted by welfare reform. It uses quantitative data from a panel survey, and qualitative narratives from respondents who reported current domestic abuse. Multivariate analysis of welfare outcomes finds that domestic violence affects welfare outcomes indirectly through its effect on depression. Depression is associated with unemployment, continuing on TANF, and being sanctioned off welfare. Domestic violence is one of the strongest predictors of the level of reported depression. Abuse is not directly …

Crime, Punishment And Penal Policy, Ian O'Donnell Jan 2001

Crime, Punishment And Penal Policy, Ian O'Donnell

Irish Journal of Applied Social Studies

Academic interest in crime and punishment in Ireland has grown in recent years and a number of important books have appeared (Bacik and O'Connell 1998, Brewer et al 1997, McCullagh 1996, O'Mahony 1993, O'Malley 2000). However any attempt to create a detailed understanding of the criminal justice process is frustrated by a lack of data. Statistical information is often published years in arrears, is of poor quality and is uncritically accepted as accurate and meaningful. The purpose of this paper is to give a snapshot of current understanding of the criminal justice system and to highlight a small number of …

Switzerland & The International Trade In Art & Antiquities, Michele Kunitz Jan 2001

Switzerland & The International Trade In Art & Antiquities, Michele Kunitz

Northwestern Journal of International Law & Business

Recently, Switzerland has proposed a law that would significantly tighten its regulation of the antiquities trade. The draft law seeks to comport Swiss law with the broad goals of international conventions on the protection and transfer of cultural property. However, given Switzerland's past reluctance to curtail the illicit trade in antiquities, it remains unclear whether this measure will pass or if passed, whether the law would be adequately enforced. The primary aim of this Comment is to detail the history of international law as it pertains to cultural property and draw attention to the Swiss role in fostering the illicit …

The Price Of Passion: The Banishment Of English Hooligans From Football Matches In Violation Of Fundamental Freedoms, Geoff Beckham Jan 2001

The Price Of Passion: The Banishment Of English Hooligans From Football Matches In Violation Of Fundamental Freedoms, Geoff Beckham

UC Law SF International Law Review

International football is the world's most popular team sport. As often as the global football community exults in worldwide camaraderie, its image is scarred by the inexplicably violent behavior of its supporters.

This Note examines English efforts to curb hooliganism through recently-enacted legislation. The anti-hooligan laws are analyzed in light of the protections guaranteed in the European Convention for the Protection of Human Rights and Fundamental Freedoms and the U.S. Constitution. This Note concludes that English hooligan laws violate Article 7 of the European Convention and the ex post facto clause of the U.S. Constitution.
