Cow Longevity, Alvaro Garcia Jul 2001

Cow Longevity, Alvaro Garcia

SDSU Extension Extra Archives

Making sure profitable cows continue to be profitable beyond their second lactation should have a positive economic impact on the net returns of a dairy farm. The rationale behind this statement is that rearing, fixed, and variable costs are spread over three or more lactations. Longevity has been defined as the ability for a cow to delay involuntary culling or to survive to 48 months of age. Productive life could thus be defined as the number of lactations a cow completes, or is expected to complete (death is usually unexpected!), prior to culling. The economic advantage of retaining a profitable …

A Military For The 21st Century: Lessons From The Recent Past, Anthony C. Zinni Jul 2001

A Military For The 21st Century: Lessons From The Recent Past, Anthony C. Zinni

Strategic Forums

This paper looks at how U.S. military operations have changed since the Cold War and what those experiences suggest for the future. Drawing on recent missions, Zinni shows that the operating environment has become more complex, not less, with forces expected to handle everything from major conflicts to peacekeeping and humanitarian crises. The paper highlights the growing importance of adaptability, joint operations, and readiness across a wide range of scenarios. It also emphasizes the need to better align force structure, training, and strategy with these evolving demands. It argues for a military that is flexible, responsive, and prepared to operate …

The Declaration Of Independence: A 225th Anniversary Re-Interpretation, Carlton F.W. Larson Jul 2001

The Declaration Of Independence: A 225th Anniversary Re-Interpretation, Carlton F.W. Larson

Washington Law Review

The importance of the Declaration of Independence to American law has been obscured by dubious associations with natural rights jurisprudence. Legal scholars have therefore overlooked the numerous ways in which the Declaration is relevant to a host of legal issues. Ample textual and historical evidence demonstrates that the Declaration, not the Articles of Confederation or the Constitution, legally constituted the United States of America as a distinct nation in the world community. The Declaration was not the act of thirteen states declaring their individual independence, but the act of one American people announcing the birth of an American nation. Nor …

Can Students Sue When Schools Don't Make The Grade? The Washington Assessment Of Student Learning And Educational Malpractice, Rebecca R. Glasgow Jul 2001

Can Students Sue When Schools Don't Make The Grade? The Washington Assessment Of Student Learning And Educational Malpractice, Rebecca R. Glasgow

Washington Law Review

Washington's Academic Achievement and Accountability Statute (AAA Statute) creates a statewide system of school accountability. It also requires that all students pass the tenth-grade level of the Washington Assessment of Student Learning standardized test (WASL) to receive a diploma. Unfortunately, when this graduation requirement takes effect in 2008, many students will not receive diplomas because they will be unable to pass the WASL before graduation. Some of these students will have met all local graduation requirements, so the only graduation requirement they will not be able to meet will be the statewide requirement that they pass the WASL. Their WASL …

Truth Or Consequences: Why The Rejection Of The Pretext Plus Approach To Employment Discrimination Cases In Reeves V. Sanderson Plumbing Establishes The Better Legal Rule, Marcia L. Mccormick Jul 2001

Truth Or Consequences: Why The Rejection Of The Pretext Plus Approach To Employment Discrimination Cases In Reeves V. Sanderson Plumbing Establishes The Better Legal Rule, Marcia L. Mccormick

Northern Illinois University Law Review

There is a constant tension in employment discrimination law between the recognition that discrimination can be subtle without having direct evidence of its existence and the recognition that under the law, hard evidence is necessary to prove an ultimate fact by a preponderance of the evidence. It was this tension that prompted the Supreme Court to devise a method of proof for employment discrimination cases that differs from the usual civil case. In employment discrimination cases, the plaintiff must first prove a "prima facie" case of discrimination by proving: 1) that he or she is a member of a class …

Army Transformation: A View From The U.S. Army War College, Williamson Murray Dr.

Books, Monographs & Collaborative Studies

The U.S. Army is now in the process of transforming itself to meet security interests and the need for land power that span the globe, now and in the future. The following essays are representative of current thinking at the U.S. Army War College by students considering the nature and direction of this transformation. Dr. Williamson Murray s introduction sets the historical context for military transformation, comparing the modern European example with recent U.S. efforts in military innovation. The remaining essays address four themes: the nature of the transformed Army, building irreversible momentum for transformation, improving strategic responsiveness, and how …

The Power Of Apology And The Process Of Historical Reconciliation, Robert R. Weyeneth Jul 2001

The Power Of Apology And The Process Of Historical Reconciliation, Robert R. Weyeneth

Faculty Publications

The article analyzes one of the ways that history makes the headlines today: in discussions of whether the present can--and should--apologize for the past. It examines this recent phenomenon by asking if historical apologies have the ability to facilitate a process of historical reconciliation. In its first three sections, the article explores the range and forms of apologies reported in the press during the last decade or so, the motives and goals of apologists, and the reasoning of those with misgivings about the utility and wisdom of apologies. A fourth section assesses the efficacy of historical apologies. Is an apology …

Organic Grapes And Wine : A Guide To Production, Gerry Parlevliet, Steven Mccoy Jul 2001

Organic Grapes And Wine : A Guide To Production, Gerry Parlevliet, Steven Mccoy

Bulletins 4000 -

The tastebuds, health concerns and environmental conscience of affluent consumers are demanding more organically grown food than producers worldwide can supply. Growing consumer concerns about the effects of synthetic chemical pesticides and fertilisers on human health and the environment have boosted world trade in organic products by a rate of about 20-30 per cent a year for the past 10 years. World trade was estimated to be worth $US 21.6 billion in 2000 and is expected to reach US$100 billion by the year 2006.

The Australian market for organic products alone is valued at $200-$250 million - with exports estimated …

Predictably Incoherent Judgments, Cass R. Sunstein, Daniel Kahneman, David Schkade, Ilana Ritov Jul 2001

Predictably Incoherent Judgments, Cass R. Sunstein, Daniel Kahneman, David Schkade, Ilana Ritov

Coase-Sandor Institute for Law & Economics Research Paper Series

When people make moral or legal judgments in isolation, they produce a pattern of outcomes that they would themselves reject, if only they could see that pattern as a whole. A major reason is that human thinking is category-bound. When people see a case in isolation, they spontaneously compare it to other cases that are mainly drawn from the same category of harms. When people are required to compare cases that involve different kinds of harms, judgments that appear sensible when the problems are considered separately often appear incoherent and arbitrary in the broader context. Another major source of incoherence …

Arbitral Discovery Of Non-Parties, Jason F. Darnall, Richard Bales Jul 2001

Arbitral Discovery Of Non-Parties, Jason F. Darnall, Richard Bales

Journal of Dispute Resolution

This article argues that the broad power approach is the better reasoned of the two. Timely discovery of important information is vital in any dispute. Further, fair results should be the goal of any dispute resolution process. The possessor of the pertinent information, i.e., whether it is held by parties or non-parties, should be irrelevant. Part II of this article describes the differences between discovery in litigation and discovery in arbitration. Part III examines the limited power approach to prehearing discovery, which restricts the power of an arbitrator to compel non-party participation in discovery to the actual hearing. Part IV …
