Recent developments in environmental law in Virginia continue to reflect several trends. These trends may be grouped into six general categories: (1) the growing tension between federal environmental mandates and their practical implementation through delegated state programs; (2) the continuing debate over the exact definition of "interstate commerce" and the scope of state authority to regulate in the gray area; (3) the impending deregulation of the electrical energy market; (4) the promotion of sustainable development; (5) the developing schism between state and local land use control; and (6) the evolving nature of administrative law in the environmental context. Annual Survey Of Virginia Law: Labor And Employment Law, Thomas M. Winn Iii

This article discusses six areas of labor and employment law in which there was significant activity in Virginia's courts over the past year: (1) covenants not to compete and employee's fiduciary duties to employers; (2) the doctrine of respondeat superior; (3) negligent hiring, retention, and supervision; (4) wrongful discharge in violation of public policy; (5) workers' compensation exclusivity; and (6) employment agreements. Beyond the scope of this article are decisions rendered in other areas of law that affect the employment relationship, including defamation, claims under Virginia's Occupational Safety and Health Act, public employment claims, and unemployment compensation claims.

Perceptions Of Nonconforming Sexualities And Genders On Television Talk Shows, Violeta Oliver

GLBTQ (Gay, Lesbian, Bisexual, Transgendered, Queer/Questioning) people often appear as guests on daytime television talk shows. Using cultivation analysis, the author explored television talk show viewers' perceived realism of television talk shows and GLBTQ people. This quantitative study tested seven hypotheses. Support was found for the first two hypotheses, indicating that heavy viewers of television talk shows perceived television talk shows to be more realistic or true to life than light viewers. The Effect Of Anaerobic Exercise On The Thermic Effect Of Food, Charlene Marie Denzer

The thermic effect of food (TEF) is the increment in energy expenditure above resting metabolic rate associated with the cost of absorption, metabolism, and storage of food. Previous studies have shown that TEF is enhanced by aerobic exercise. The purpose of this study was to determine if a similar effect occurs with anaerobic exercise (weight lifting). VO2 was measured after ingestion of a 660 kcal meal with and without prior completion of a weight-training regimen. TEF was 42% higher after the exercise trial (t = 2.539, p < .017), compared with the control trial. These results indicate that prior anaerobic exercise also leads to an enhanced TEF.

Modeling Of Hand-Arm-Glove Vibration System And Testing And Evaluating Of Antivibration Gloves, Jianying Cui

Work-related hand-arm disorders (HAVS) caused by exposure to vibration while operating vibrational tools were discussed; no clear dose-effect relationship between vibration exposure and HAVS was found yet. Ways to avoid or delay harmful impact on workers were explored, one means of which is using antivibration gloves during operation. Four types of antivibration gloves were tested per standard ISO 10819, test setup and procedures were presented. Two models of hand-arm-glove system were developed and analyzed; the models were used for predicting the gloves' transmissibility before carrying out actual tests. Algal bioassays were conducted to determine algal growth potential (AGP) and nutrient limitation of the Las Vegas (LV) Bay of Lake Mead using the standard test organism Selenastrum capricornutum and the Lake phytoplankton. Results for the current nutrient levels in the LV Bay revealed that the AGP of the LV Bay waters, measured by the maximum specific growth rates is limited by phosphorus (P). Both the growth rates and the biomass content indicated the LV Bay is P-limited. Bioassay results, using higher nitrogen (N) and phosphorus levels, showed that increasing the N and P of the Bay concentrations to levels …

The Value Relevance And Reliability Of Brand Assets Recognized By Uk Firms, Sanjay Kallapur, Sabrina Kwan

We examine the value relevance and reliability of brand assets recognized by 33 UK firms, and the stock price reaction to the announcement of brand capitalization. We find that brand assets are value relevant, i.e., associated with market values. However, the market capitalization rates of brands of firms with low contracting incentives—firms with no transactions that avoided the London Stock Exchange (LSE) rule requiring shareholder approval for acquisitions/disposals, and firms with industry-adjusted leverage below the sample median—are higher than those of firms with high contracting incentives. Objective: This paper addresses the following statistical question: ‘if genuine improvements in cardiopulmonary resuscitation (CPR) were discovered that doubled the probability of resuscitation success in a series of randomized clinical trials, would they be recognized and incorporated into consensus guidelines?’ Methods: Statistical powers for hypothetical individual clinical trials comparing experimental and control CPR were computed as a function of the study N when the true probabilities for immediate survival, 24 h survival, and discharge survival in the experimental group were twice those in the control group. To better understand the risk and safety of heading a soccer ball, the author created a set of simple mathematical models based upon Newton’s second law of motion to describe the physics of heading. These models describe the player, the ball, the flight of the ball before impact, the motion of the head and ball during impact, and the effects of all of these upon the intensity and the duration of acceleration of the head. This Note will discuss the unconstitutionality of the MDR initiative. Part II will describe the implementation of MDR procedures currently in place. Part III will discuss the necessity of a protected interest in a due process analysis, how Goldberg defined the protected interest and how it has changed since the implementation of PRWORA. A P index was developed as a tool to rank agricultural fields on the basis of P loss vulnerability, helping to target remedial P management options within watersheds. We evaluated two approaches, a soil P threshold and components of a P index, by comparing site vulnerability estimates derived from these two approaches with measured runoff P losses in an agricultural watershed in Pennsylvania. Rainfall–surface runoff simulations (70 mm h-1 for 30 min) were conducted on 57 sites representing the full range of soil P concentrations and management conditions found in the watershed. Bemisia tabaci was described over 100 years ago and has since become one of the most important pests worldwide in subtropical and tropical agriculture as well as in greenhouse production systems. It adapts easily to new host plants and geographical regions and has now been reported from all global continents except Antarctica. In the last decade, international transport of plant material and people have contributed to geographical spread. B. tabaci has been recorded from more than 600 plant species and there may be many additional hosts not yet formally documented. Biotypes have been identified in different areas of the world …
