The Vulcan Photometer: A Dedicated Photometer For Extrasolar Planet Searches, William J. Borucki, Douglas Caldwell, David G. Koch, Larry D. Webster, Jon M. Jenkins, Zoran Ninkov, Robert Showen

Articles

A small CCD photometer dedicated to the detection of extrasolar planets has been developed and put into operation at Mount Hamilton, California. It simultaneously monitors 6000 stars brighter than 13th magnitude in its 49 deg2 field of view. Observations are conducted all night every clear night of the year. A single field is monitored at a cadence of eight images per hour for a period of about 3 months. When the data are folded for the purpose of discovering low-amplitude transits, transit amplitudes of 1% are readily detected. This precision is sufficient to find Jovian-size planets orbiting solar-like stars, which …

Company Registration And The Private Placement Exemption, Merritt B. Fox Jan 2001

Company Registration And The Private Placement Exemption, Merritt B. Fox

Faculty Scholarship

Over the last twenty years, there has been a steady shift in securities disclosure regulation away from its traditional transactional basis toward a system of company registration. Under the transaction based approach, each new public offering of a security has to be registered under the Securities Act of 1933 (the "1933 Act"), a requirement that reflects the SEC's traditional concern that the most important time to have high-quality disclosure is at the moment of a securities offering. Under the company registration approach, an established, publicly traded issuer would register just once, provide information thereafter on a periodic basis, and then …

Taxing International Income: Inadequate Principles, Outdated Concepts, And Unsatisfactory Policies, Michael J. Graetz Jan 2001

Taxing International Income: Inadequate Principles, Outdated Concepts, And Unsatisfactory Policies, Michael J. Graetz

Faculty Scholarship

It is a pleasure to be here today to deliver the first David R. Tillinghast Lecture of the 21st century, a lecture honoring a man who has done much to shape' and stimulate our thinking about the international tax world of the 20th.

Our nation's system for taxing international income today is largely a creature of the period 1918-1928; a time when the income tax was itself in childhood. From the inception of the income tax (1913 for individuals, 1909 for corporations) until 1918, foreign taxes were deducted like any other business expense. In 1918, the foreign tax credit (FTC) …

On Insider Trading, Markets, And Negative Property Rights In Information, Zohar Goshen, Gideon Parchomovsky

Faculty Scholarship

Few issues have sparked as much debate and disagreement among Law and Economics scholars as the prohibition on insider trading. Ironically, the Supreme Court's attempts in Chiarella v. United States, Dirks v. Securities and Exchange Commission, and, most recently, in United States v. O'Hagan to clarify the scope and content of the ban on insider trading, and the subsequent reaction of the Securities and Exchange Commission ("SEC"), have only added fuel to the fire of the academic debate already raging on the issue.

The most intriguing feature of the debate on insider trading is that all contributors seek to promote …

From Raw Materials To Customers: Supply Chain Management In The Service Industry, Jack Cook, Kathy Debree, Amie Feroleto Jan 2001

From Raw Materials To Customers: Supply Chain Management In The Service Industry, Jack Cook, Kathy Debree, Amie Feroleto

Articles

No company can operate without a supply chain. recent years have seen change in the way many companies manage their supply chains - holistically rather than as a series of separate pieces. Manufacturers have taken the lead in improving supply chain management, but now the fast-growing service industry is adopting these principles. A study in the health care area illustrates fast-growing service industry is adopting these principles. A study in the health care area illustrates how service businesses can benefit from the decreased lead times, faster product development, higher quality, and reduced costs that can accompany successful supply chain management.

Extinguishing Inheritance Rights: California Breaks New Ground In The Fight Against Elder Abuse But Fails To Build An Effective Foundation, Kymberleigh N. Korpus Jan 2001

Extinguishing Inheritance Rights: California Breaks New Ground In The Fight Against Elder Abuse But Fails To Build An Effective Foundation, Kymberleigh N. Korpus

UC Law Journal

This Note examines the elder abuse problem in the United States by describing: state responses to its "discovery" in the late 1970s as well as the debilitating reliance upon reporting; the currently available remedies and the hurdles to using those remedies; the ethical challenges to the states' primary abuse prevention tools, and the dramatic explosion in elder abuse that is already underway. Then, this Note describes American descent doctrines, and philosophies underlying exceptions to the doctrinal testamentary freedom and value-neutrality of intestate succession statutes. It proposes the Chinese behavior-based model of inheritance as an alternative inheritance scheme that, with its …

Working Knowledge: Trade Secrets, Restrictive Covenants In Employment, And The Rise Of Corporate Intellectual Property, 1800-1920, Catherine L. Fisk Jan 2001

Working Knowledge: Trade Secrets, Restrictive Covenants In Employment, And The Rise Of Corporate Intellectual Property, 1800-1920, Catherine L. Fisk

UC Law Journal

The invention of trade secret doctrine in the mid-nineteenth century enabled employers to enjoin revelation of secret information by current or former employees. At the same time, courts expanded the permissible uses of post-employment covenants not to compete so as to prevent dissemination of knowledge. These doctrinal developments thus defined the bounds of permissible entrepreneurship. Equally as significant, these doctrines both generated and reflected a profoundly new perspective on the nature and control of workplace knowledge.

This Article examines the origins and development of the law of trade secrets and restrictive covenants through study of cases and treatises and through …

Lying, Misleading, And Falsely Denying: How Moral Concepts Inform The Law Of Perjury, Fraud, And False Statements, Stuart P. Green Jan 2001

Lying, Misleading, And Falsely Denying: How Moral Concepts Inform The Law Of Perjury, Fraud, And False Statements, Stuart P. Green

UC Law Journal

This Article seeks to describe the relationship between the criminal law and various concepts of deception. Deception is defined as the communication of a message that is intended to cause a person to believe something untrue. Three different kinds of deception are identified: (1) lying (deception that involves an assertion and is literally false); (2) non-lying deception, or mere "misleading" (deception that requires neither an assertion nor literal falsity); and (3) falsely denying (deception that occurs in the context of a person's denying some accusation of alleged wrongdoing). This Article argues that, other things being equal, non-lying deception tends to …

An Investigation Of Residual Stresses Induced By Forming Processes On The Fatigue Resistance Of Automotive Wheels, Patrick James Mcgrath Jan 2001

An Investigation Of Residual Stresses Induced By Forming Processes On The Fatigue Resistance Of Automotive Wheels, Patrick James Mcgrath

School of Engineering, Computing and Mathematics Theses

The nature and scope of this thesis relates to obtaining an understanding of the way in which sheet metal forming processes affect the residual stresses (plastic deformation) and the fatigue perfomiance of wheel centre discs made of a dual phase steel. Automotive wheels are mainly manufactured from sheet metal plate by forming processes using tools and dies. This manufacturing process is directly concemed with deforming the plate under predominantly applied tensile forces where the component acquires a sfress state which is multi-axiial. This stress state is both complex and difficult to assess from an analytical point of view and thus …
