UF Law Faculty Publications

In the early 1990s, Delaware replaced New York as the jurisdiction of choice for the bankruptcy reorganization of large, public companies. In an empirical study of 188 companies emerging from bankruptcy reorganization from 1983 through 1996, the authors found that the refiling rates for public companies reorganized in Delaware and New York were about five to seven times the refiling rates for companies reorganized in other courts. Nine of the thirty large, public companies emerging in Delaware from 1991 to 1996 (30%) have already refiled. New York rates were higher during the period of New York's dominance than during the …

On Becoming The Other: Cubans, Castro, And Elian -- A Latcritical Analysis, Berta E. Hernández-Truyol

UF Law Faculty Publications

It is difficult to imagine that a cute, little, six-year-old boy would be able to change the favorable socially constructed images of cubanas/os virtually overnight. But that is precisely what happened with Elian and the comunidad cubana en Miami en estos estados unidos. The story is sad and poignant, heart-wrenching and surreal, human and political, civil and social, cultural and economic. It reaches into the souls of all who have fought and lost after having thought that they had fought and won.

This essay explores the transformation of the Cuban community in the eyes of the estado unidense majority …

The Accidental Crit Ii: Culture And The Looking Glass Of Exile, Pedro A. Malavet Jan 2001

The Accidental Crit Ii: Culture And The Looking Glass Of Exile, Pedro A. Malavet

UF Law Faculty Publications

The current "Latin Music Craze" in United States mass media demands critical analysis from the LatCrit community. LatCrit scholars have engaged in the serious discussion of cultural production—of culture generally and popular culture in particular. LatCrit theory has analyzed cultural production mostly by "others," that is, cultural production internal to outsider communities. LatCritters also have studied how United States mass media portrays Latinas/os, African-Americans and Filipinas/os. This article will examine the competing narratives of Puerto Rican cultures in Puerto Rico and in the United States that are illuminated by the current Latin Music Craze. It will then explore how LatCritical …

The tribe Triticeae contains over 250 perennial species that are components of grasslands in the temperate and sub-arctic regions of the world and includes some of the world’s most valuable forage and rangeland species. Many of these species had not been evaluated previously in the Central Great Plains, USA. A subset of the germplasm of the tribe Triticeae which included over 100 accessions of 55 different species was evaluated in a replicated, space-planted trial in eastern Nebraska during 1994–1996 to determine the survival and forage productivity of the accessions. The evaluated accessions were representative of perennial Triticeae genera and genomes. …

Bargaining For Loyalty In The Information Age: A Reconsideration Of The Role Of Substantive Fairness In Enforcing Employee Noncompetes, Rachel Arnow-Richman Jan 2001

Bargaining For Loyalty In The Information Age: A Reconsideration Of The Role Of Substantive Fairness In Enforcing Employee Noncompetes, Rachel Arnow-Richman

UF Law Faculty Publications

This article explores the enforceability of employee non-compete agreements, with particular attention to their use in information-based industries as a response to increased worker mobility. Non-compete agreements have long been viewed with skepticism by courts and scholars due to historical concerns about employee bargaining power. This article argues that the current approach to assessing the fairness of these agreements is misdirected. Courts attempt to distinguish proper from improper restraints by looking to whether the non-compete protects an employer interest that is separate and distinct from the employer's desire simply to retain the employee. Such an approach is unworkable in an …

Property, Wealth, Inequality And Human Rights: A Formula For Reform, Berta E. Hernández-Truyol, Shelbi D. Day Jan 2001

Property, Wealth, Inequality And Human Rights: A Formula For Reform, Berta E. Hernández-Truyol, Shelbi D. Day

UF Law Faculty Publications

This essay scrutinizes the persistence of inequality in the United States through a human rights lens and grapples with the troubling disparities unearthed by two works: American Apartheid: Segregation and the Making of the Underclass and Black Wealth/White Wealth: A New Perspective on Racial Inequality. These two highly enlightening and, simultaneously, deeply troubling and depressing books elucidate the myriad locations at which inequalities persist and the historical, social, psychological, and legal foundations of, and explications for, such disparities in the African American community.

This work proposes a human rights paradigm that provides a methodology to analyze, deconstruct and unravel …

Bridging The Divide: An Alternative Approach To International Labor Rights After The Battle Of Seattle, Stephen F. Diamond Jan 2001

Bridging The Divide: An Alternative Approach To International Labor Rights After The Battle Of Seattle, Stephen F. Diamond

Faculty Publications

The massive protest by labor, human rights, and environmental activists at the Ministerial Conference of the World Trade Organization in Seattle in late 1999 was a singular event in global trade politics. It represented a major setback for the proponents of free trade and for the "globalization" process itself. It reflected, and has now influenced, the contours of American domestic politics as well. At the heart of the Seattle events was a new coalition between trade unions, led by the American AFL-CIO, and a wide range of protest groups and non-governmental organizations. This new coalition represents a potent force but …

Also, Too And Moreover In A Novel By Dorothy L. Sayers, Stephen H. Levinsohn Jan 2001

Also, Too And Moreover In A Novel By Dorothy L. Sayers, Stephen H. Levinsohn

Work Papers of the Summer Institute of Linguistics, University of North Dakota Session

When Dorothy Sayers uses also in her novel The Documents in the Case, this indicates that the material that is added is at least as important as that to which it is added. She uses moreover, as Blakemore (1987) has observed, to indicate that the material that is added provides further evidence for a recently stated conclusion. Too is the 'elsewhere' additive. Sayers uses it when the information that is added confirms or contradicts a previous utterance or assumption. She also uses it when the material concerned is of lesser or greater importance than that to which it …

Cleveland State Law Review

Another important consideration is the policy behind these statutes, especially the IGRA. Part II will describe what the pull-tab games are, the statutes at issue, the conflicting cases, and the statutory interpretation issue. Part III will describe how the tenets of Indian Law can affect the analysis. Part IV will contain an analysis of the statutes and compare it to how the courts analyzed them. …

Working With People To Make Art: Oral History, Artistic Practice, And Art Education, Dipti Desai Jan 2001

Working With People To Make Art: Oral History, Artistic Practice, And Art Education, Dipti Desai

Journal of Social Theory in Art Education

In recent years, some contemporary artists have used oral history methods as an integral part of their artistic practice. Oral history emerged in the United States as a distinct historical method with the establishment of the first organized oral history project in 1948 by Alan Nevin at Columbia University in New York. It gradually wrenched itself from its elitist origins of documenting stories of prominent white men to becoming a populist approach that draws attention to ordinary people’s lives, perceptions, and experiences of an event. Based on interviews conducted over a short period of time, oral histories’ primary contribution to …
