Reconstructing First Amendment Doctrine: The 1990s (R)Evolution Of The Central Hudson And O'Brien Tests, Susan Dente Ross

In this article, the Supreme Court's shifting and expanding approach to intermediate scrutiny of commercial free speech under the First Amendment is examined. The author maintains that the Supreme Court has increased the level of review for content-neutral laws regulating commercial speech, while decreasing the level of review of laws affecting the media. The author argues that these analytical shifts have eroded First Amendment protection for the media, replacing the traditional notion that the media is central to a functioning democracy with the view that the press is simply a powerful, commercial enterprise. This paper critically analyzes the de facto control over the Domain Name System currently administered by the not-for-profit organization, Internet Corporation for Assigned Names and Numbers ("ICANN"). Specifically, the author addresses the concerns of how ICANN fails to lead in the direction of appropriate Internet governance, and how it directs the Domain Name Registration ("DNR") industry to focus more upon economics, rather than engaging in legitimate issues surrounding trademark disputes created by the DNR.

Avec cette dissémination des résultats de l’Analyse Situationnelle (AS) de 1998 le Ministère de la Santé réalise la troisième activité de ce genre. Au sortir de la dissémination, plusieurs enseignements sont tirés: Une bonne préparation de l’activité est nécessaire et, dans ce sens, la place de l’atelier de planification et l’établissement concerté d’un calendrier des activités par les niveaux national et régional sont prépondérants. Effects Of Epilimnetic Versus Metalimnetic Fertilization On The Phytoplankton And Periphyton Of A Mountain Lake With A Deep Chlorophyll Maxima, Wayne A. Wurtsbaugh, H. P. Gross, Phaedra E. Budy, Chris Luecke

Nutrients can load directly to either the epilimnion or metalimnion of lakes via either differential inflow depths of tributaries or intentional fertilization of discrete strata. We evaluated the differential effects of epilimnetic versus metalimnetic nutrient loading using 17-m-deep mesocosms that extended into the deep chlorophyll layer of oligotrophic Pettit Lake in the Sawtooth Mountains of Idaho. Addition of nitrogen plus phosphorus stimulated primary production nearly identically (2.4- to 4-fold on different dates) in both treatments, with the production peaks occurring in the strata where nutrients were added. The metalimnetic fertilization, however, resulted in equal or greater stimulation of chlorophyll a …

The summer drenching program has provided highly effective sheep worm control in Western Australia for many years - but recent research challenges its long term sustainability.

Trial results suggest that in large parts of the State, summer drenching is the main factor leading to the development of drench resistant worms. Alternative programs less likely to lead to drench resistance will require greater monitoring of worm burdens and panning pasture moves.

Pastoralists and rangeland bureaucracies are now required to operate within the limits of ecological sustainability. However, while the concept of ecological sustainability has been enshrined in law and policy at State and Commonwealth levels in Australia, there has been little translation into pastoral management objectives. The introduction of the 'EMU (Ecosystem Management Unit) process', as an equal partnership between ecologists and pastoralists, promises to bring pastoralists into close dialogue with the landscapes they manage on their stations, and to acknowledge and manage for values other than pasture production. Developments in medical research have been occurring at a rapidly increasing rate during the past two decades. Expanding budgets, augmented computer capabilities, and new research tools have all dramatically enhanced research technology. Accompanying the proliferation of medical research are increasing concerns about research risks. This article focuses on placebo-controlled clinical trials. The use of placebos enables clinical investigators to compare results from subjects taking an experimental intervention to results from a group that is receiving an inactive substance, such as a sugar pill, in order to determine the efficacy of the new medication. This Study, the fourteenth in a series, tabulates and analyzes the voting behavior of the United States Supreme Court during the 1999 Term. The analysis is designed to determine whether individual Justices and the Court as a whole are voting more "conservatively," more "liberally," or about the same as compared with past Terms. This Term's survey suggests a reversal of the Court's liberal trend over the past two Terms, with conservative movement in six of the ten categories. Specifically, the Court's support of statutory civil rights claims plummeted to an all time low, while the Court exhibited a dramatic conservative …

It is widely recognized that the purpose of education is not merely to develop in students a narrow set of skills. Rather, education should prepare all students to assume roles in actively shaping our democracy. Racial segregation and economic isolation in schools prevent the attainment of full and meaningful citizenship rights for students of color and low-income students in that they deny fair access to educational opportunities and other structures crucial to democratic participation. Throughout the US, school systems that once faced federally-mandated desegregation plans have been declared "unitary" - that is, courts ruled that these districts have removed any vestiges of overt segregation and therefore need not adhere to previous integration mandates. In Denver, Colorado, after busing students for over 20 years, federal courts declared the city school system unitary in 1996. In Denver the return to neighborhood schools has meant a concurrent return to more racially segregated schools. Given the strong correlation between race/ethnicity and socioeconomic status in US urban centers, the return to neighborhood schools has created conditions of concentrated poverty …

Despite the title, this Note does not attempt to articulate a defense of sexually explicit speech. Rather, the effort here is to expose current inconsistencies in First Amendment speech doctrine and to argue that those inconsistencies are the result of the excessive, if not wholly improper, weight given to majoritarian morality when evaluating the regulation of non-obscence sexually explicit speech. Thus, this Note will argue that the Supreme Court's treatment of non-obscene sexually explicit speech in the form of licensing, zoning and nudity regulations has weakened the scrutiny applied to all speech regulations.
