This project explores the contemporary meanings and persistence of the "crime legend." A case study approach was used: three crime legends with a considerable history of public debunking were chosen. These cases were: the market in snuff films, the theft of vital organs for black-market transplant, and the abduction of children from theme park restrooms. Current versions circulating in Internet newsgroups and via electronic mail lists were collected. Discussions in Internet newsgroups were examined and twenty regular newsgroup participants were interviewed. This article examines the French court order requiring Yahoo to prevent French Internet users from accessing images of Nazi memorabilia available for auction on the company's American web site. The article uses the French case to challenge the popular belief that an entirely borderless Internet favors democratic values. The article starts from the premise that while the Internet enables actors to reach a geographically dispersed audience, the Internet should not change the accountability of those actors for their conduct within national borders. The article shows that Yahoo's extensive business in France justifies the application of France's democratically chosen law and …

Rules of criminal procedure, like all rules of legal procedure, exist to advance the goals of the corresponding substantive law. To ask whether American criminal justice - pursued through the operation of these procedural rules - is fair is to engage in a debate that has persisted since the Founding. More recently, the early twentieth century witnessed a revolution against the procedural formalism of preceding decades. Whether justified or not, the perception flourished that the legal system's dogmatic adherence to process allowed many criminals to escape punishment, and endangered society. The Georgia Bureau of Investigation (GBI) has initiated a research project that profiles the perpetrators of hostage and barricade incidents. This research is conducted using a questionnaire that is completed at incident conclusion. The questionnaire was provide .. by the FBI as part of a project called HOB AS (Hostage, Barricade, and Suicide). The HOBAS information is distributed electronically and in print to member law enforcement agencies. HOBAS information is used in this project as the main source of secondary data. The University of Louisville School of Medicine supplied an additional source of secondary data. There are 24 questionnaires that …

Once the Court granted [certiorari in Dickerson] court-watchers knew the hour had come. At long last the Court would have to either repudiate Miranda, repudiate the prophylactic-rule cases [the cases viewing Miranda's requirements as not rights protected by the Constitution, but merely "prophylactic rules"] or offer some ingenious reconciliation of the two lines of precedent. The Supreme Court of the United States, however, doesn't "have to" do anything, as the decision in Dickerson once again reminds us.

The Lautenberg Amendment to the Gun Control Act of 1968 was passed in 1996 with the purpose of preventing gun-related domestic violence. The Lautenberg Amendment's passage raises unique commerce clause issues, and the amendment is possibly unconstitutional. Part I of the article examines the Commerce Clause (and Tenth Amendment) challenges to the Lautenberg Amendment. It provides the history of cases thus far failing to successfully challenge the constitutionality of the Lautenberg Amendment. It then discusses the Supreme Court's decision in Morrison v. Olson, that struck down the civil remedies provision of the Violence Against Women Act as a violation of …

This article will consider various aspects of the U.S. legal system that affect proselytism. Although the United States has had a longstanding constitutional guarantee of the “free exercise” of religion, there are nonetheless significant constraints upon free exercise directly relating to proselytism. Some legal commentators, including Douglas Laycock, have argued that our decentralized system of government leads to insufficient protection of religious liberty, especially for religious minorities.Most case law on the subject in the United States, as well as most attempts to regulate behavior by ordinance or statute, have developed in response to groups or individuals that are outside the …

While scholars espousing ideological explanations have noted the correlation between the intellectual trends of the New Deal and International Shoe, they have not demonstrated the strength of this connection. Some merely assert that ideology caused International Shoe,12 while others point to only very general similarities between International Shoe and the ideology of the age.' 3 This Article attempts to strengthen the ideological explanation by examining closely the intellectual context of International Shoe. That examination reveals that the decision did not result simply from the expansion of interstate business or the inherent weakness of the Pennoyer system. Instead, International Shoe was …

Nurse Managers' Responses To Chemically Impaired Nurses, Dorothy Taylor Moon

The purpose of this study was to examine the attitudes of nurse managers toward chemically impaired nurses and to understand how managers respond to nurses in their charge. The research further examined whether certain demographic characteristics influenced the nurse managers' attitudes.
A descriptive research design with a probability convenience sample was used. The sample consisted of 83 nurse executives from throughout Michigan. The sample was randomly selected from the roster of the Michigan Organization of Nurse Executives (MONE). Data were obtained through a mailed survey.
Analyses of the data revealed that while managers held different attitudes and perceptions toward impaired …
