Corrective Justice And Constitutional Torts, Bernard P. Dauenhauer, Michael L. Wells Jan 2001

Corrective Justice And Constitutional Torts, Bernard P. Dauenhauer, Michael L. Wells

Georgia Law Review

Tort liability in the private realm may be understood both as "an instrument aimed... at deterrence... [and] a way of achieving corrective justice between the parties."' Following the common law model, the Supreme Court has borrowed this normative framework for constitutional torts, ruling that the aims of liability for damages are to vindicate constitutional rights and to deter constitutional violations. A recent article by Daryl Levinson takes issue vith this approach. Levinson argues that the superficial similarities between public torts and private torts conceal real differences, to which neither the Court nor scholars have paid adequate attention. The main point …

A Virtual Organisation Model For E-Government, Greg Robins, Janice Burn Jan 2001

A Virtual Organisation Model For E-Government, Greg Robins, Janice Burn

Research outputs pre 2011

This paper looks at the implementation of a new customer value alliance model in e-govemment. Firstly we review the issues of e-govemment and the drive towards customer centric organisations in the context of multiple government agencies. A model of e-Government is introduced and examined within the context of a virtual organisation model which can be applied along the customer value chain across multiple service agencies. A case study is used to demonstrate how this concept of a virtual organisation as a customer value-alliance model can effect a successful transition to e-Govemment from a traditional Government model. Finally, we examine how …

A Prototype Automatic Dental Identification System (Adis)., Diaa Eldin Mohamed Nassar Jan 2001

A Prototype Automatic Dental Identification System (Adis)., Diaa Eldin Mohamed Nassar

Graduate Theses, Dissertations, and Problem Reports (ETD)

In this work we apply combined digital image processing and artificial neural network techniques in developing a prototype of an automatic dental identification system (ADIS) to be employed for postmortem forensic identification. The prototype ADIS follows a pyramidal image-matching architecture used in developing an analogous fingerprint comparison system. Owing to the differences in image natures, we used new techniques and modified some mathematical models. We introduce an adaptive technique for dental radiograph enhancement and an adaptive strategic searching technique for neural network training. The training and testing results we obtained are promising.

Manufacturing Security: Mass Media Coverage Of Depleted Uranium Weapon Use In Okinawa, Japan., Yoko Abe Jan 2001

Manufacturing Security: Mass Media Coverage Of Depleted Uranium Weapon Use In Okinawa, Japan., Yoko Abe

Graduate Theses, Dissertations, and Problem Reports (ETD)

Despite the reversion of Okinawa to Japan in 1972, thirty-eight U.S. military bases still remain in the prefecture. While the local residents’ entreaties to end their suffering from the consequences of the U.S. military presence remain strong, the U.S. and Japanese governments have adopted measures to maintain the U.S. military foothold. This study examined the viewpoints of six claimsmakers to illustrate an overlooked political process in the perpetuation of the U.S. military presence. The research applied a content analysis of newspaper articles appearing in the Okinawa Times following the disclosure of the U.S. Marine Corps’ use of depleted uranium weapons. …

Why A Journal Of Research For Consumers?, Simone Pettigrew Jan 2001

Why A Journal Of Research For Consumers?, Simone Pettigrew

Research outputs pre 2011

This article outlines the rationale behind the introduction of the Journal of Research for Consumers. The potential benefits to be gained from educating consumers are discussed, and arguments are made for the contribution of consumer researchers to the consumer education process. In particular, the deficiencies of the current dependence on research that produces managerial outcomes are discussed in terms of the limitations they place on understanding the relevance of consumption in consumers' lives. The structure of the Journal of Consumer Research is described in terms of the access provided to both academic and consumer audiences.

Chimpanzee-Caregiver Interactions In Captive Settings: The Effects Of "Cultures" Of Captive Management, Sarah Angela Baeckler Jan 2001

Chimpanzee-Caregiver Interactions In Captive Settings: The Effects Of "Cultures" Of Captive Management, Sarah Angela Baeckler

All Master's Theses

Interactions between chimpanzees and human caregivers can have profound effects on both the humans and the chimpanzees. These interactions were studied at three different facilities. Twenty-one chimpanzees and five caregivers were observed during their daily interactions over the course of approximately two weeks per facility. Results indicate differences in the types and styles of interactions that take place at each facility, and the relationships between the chimpanzees and their caregivers.

Implications for captive management were discussed.

Some Philosophical, Political And Legal Implications Of American Archeological And Anthropological Theory, John W. Ragsdale Jr Jan 2001

Some Philosophical, Political And Legal Implications Of American Archeological And Anthropological Theory, John W. Ragsdale Jr

Faculty Works

Archaeological and anthropological theories about the origins and practices of ancient peoples, and about events and histories, distant in time, but blending into the present, have had impacts that transcend the tenets and borders of the sciences as discrete disciplines. Our suppositions about the factual past can influence our present beliefs - not only our understandings and conclusions about the tangible and practical - but our feelings and faiths about the intangible and the spiritual as well. Our values, principles, world views, and cosmologies may thus be shaped by our scientific backdrop. Beyond this, our social activity, our national policy, …

Mathematization And Modern Science, Calvin Jongsma Jan 2001

Mathematization And Modern Science, Calvin Jongsma

Faculty Work Comprehensive List

The discipline of mathematics has not been spared the sweeping critique of postmodernism. Is mathematical theory true for all time, or are mathematical constructs in fact fallible? This fascinating book examines the tensions that have arisen between modern and postmodern views of mathematics, explores alternative theories of mathematical truth, explains why the issues are important, and shows how a Christian perspective makes a difference.

This chapter continues the process of tracing Western mathematization.

Aha? Is Creativity Possible In Legal Problem Solving And Teachable In Legal Education?, Carrie Menkel-Meadow Jan 2001

Aha? Is Creativity Possible In Legal Problem Solving And Teachable In Legal Education?, Carrie Menkel-Meadow

Georgetown Law Faculty Publications and Other Works

This article continues and expands on my earlier project of seeking to describe how legal negotiation should be understood conceptually and undertaken behaviorally to produce better solutions to legal problems. As structured problem solving requires interests, needs and objectives identification, so too must creative solution seeking have its structure and elements in order to be effectively taught. Because research and teaching about creativity and how we think has expanded greatly since modern legal negotiation theory has been developed, it is now especially appropriate to examine how we might harness this new learning to how we might examine and teach legal …

Issues On Ethnicity And Governance In Nigeria: A Universal Human Rights Perspective, Ema I. Orji Jan 2001

Issues On Ethnicity And Governance In Nigeria: A Universal Human Rights Perspective, Ema I. Orji

Fordham International Law Journal

This Article focuses on the plight of the Igbo ethnic group of southeast Nigeria. It traces the historical and political evolution of Nigeria with emphasis on ethnic relations. In arguing that the Igbo are victims of fundamental human rights violations, references are made to relevant international human rights instruments, as well as to the various constitutional guarantees entrenched in various Nigerian constitutions. The marginalization of the Igbo is discussed, particularly with regard to disparities in national education programs. This Article also discusses the Igbo right to self-determination and the failure of the international community to intervene on behalf of the …

Church Growth In The Khasi-Jaintia Conference, Meghalaya, India, Khrawbor Kharbteng Jan 2001

Church Growth In The Khasi-Jaintia Conference, Meghalaya, India, Khrawbor Kharbteng

Doctor of Ministry Projects

The population of the Khasi-Jaintia Conference territory is made up of 80 percent Khasis and 20 percent other ethnic groups. The Khasis, an accepting and happy people, are receptive to the Christian message. This receptivity comes from their monotheistic concept of God and their admiration for the dedicated missionaries who brought the gospel but did not attempt to modify their culture, except for their refusal to accept social evils such as drinking, gambling, and sexual promiscuity. Seventh-day Adventism came to the Khasi region in 1915 with the arrival of E. G. Hardinge and family. The actual work of the Seventh-day …

An Analysis Of Service Sector Growth Effects On Income Inequality A Comparison Model Of Metropolitan And Non-Metropolitan Areas Of The Appalachia., Cheryl Lynne Peskar-Johnson Jan 2001

An Analysis Of Service Sector Growth Effects On Income Inequality A Comparison Model Of Metropolitan And Non-Metropolitan Areas Of The Appalachia., Cheryl Lynne Peskar-Johnson

Graduate Theses, Dissertations, and Problem Reports (ETD)

It is very difficult to find regional economic restructuring studies that examine economic well-being by analyzing the effects of service sector growth on income inequality. This study is a regional economic restructuring analysis. Through the use of county level data of 399 Appalachian Counties this study produced a comparison model of metropolitan and non-metropolitan areas. The main goal of my thesis was to evaluate the growing economic differences in income potentials that have resulted in new spatial inequalities in the United States. By regressing income inequality (GINI INDEX) against service sector growth this study was able to support earlier studies …

The Need For Diversity In The Tourism And Hospitality Industry, Joel Frater Jan 2001

The Need For Diversity In The Tourism And Hospitality Industry, Joel Frater

Visions in Leisure and Business

Examined at a macro level, there are several key factors that are likely to influence the tourism and hospitality industry. The first factor is the changing face of the American population. A second factor is the rate of growth of the tourism industry. A third, and very important factor is the extent to which the industry embraces diversity. There is a need for industries to reach out to a diverse group of customers and employees. The need for cross-cultural responsiveness and the adoption of training models is apparent. This paper examines population and travel industry data-trends as a corner stone …
