Legal Subjects: The Tropological Construction Of "Woman" In Legal Narratives, Kate Mele

This dissertation examines the legal narrative as a contemporary discursive structure whose patriarchal operations depend upon the tropological construction of "woman." As gender categories break down, the legal narrative of the 1980s and 1990s provides a forum within which various ideological constituencies encounter, resist, and assimilate one another--in other words, where feminisms meet patriarchy. I argue that "woman" emerges as the material of production through which patriarchal ideology perpetuates itself in the legal narrative. According to Althusser, ideology operates so as to obscure its own operations. If we read his theory through the lens of rhetoricality, where the shifting ground …

The rising concern is exacerbated as the number of these students entering American schools is sharply increasing. Cultural Preservation In The Romansh Landscape: A Geography Of The Swiss -Romansh Movement., Erik George Prout

The research explores the cultural landscape of Romansh speakers in Switzerland. The fundamental question is whether small ethno-linguistic groups can create and protect a place (earthly and poetic) for their language to flourish. Swiss-Romansh have many advantages because of their political stability and economic prosperity. Their efforts in promoting and protecting the Romansh language offer a possible model for other culture groups. The research elucidates four distinct geographic scales: national (Switzerland's multilingual federalism), regional (alpine canton of Grischun/Graubunden), local Romansh villages (vinscnanca or communes), and an imaginary Rhactian ethnicity. The literature concerning language, law, and power has traditionally focused on the linguistic strategies legal professionals employ for the purpose of controlling the speech of their clients and/or witnesses. The purpose of this study was to use deep time, that is geologic time as a mechanism to explore middle school students' understanding of the natural history of the earth and the evolution of life on earth. Geologic time is a logical precursor to middle school students' understanding of biological evolution. This exploratory, mixed model study used qualitative and quantitative methods in each stage of the research to explore sixth grade students, understanding of geologic time, their worldviews (e.g., conceptual ecology), and conceptual change. Dominant explanations for why urban African American learners dropout is that these students are "at-risk" (Swanson, 1991; Sartain,1989; Levine, 1988; Macchiarola, 1988). Such explanations blame the victim while exonerating the role schooling plays in shaping students' "at-risk" conditions (Woodson, 1933/1998; Tatum, 1997; Freire, 1970/1997; Shujaa, 1994; Gordon, 1993). This research contests these explanations for why African American learners dropout by centering 10 African American students' voices to highlight the role curriculum plays at casting them at-risk. Age-related changes in discrete swallows have been well researched, but few studies have investigated sequential swallowing with little emphasis on age-related changes. It is also unclear whether the cortical representation of swallowing is lateralized to one hemisphere or is bilaterally represented. As such, the aims of this research were to examine deglutitive biomechanics of sequential straw swallowing (Experiment I), and study swallowing lateralization using a dual task paradigm in healthy, young and old adults (Experiment II). Thirty-eight right-handed men (young = 20, old = 18) were studied. Experiment I: Videofluoroscopic swallow samples of two 10-second straw drinking trials were obtained. …

Performativity And Performance: Representing The Tattooed Body., Mindy Elaine Fenske

In this study I examine visual representations of tattooed bodies in three arenas of cultural production: tattoo conventions, advertising, and neo-tribal books. Through the methodological lens of genealogies of performance, I analyze these texts' construction of the tattooed body as classed, gendered, and exotic. I argue that contemporary representations of the tattooed body resist and reproduce discursive power regimes by surrogating prior cultural performances and representations of performance. I argue that contemporary visual representations of the tattooed body succeed in resisting discursive authority when they performatively cite multiple and transgressive authorities. In Korea, efforts to teach a non-native language, such as English, to Korean students usually result in native speakers acquiring limited language abilities. As a result, the teaching of English has little effect upon making native speakers fluent in a non-native language. Both utilizing and problematizing the notions of stranger, home, journey, and self through cross-cultural inquiry, gender analysis, psychoanalysis, and autobiography, this study attempts to draw a new picture of the human self and a new vision of curriculum. It draws upon the works of three great thinkers: Michel Foucault, a French philosopher; Confucius, an ancient Chinese sage; and Julia Kristeva, a French psychoanalyst. In both In the Heart of the Country (1977) by J. M. Coetzee and The Memoirs of a Survivor (1974) by Doris Lessing, a female narrator fabricates a sanctuary—mental rather than physical—that enables each woman to challenge, deflect, or adapt to a conflict and that shelters her from a hostile, patriarchal society. For Coetzee's narrator (Magda) in In the Heart of the Country, writing, rewriting, and editing provide the necessary devices to establish her asylum in her quest for identity. Riskin's categorization of mediation has engendered much debate among academics and practitioners. Although most in the mediation community accept Riskin's positive assertion that mediation as currently practiced includes both facilitation and evaluation, a vocal group of purist critics rejects Riskin's pluralist view of mediation on normative grounds. These purist critics -- including such prominent mediator-scholars as Professors Kim Kovach, Lela Love," and Josh Stulberg -- argue that mediation is in fact, and should be, solely a facilitative process "designed to capture the parties' insights, imagination, and ideas that help them to participate in identifying and shaping their preferred outcomes." With the publication of TESOL's ESL Standards for Pre-K-12 Students in 1997, there was established a format by which to standardize English language learner progress with defined goals, standards, descriptors, and sample progress indicators. School districts throughout the United States began redesigning their curricula to address English Language Learners' needs by using the Standards. However, Intensive English Programs (IEPs) do not have a set of standards that includes their populations. Presents intelligent feedback control techniques for adaptive resource management in asynchronous, decentralized real-time systems. We propose adaptive resource management techniques that are based on feedback control theory and are designed using the intelligent control design paradigm. The controllers solve resource allocation problems that arise during run-time adaptation using the classic proportional-integral-derivative (PID) control functions and fuzzy logic. We study the performance of the controllers through simulation. The simulation results indicate that the controllers produce low missed deadline ratios and resource utilizations during high-workload situations.

This paper responds to Keith Tribe's provocative Journal of Economic Literature article, “Adam Smith: Critical Theorist?” There Tribe argued that most people most of the time grossly misread Smith, due, among other things, to their quite inadequate appreciation of Smith's linguistic, social, moral, and theological context. Against Tribe, the paper argues that Smith can profitably be read as both an eighteenth-century moralist and a twenty-first century critic. Smith can be a source of inspiration, wisdom and profundity for contemporary economists. Moreover, Smith can be successfully employed by modern economists to change, deepen, and broaden contemporary economic theory.

Translation and exile are two phenomena that marked life in the twentieth century, especially in Europe, and have therefore left their traces in French literature as well. Translation from one language to another is a heightened form of the translation process inherent in any writing. Exile in a foreign country, linguistic exile, is an aggravated form of the exile every human being experiences at some point. Until recently, early modern letters, and women's letters in particular, have been neglected as a source of information about early modern life and literary culture, although they have much to say, especially about the manuscript culture of which we now have become aware. One of the cultural changes noted in American society in the last fifty years has been a noticeable increase in the public use of sexual profanity, particularly by women. Many commentators attribute this change to the sexual revolution of the nineteen-sixties and seventies, as well as the increasing emancipation of women from traditional gender roles. This dissertation examines the ideological foundations that have shaped both western sexual attitudes and the nature of modern use of sexual profanity, to question whether these changes are indicative of greater gender equity.
