The Search For Vinland: Reconciling Literature And Archaeology, Clifford W. Anderson Apr 2001

The Search For Vinland: Reconciling Literature And Archaeology, Clifford W. Anderson

History Theses & Dissertations

It is now generally accepted that Columbus was not the first white European to have visited or attempted colonization of North America. It is also generally accepted that the only hard evidence available on the subject suggests that Norse settlers made the first attempt around 1000 CE. The term most often associated with the Norse settlement in question is "Vinland." However, several scholars are unwilling to associate Vinland with the location of the relevant archaeological find at L'Anse aux Meadows, Newfoundland. Utilizing an analysis of the two sagas that refer to the settlement and an authentication of the cartographical evidence, …

Theology, Tradition, And Turbulent Times: Ordination Of Women In The Lutheran Church, 1970, Donna L. Koch Apr 2001

Theology, Tradition, And Turbulent Times: Ordination Of Women In The Lutheran Church, 1970, Donna L. Koch

History Theses & Dissertations

Only relatively recently in the United States have women officially been able to preach, administer the sacraments, and minister fully to the spiritual needs of congregations as ordained Protestant clergy. For millions of Lutherans in the United States, 1970 was the beginning of a new era in their church when the Lutheran Church in America (LCA) and the American Lutheran Church (ALC) changed centuries of tradition and prepared the way for women to join the clergy. The third national Lutheran body, the Lutheran Church Missouri Synod (LCMS), at both its 1969 and 1971 conventions retained its conservative position, as it …

The Restatement (Third) And The Place Of Duty In Negligence Law, John C.P. Goldberg, Benjamin C. Zipursky Apr 2001

The Restatement (Third) And The Place Of Duty In Negligence Law, John C.P. Goldberg, Benjamin C. Zipursky

Vanderbilt Law Review

A prima facie case of negligence has four elements: duty, breach, causation, and injury. In plain English, a person suing for negligence alleges that the defendant owed her a duty of reasonable care and injured her by breaching that duty. Every state adheres to the four-element account,' with perhaps two exceptions. That ac- count was prominent in the various editions of Prosser's treatise, and is likewise prominent in Professor Dobbs' successor treatise. Leading casebooks also feature the four-element formula.

Given the widespread adoption of the four-element test, one would have expected to encounter it somewhere in the two drafts of …

Non-Utilitarian Negligence Norms And The Reasonable Person Standard, Steven Hetcher Apr 2001

Non-Utilitarian Negligence Norms And The Reasonable Person Standard, Steven Hetcher

Vanderbilt Law Review

Informal social norms play a crucial, albeit largely unheralded, role in negligence law. The reasonable person standard is an empty vessel that jurors fill with community norms. Jurors do this rather than performing cost-benefit analysis. The proposed Restatement (Third) of Torts: General Principles (Discussion Draft) ("Discussion Draft") misses both of these points. It dramatically overstates the role of utilitarian, cost-benefit analysis in the reasonable person standard, and it dramatically understates the role of non-utilitarian negligence norms in this standard. This Article will explore these twin failings of the Discussion Draft.

The negligence cause of action makes up the lion's share …

Lifesaving Welfare Safety Net Access For Battered Immigrant Women And Children: Accomplishments And Next Steps, Leslye Orloff

Scholarly Articles in Law Reviews & Journals

The United States is currently experiencing one of the largest waves of immigration in its history. Contrary to common assumptions, more than half of new immigrants are women. Despite this fact, U.S. immigration policy and most agencies serving immigrants have remained blind to gender differences and have treated all immigrants alike.

Perceptions Of International Students And University Personnel Of Cultural Adjustment Problems At Two Private Universities, John R. Jenkins Edd Mar 2001

Perceptions Of International Students And University Personnel Of Cultural Adjustment Problems At Two Private Universities, John R. Jenkins Edd

Dissertations

The influx of international students studying at United States colleges and universities during the past five decades has presented many challenges related to accommodating the needs of these “special” students. In the early 1950s, fewer than 40,000 international students were enrolled within the higher education system of the U.S.; today that number has grown to more than 490,000 students. The problems confronted by these students are both numerous and complex. University personnel often address these problems by developing specific programs designed to meet the needs of the international students at their university. However, the perceptions of these problems by international …
