Bankruptcy, Just For The Rich? An Analysis Of Popular Fee Arrangements For Pre-Petition Legal Fees And A Call To Amend, Kerry H. Ducey

Vanderbilt Law Review

The scenario is typical. An individual sits amid a pile of overdue bills. He calculates and recalculates only to verify what he has already suspected-his debt far exceeds his monthly income. Meanwhile, creditors and collection agencies demand payment while threatening repossession and other legal action. With no ready source of additional income, the debtor ultimately decides to file for bankruptcy. He consults an attorney, and the two agree to file a consumer no-asset Chapter 7 bankruptcy petition.' The lawyer then promises to use her best efforts to secure relief for the debtor. All she needs is a retainer. A retainer? …

Japan's New Patent Attorney Law Breaches Barrier Between The "Legal" And "Quasi-Legal" Professions: Integrity Of Japanese Patent Practice At Risk?, Lee Rousso May 2001

Japan's New Patent Attorney Law Breaches Barrier Between The "Legal" And "Quasi-Legal" Professions: Integrity Of Japanese Patent Practice At Risk?, Lee Rousso

Washington International Law Journal

In order to increase the quantity of intellectual property related legal services made available to the public, the Japanese Diet enacted a complete revision of Japan's eighty-year-old Patent Attorney Law. Under the terms of the new law, which became effective on January 6, 2001, benrishi (patent attorneys) have authority to greatly expand their range of professional activities. The newly recognized activities encroach upon the statutory monopoly long enjoyed by Japan's bengoshi (attorneys). Furthermore, the new legislation gives the benrishi a professional domain that is inconsistent with the profession's credential requirements. This Comment argues that the revision is likely to have …

Legal Accountability In An Era Of Privatized Welfare, Michele E. Gilman May 2001

Legal Accountability In An Era Of Privatized Welfare, Michele E. Gilman

All Faculty Scholarship

When the federal welfare system was reformed in 1996, Congress devolved much of the authority over welfare delivery to the states and gave them the option of contracting out administration of their programs to private entities. Moreover, after welfare reform, enacted as the Personal Responsibility and Work Opportunity Reconciliation Act (PRA), welfare recipients are expected to work to receive benefits. This means that front-line workers must engage in intensive interpersonal counseling rather than simply confirm objective eligibility criteria and dispense checks. As a result, front-line workers have vastly increased discretion. When privatization is layered over this discretionary scheme, issues of …

A Survey Of Public Librarians' Attitudes Toward The Marketing Of Library Services, Jon C. Parker

Theses and Dissertations

The purpose of this study was to identify attitudes of public librarians toward the marketing of library services, and relate these attitudes to selected independent variables. A questionnaire was developed and mailed to 1198 individual members of the New Jersey Library Association. Usable responses were received from 415 public librarians. The results were analyzed using various statistical techniques, including correlations and analysis of variance (ANOVA). Although most of the respondents had generally positive attitudes toward library marketing, there were some statistically significant differences between subgroups. For example, more positive attitudes toward marketing were expressed by library administrators, librarians who had …

The study focused on whether the needs of homeschool educators from the Atlantic County area of New Jersey were being met and what other public library services could be offered to them. The number of parents reported as homeschooling their children is growing. Larger and larger numbers of homeschoolers may be relying on the public library for some of or all of their curriculum needs. By conducting a survey of the needs of homeschool educators, public librarians may …

Symposium Article - The Incompleteness Of The Model Rules And The Development Of Professional Standards, Nathan M. Crystal

Mercer Law Review

Rules and standards of professional conduct are proliferating. In November 2000, the American Bar Association's ("ABA's") Ethics 2000 Commission released its final report recommending changes in the ABA's Model Rules of Professional Conduct. Earlier in the year the American Law Institute ("ALI") issued its long awaited Restatement of the Law Governing Lawyers.

The Model Rules and the Restatement are similar in two respects. Both contain detailed rules and both are comprehensive, covering relationships between lawyers and their clients, the courts, and third parties. Standards prepared by other organizations, however, have taken a narrower approach. Some have focused on particular activities …

The Best Laid Plans: How Unrestrained Arbitration Decisions Have Corrupted The Uniform Domain Name Dispute Resolution Policy, Ian L. Stewart May 2001

The Best Laid Plans: How Unrestrained Arbitration Decisions Have Corrupted The Uniform Domain Name Dispute Resolution Policy, Ian L. Stewart

Federal Communications Law Journal

In the rapidly changing Internet age, a sound dispute resolution policy is needed to address conflict where traditional rights intersect emerging technologies. This Note examines how unfettered arbitration decisions, even those made with the best of intentions, can corrupt a good dispute resolution policy, as is the case with the Uniform Domain Name Dispute Resolution Policy. The Note provides background information on ICANN, domain disputes regarding cybersquatting and reverse domain hijacking, and the Policy. It then explains how ICANN’s dispute resolution providers’ expansive decisions have weakened the Policy by removing the internal limitations that made it strong and effective. Finally, …

Resolving The Mdp Issue: Deciding If The Status Quo Is What's Best For The Client, Julia J. Hall

Mercer Law Review

On the forefront of the current debate surrounding legal ethics is the heated question of whether the legal profession should permit its members to participate in multidisciplinary practices or partnerships ("MDPs") and thereby share fees with nonlawyers. Currently, this conduct is prohibited by the Model Rules of Professional Conduct. This issue clearly has global implications for various professions desiring to partner with attorneys, and those persons with interest in this area have followed the debate closely as viewpoints are researched and expressed in support of one position over another. Nonetheless, the American Bar Association ("ABA") has effectively closed the door …

Sales And Use Taxes In Clark County And Potential Implications Of The Internet Sales Tax Moratorium, Patrick Timothy Collins Smith

UNLV Theses, Dissertations, Professional Papers, and Capstones

Sales taxes have been a much-depended on source of revenue for local governments since the early part of the 1900’s. Southern Nevada local governments rely relatively heavily on sales and use taxes for a source of income. In 1998, the United States Congress passed an Act that imposed a moratorium on Internet sales tax collection until October 2001. With the explosive growth in Internet sales, the issue of the failed collection of an Internet sales tax has come to the forefront of local government finance discussions.

Averting Mistaken Executions By Adopting The Model Penal Code's Exclusion Of Death In The Presence Of Lingering Doubt, Margery Malkin Koosed May 2001

Averting Mistaken Executions By Adopting The Model Penal Code's Exclusion Of Death In The Presence Of Lingering Doubt, Margery Malkin Koosed

Northern Illinois University Law Review

This article urges adopting the Model Penal Code's exclusion of the death penalty when the evidence does not foreclose all doubt respecting the defendant's guilt. Adopting a modified version of the Code's section 210.6(1)(f) would both save innocent lives and lessen burdens on our justice system. While the trial jury may convict on proof beyond a reasonable doubt of capital murder, the case would not proceed to a penalty phase unless jurors found the elements proven by a stronger standard. Illinois is now reevaluating its system of capital punishment, desperately seeking means of averting the execution of innocents. That real …

Digital Transmission : An Innovative Strategy To Improve Quality In Education., Vijaya Gururajan

Australian Journal of Teacher Education

In 2000 the Australian government, recognising the need for educational equality for Australian Indigenous people has commissioned a taskforce to identify various factors affecting Indigenous Education. One of the factors identified by the task force included the need for strategies to deliver quality education to various Indigenous communities. Research studies conducted on the delivery of education highlight the importance of the Internet for the flexible delivery of education. However, government reports indicate that Australian Indigenous communities have problems in utilising this technology for reasons such as access, infrastructure, training, etc. Therefore a new model based on the recently introduced digital …
