Evaluation Of A Jaibg-Funded Project: Emmonak Elders' Group, N. E. Schafer, Corey Knox Jul 2001

Evaluation Of A Jaibg-Funded Project: Emmonak Elders' Group, N. E. Schafer, Corey Knox

Reports

Since 1999, the Emmonak Elders' Group Project has handled certain non-felony juvenile cases in the village of Emmonak, a predominately Yup'ik community on the Yukon Delta of western Alaska. The project permits youth to remain within the community while their offenses are adjudicated through the body of elders – thus avoiding formal justice system processing which usually entails removal from the village. Youths are held accountable within the context of the local community and its traditions. This article describes the results of an initial evaluation of the program in early 2001, after the court had been in operation for approximately …

Appellate Practice And Procedure, William M. Droze, Suzanne F. Sturdivant Jul 2001

Appellate Practice And Procedure, William M. Droze, Suzanne F. Sturdivant

Mercer Law Review

In 2000 the United States Court of Appeals for the Eleventh Circuit was called upon to decide high profile and difficult issues. It helped determine the fate of young Elian Gonzalez and the course of President Bush and former Vice President Al Gore's legal battles for the presidency. Yet some of these decisions-and many others-turned on less sensational procedural questions. This Article examines the role that procedural issues have played in the court's recent opinions. It is intended to help practitioners gauge trends in the court's approach to interlocutory matters; timeliness of notice of appeal and presentation of argument; the …

State Road Fund Revenue Collection Processes: Differences And Opportunities Of Improved Efficiency, Robert J. Eger Iii, Merl M. Hackbart

Kentucky Transportation Center Research Report

Research regarding the administration and collection of road fund revenues has focused on gaining an understanding of the motivations for tax evasion, methods of evasion, and estimates of the magnitude of evasion for individual states. To our knowledge, little attention has been focused on the impact road fund collection, assessment, audit, and enforcement processes have on tax evasion. The purpose of this study is to review the current road fund assessment, collection, audit, and enforcement processes and procedures and to develop recommendations to improve the efficiency and effectiveness of the process.

Echazabal V. Chevron: A Direct Threat To Employers In The Ninth Circuit, Deborah Leigh Bender Jul 2001

Echazabal V. Chevron: A Direct Threat To Employers In The Ninth Circuit, Deborah Leigh Bender

Washington Law Review

Although Congress enacted the Americans with Disabilities Act (ADA) in part to protect disabled individuals from paternalism, the ADA permits employers to adopt a requirement that individuals not pose a direct threat to others in the workplace. The Equal Employment Opportunity Commission (EEOC) has determined that this direct threat defense also protects an employer who discharges or refuses to hire individuals who pose a direct threat to their own health or safety in the workplace. In Echazabal v. Chevron, the Ninth Circuit struck down the EEOC interpretation of direct threat on the ground that it was paternalistic and inconsistent …

Finding The Blight That's Right For California Redevelopment Law, George Lefcoe Jul 2001

Finding The Blight That's Right For California Redevelopment Law, George Lefcoe

UC Law Journal

This Article makes the case for liberalizing California's restrictive definition of blight, contending that no concept of blight can capture the salient costs and benefits of redevelopment. Present definitions of blight are failing to protect schools and counties from the fiscal drain resulting from the widespread use of tax increment financing to support redevelopment. Definitions of blight are also tangential to the underlying policy debate over whether local governments should take an active hand in shaping the urban environment by becoming land developers. This Article examines two recent cases striking down redevelopment projects for not meeting California's stringent blight standards …

Juvenile Delinquency In The Twenty-First Century: Is Blended Sentencing The Middle-Road Solution For Violent Kids?, Christian Sullivan

Northern Illinois University Law Review

This article will discuss the history of the juvenile justice system in America, from its English common law origin, through the Progressive Era of the late nineteenth century, to the 1998 revisions in Illinois. In Parts I and IV, the article will focus on current problems with the juvenile system in Illinois, highlighted in the context of a recent Illinois Supreme Court decision, In re G.O., a case in which a thirteen-year-old boy was adjudicated delinquent for first degree murder and sentenced to the Department of Corrections, without parole, until age twenty-one. In Part IV, it will point out the …

Hold All Arbitrations: Public Policy Invalidations Are On The Loose - Town Of Groton V. United Steelworkers Of America, Christina S. Lewis

Journal of Dispute Resolution

The United States Supreme Court has held that arbitration awards derived from collective bargaining agreements may be invalidated based on public policy. However, an arbitration award should only be invalidated if the public policy is explicit, well-defined, and dominant.' This article will examine how the Connecticut Supreme Court applied the public policy test and whether the court adequately justified its decision.
