Written examinations play a key role in legal education. The LSAT is the most important factor in law school admissions. Once students enroll in law school, exams are used to evaluate and sort first year students. At most American law schools, a single, end of semester or end of year, timed, written, in class exam determines the grade in each first year class.' Although exams continue to play a major role throughout law school, once students are sorted at the end of first year it is often difficult for them to significantly change their place in the law school hierarchy. …

Reasonable care is, of course, a concept central to any torts class. But what is it? One very standard doctrinal move is to conceptualize reasonable care as that care shown by a "reasonable person" under like circumstances. The next step, logically, is to visualize this reasonable person. Visualization requires some important choices. For example, is the reasonable person old or young? Disabled or not? These are two questions that all the casebooks I have consulted discuss. But, oddly, no casebook of which I am aware deals with the trait that nearly invariably figures in our description of people: sex. If …

The purpose of the present study was to investigate whether a pre-interview training package was effective in reducing compliance to misleading questions with pre-school children and if the effects of the pre-interview training package could be generalized to interviewers other than those conducting the pre-interview training. Sixty preschool children, aged between four and five years, were randomly allocated to one of three interview conditions. The first group was given no pre-interview training (control group). In the second group, the same person administered the pre-interview training package and subsequent interview (same interviewer group). In the third group, different people conducted the …

In Thinking from the Han, David Hall and Roger Ames compare Plato's - and Confucius's views of friendship in relation to the question of transcendence and arrive at the sad conclusion that Socrates and Confucius could not be friends. "Socratic irony would not allow the inequality Confucius requires as a means of self-betterment. Confucius would not permit he and Socrates to hold all things in common." In her review essay Ending Male Privilege: Beyond the Reasonable Woman, Professor Wildman examines A Law of Her Own: The Reasonable Woman as a Measure of Man by Caroline A. Forell and Donna M. Matthews. Forell and Matthews explain the need for a reasonable woman standard, particularly in cases of sexual harassment, stalking, domestic homicide, and rape. This dissertation explores how a tribal construct of gender relations---gender complementarity---functions in the works of Zitkala-Sa (Yankton Sioux), Leslie Marmon Silko (Laguna Pueblo), Louise Erdrich (Ojibwe), and Sherman Alexie (Spokane/Coeur d'Alene). Gender complementarity, or balanced reciprocity, acknowledges that the worlds of men and women are different but not generally perceived as hierarchical. If gender roles are not seen as unequal but simply different, the resulting political relationships do not necessarily result in power struggles for equality. Examining the political ramifications of gender complementarity for women in Native American literature is approached through the historical and cultural contexts of each specific …

In 1893, Frederick Jackson Turner published his famous thesis, "The Significance of the Frontier in American History." The thesis, as well as his subsequent writings, established the groundwork for the dialogue on the American West. That groundwork essentially captured western history as the relationship between seen and unseen forces. Implicit in Turner's work was a structural model for how visible and invisible worlds interacted with one another. When one examines the work of later scholars like Henry Nash Smith who shifted away from Turner's synthesis, it becomes apparent that there was more underpinning Smith's dissent than simply a disagreement regarding …

The purpose of this study was to survey teachers at five accelerated schools in the Clark County School District to determine their perceptions of the organizational culture and properties of their respective schools, and to determine if there are any differences between the results on these surveys and the original studies; Two instruments, the Organisational Culture Assessment Inventory (OCAI) and the Structural Properties Questionnaire (SPQ), were administered in the Spring of 2001 to 277 teachers from five selected accelerated schools in the Clark County School District. This study examines how nervousness and the ideas that came to be associated with it manifest themselves in the works of F. Scott Fitzgerald, often influencing both the characters and themes in his fiction; Chapter one traces the development of what is referred to as a "nervous discourse" from the eighteenth to the early twentieth centuries, revealing how the pre-Enlightenment sense of nervous, which signified strength, gradually gave way to a meaning which indicates agitation or timidity and implies a sense of weakness. This study compared the perceptions of three groups concerning differentiated educational opportunities provided for students with gifts and talents. The perceptions of general education teachers, gifted resource room teachers, and students with gifts and talents were collected using a questionnaire that encompassed questions focused on cognitive, interpersonal, and intrapersonal skill development; Results indicated that gifted resource room teachers and general education classroom teachers perceived that they provided differentiated instruction more often in the cognitive and interpersonal domains than in the intrapersonal domain. "Holy Dwarves" And "Devil Babies": An Anthropological World-Survey Of Stigmatization Of The Disabled, Tommi Louise White

Disability exists as a human universal based upon conceptual categorizations. Positive and negative forms of stigmatization exist cross-culturally, and are examined in a world-survey format in terms of emic socio-cultural level, subsistence economy, and religion. I suggest that responses to disability are cultural specific, and that these individualized responses are filtered through cultural perceptions of reality and transformed into various treatment strategies of care, euthanasia, and abandonment, in addition to common discriminatory customs, such as limitations on marriage eligibility.

Following the guidelines of journalistic integrity, media coverage of presidential elections should be fair and unbiased. This study examined the newspaper media coverage of George W. Bush and Al Gore, the two major presidential candidates in the 2000 election. This study examined all issues of the Las Vegas Review-Journal, Las Vegas Sun and the Reno Gazette-Journal during the 65-day time frame from Labor Day to Election Day 2000. Specifically, this investigation examined the effects of a distributed practice schedule on speech productions in young children and adults. On Inaugural Day, President George W. Bush faced an unusually hostile audience. To reunite the nation, President Bush reached back to Americans' fundamental archetypal images, featuring the American founding myth. However, this reunification process was not complete until his speeches of September 14 and 20, 2001. Through his rhetorical transformation of worldwide terrorism into Evil, Bush reconstructed a broadly accepted image of America as Good and concurrently legitimated his ascendancy to the Presidency. This study examined whether groups of adolescent girls, who society defines as having a positive body image, actually feel positive about their own body image and how they express it culturally. Cheerleaders and dancers were chosen as accessible groups that embodied the ideal body image as defined by popular Western teen culture. Qualitative analysis was conducted using interviews, observations, and focus groups to determine how these groups felt about their body image and how they defined a positive image. Measurement of working memory span typically involves tasks designed to introduce stimuli to the unique slave systems. It is widely accepted that these isolated measurements indicate, at a relatively simple level, the span of the given working memory system. This study hypothesizes that separate working memory systems can be combined to enhance span length. To evaluate this hypothesis, the Corsi Block Task, a commonly used measure of spatial working memory, will be altered to include verbal information (colors).
