Unlike the personal journal which involves private communication, dialogue journal evolves from the authenticity of partners, typically the teacher and student, engaging in an extended two-way written interaction in which there is real exchange of information. The deviations in these varieties are seen in a negative light and therefore the non-native varieties are considered inferior to Standard British English. If that is the case, the question arises …

Does Law Promise Justice?, Jeremy Waldron Jan 2001

Does Law Promise Justice?, Jeremy Waldron

Faculty Articles

"Justice being taken away, then, what are kingdoms but great robberies?" The philosophy of law has long been dominated by a disagreement between those who say, with St. Augustine, "that an unjust law is no law at all," and those who respond, with John Austin, that "[t]he existence of law is one thing; its merit or demerit is another." Against the latter camp - that is, against those who insist on a comprehensive separability of law and morality and, accordingly, on the contingency of any connection between positive law and justice-Philip Selznick, an eminent sociologist of law and a former …

World Languages and Literatures Faculty Publications and Presentations

Decisionmaking At The End Of Life: Patients With Alzheimer's Or Other Dementias, Leslie P. Francis

Georgia Law Review

Patients with dementia present difficult issues for health-care decisionmaking. This article addresses the moral and legal issues posed by end of life decisionmaking for such patients. In general, the ethical goals of care are to assure that patients' choices are respected and that patients' best interests are protected. These goals may not always recommend the same decisions about care, however, and there is controversy about how they should be balanced when they conflict. In addition, the law may not always further these goals, nor be as helpful as it could be in resolving conflicts between them. In the bioethics literature, …
