Justice Under Siege: The Rule Of Law And Judicial Subservience In Kenya, Makau Wa Mutua

The piece examines the tortured history of the judiciary in Kenya and concludes that various governments have deliberately robbed judges of judicial independence. As such, the judiciary has become part and parcel of the culture of impunity and corruption. This was particularly under the one party state, although nothing really changed with the introduction of a more open political system. The article argues that judicial subservience is one of the major reasons that state despotism continues to go unchallenged. It concludes by underlining the critical role that the judiciary has to play in a democratic polity.

The "feminization of poverty" concept should be retired, if it has not already been so. It should be retired, even though the concept has been extremely powerful as a discursive construct. In a phrase, the idea captured a seemingly universal phenomenon, inspired theoretical research into the nexus between women and poverty, and summoned coalitions of women by marking an agenda for, and among, women across the boundaries of race, ethnicity, and nationality. Artificial neutral networks (ANN) can be used as an online health monitoring systems (involving damage assessment, fatigue monitoring and delamination detection) for composite structures owing to their inherent fast computing speeds, parallel processing and ability to learn and adapt to the experimental data. The amount of impact-induced strain on a composite structure can be found using strain sensors attached to composite structures. Prior work has shown that strain-based ANN can characterize impact energy on composite plates and that strain signatures can be associated with damage types and severity. Ninety-five percent of consumer goods used in the United States reach the markets by way of vessel transport. Each of these vessels carries ballast water, and with it, exotic organisms from ports around the world that can threaten native ecosystems.

A survey (n=10) conducted to gather perceptions on existing ballast water legislation shows that those state and federal agencies who are involved agree on certain aspects of the issue, but there are broad areas of dissent regarding other aspects. Cognitive Differences In Chart Reading: A Comparison Of Nurses And Physicians, Todd R. Johnson, Vimla L. Patel, James P. Turley

This pilot study compares the mental models of a patient constructed by nurses and physicians while reading an electronic medical record. Preliminary results suggest that the participants' summaries were both quantitatively and qualitatively different. The physician made more inferences and focused on deeper relationships in the record, whereas the nurse focused on the descriptive surface structure of the record.

Objective: Self-report of medication adherence is commonly used in research studies, but the information is lacking about the sensitivity, specificity, reliability and clinical validity of this method. The purpose of this study was to test the sensitivity, specificity and reliability of several methods for accessing medication compliance using patient self-report of adherence. The Medication Event Monitoring System (MEMS) was used as a standard against which self-report measures were compared.

As the environmental technology aspects of hazardous waste remediation projects are becoming more innovative, the occupational health and safety aspects associated with these projects have not kept pace. This study was designed to examine a single, long-term remediation project's experiences with this dilemma. Although the project employed a number of traditional strategies to abate occupational health and safety hazards through most of its course, innovations concerning chemical protective clothing, air monitoring/sampling equipment, and the management of physical hazards at the last and perhaps most dangerous site lead to some interesting results. Numerous studies have underscored the strong contributions families make to their children's academic achievement (e.g., Christenson & Buerkle, 1999; Conoley, 1987; Henderson & Berla, 1994). The purpose of the study was to examine the influence of parental involvement and the relationship between family-process and status variables and their impact on student academic achievement. Results indicated when parents and schools establish collaborations and work in conjunction to encourage learning, student academic achievement is enhanced. The present study investigated the relationship between competitive state anxiety and athletic performance in female volleyball players. The sample consisted of two volleyball teams (N = 13) with a mean age of 15.54 years (SD = 0.66). Participants included 16 year olds and younger in the Amateur Athletic Union (AAU) volleyball tournament. Thirty minutes prior to the volleyball competition, all subjects were administered the modified Competitive State Anxiety Inventory-2 (CSAI2) (Martens et al., 1990). The findings revealed no significant relationship between competitive state anxiety intensity or interpretation and player's performance. In the United States the top four causes of death in 1998, each lifestyle-related, were (1) heart disease - 724,859 deaths, (2) cancer - 541,532, (3) stroke - 158,448, and (4) chronic obstructive pulmonary disease - 112,584, as reported by the Centers for Disease Control and Prevention (CDC, 2001 ). A literature-based language arts program provides meaningful experiences for children within the functions of language. Such programs can be extended across the curriculum to utilize the functions in other areas. These connections across the curriculum can be enhanced through the different genres of literature.

In this article, a literature base was integrated into the science area of the curriculum. A science unit on pumpkins was developed for first grade children with quality literature and related expressive activities that extended the children's literacy and their understanding of plants. Teacher-directed activities were presented along with learning centers.

The principalship is a collection of contradictory roles and responsibilities that requires knowledge and skills in many diverse areas. Paul Houston's (2001) description of society's expectations for a superintendent applies to the expectations for a principal as well: "The job is impossible because the expectations are unrealistic. We want one individual to be all and know all in a complex system" (p. 432). The Fate Of The Native Hawaiians: The Special Relationship Doctrine, The Problem Of Strict Scrutiny, And Other Issues Raised By Rice V. Cayetano, William E. Spruill

Harold "Freddy" Rice is a Native Hawaiian in the sense that he was born in the Hawaiian Islands and can "trace[ ] his ancestry to two members of the legislature of the Kingdom of Hawaii, prior to the Revolution of 1893. " He is a taxpayer and a qualified elector of the United States, the State of Hawaii, and the County of Hawaii. When Rice applied to vote in the 1996 election for the trustees of the Office of Hawaiian Affairs ("OHA"), however, his application was denied. Why? Because, according to a state statute, he was not Hawaiian enough.
