Divorce And The Catholic Lawyer, John J. Coughlin Jan 2001

Divorce And The Catholic Lawyer, John J. Coughlin

Journal Articles

On January 28, 2002, Pope John Paul II focused his annual address to the officials of the Roman Rota on the topic of the indissolubility of marriage. At the conclusion of this theological and canonical analysis, the Holy Father made a few short statements cautioning civil lawyers about divorces cases. The following day, a story in The New York Times carried the headline "John Paul Says Catholic Bar Must Refuse Divorce Cases." The article construed the pope's reference as a blanket prohibition against Catholic lawyers handling divorce cases. It further questioned whether the prohibition contradicted the Pontiff's prior emphasis on …

Common Schools And The Common Good: Reflections On The School-Choice Debate, Richard W. Garnett Jan 2001

Common Schools And The Common Good: Reflections On The School-Choice Debate, Richard W. Garnett

Journal Articles

Thank you very much for this timely and important discussion on school choice, religious faith, and the public good.

First things first—Steven Green is right: The Cleveland school-voucher case is headed for the Supreme Court. And I am afraid that Mr. Green is also correct when he observes that the question whether the First Amendment permits States to experiment with meaningful choice-based education reform will likely turn on Justice O'Connor's fine-tuned aesthetic reactions to the minutiae of Ohio's school-choice experiment.

Putting aside for now the particulars of the Cleveland case, though, I would like to propose for your consideration a …

Rural Low-Income Housing And Massachusetts Chapter 40b: A Perspective From The Zoning Board Of Appeals, Eric J. Gouvin Jan 2001

Rural Low-Income Housing And Massachusetts Chapter 40b: A Perspective From The Zoning Board Of Appeals, Eric J. Gouvin

Faculty Scholarship

The Massachusetts Low and Moderate Income Housing Act ("Act") was enacted in 1969 to promote the construction of lowincome housing in restrictively zoned Massachusetts communities. It seeks to achieve its goal by providing a builder's remedy which, in effect, overrides local zoning ordinances. The local Zoning Board of Appeals ("ZBA"), in deciding whether to issue a Comprehensive Permit under the Act, must evaluate the local and regional need for low-to moderate-income housing and weigh that need against local concerns over health, safety, design, and open space conservation. This Article examines the difficulty of applying the Act in rural towns. First, …

Locomotor And Habitat Classifications Of Cercopithecoid Postcranial Material From Sterkfontein Member 4, Bolt's Farm And Swartkrans Members 1 And 2, South Africa, Sarah Elton

KIP Articles

Much southern African cercopithecoid postcranial material is not associated with craniodental remains. Consequently, this postcranial material cannot be confidently assigned to a particular taxon, with the result that little is known about the locomotor strategies and habitat preferences of specific Plio-Pleistocene cercopithecoids from southern Africa. However, cercopithecoid postcrania can provide important information about habitats that were present at fossil sites, even when the material is not attributed to taxa. In this paper, ecomorphic analysis is used to assign cercopithecoid postcranial material from Sterkfontein Member 4, Bolt' s Farm and Swartkrans Members 1 and 2 to one of three habitat/locomotor categories: …

Explaining Away Jesus' Resurrection: The Recent Revival Of Hallucination Theories, Gary Habermas Jan 2001

Explaining Away Jesus' Resurrection: The Recent Revival Of Hallucination Theories, Gary Habermas

Liberty Baptist Theological Seminary (1973-2015)

A survey of over 1000 recent publications on Jesus’ resurrection reveals some intriguing trends. For example, after almost a century of virtual dormancy, some critical scholars have proposed a number of naturalistic alternative hypotheses to explain away Jesus’ resurrection. Similar to the situation at the end of the Nineteenth Century, the most popular response by critics today is that the disciples experienced some sort of subjective perceptions of Jesus, although He had not been raised from the dead. Hallucination (more properly termed subjective vision) hypotheses come in different varieties. Sometimes it is suggested that the resurrection appearances of Jesus were …
