The Clean Air Act And The Constitution, Lisa Heinzerling

Saint Louis University Public Law Review

On February 27, 2001, the Supreme Court unanimously upheld the Clean Air Act against a constitutional challenge based on the nondelegation doctrine. The Court held that the Act provided the requisite “intelligible principle” for assignments of authority to the executive, and it also held that the D.C. Circuit had erred in allowing an administrative agency to decide the scope of its own authority under what that court had held was an impermissibly broad assignment of authority. This article was written before the Supreme Court issued its decision.

Morris Berman tells the story of his maternal grandfather, who, when he was five years old in 1883 or 1884, was sent to a Jewish elementary school in Belorussia. On the first day of class, the teacher startled the young boy by taking each child's slate and smearing the first two letters of the Hebrew alphabet—aleph and beys—on it in honey. Microsatellite Analysis Of Female Mating Behaviour In Lek-Breeding Sage Grouse, Katy Semple, Robert K. Wayne, Robert M. Gibson

We used microsatellite DNA markers to genotype chicks in 10 broods of lek-breeding sage grouse, Centrocercus urophasianus, whose mothers’ behaviour was studied by radio tracking and observing leks. Previous behavioural studies suggested that almost all matings are performed by territorial males on leks and that multiple mating is rare. Two broods (20%) were sired by more than one male. Genetic analyses of the broods of eight females that visited an intensively studied lek were consistent with behavioural observations. Four females observed mating produced singly sired broods and males other than the individual observed copulating were excluded as sires for most …

Interpreting Urugual Round Agreements Act Section 102(B)'S Safeguards For State Sovereignty: Reconciling Judicial Independence With The United States Trade Representative's Policy Expertise, Brandon Johnson

In this Note, I address the concerns of one aspect of this academic commentary-the claim that the WTO Agreement may cause a tectonic shift in domestic regulatory power, away from the states and toward the federal government and/or the WTO. I argue that while the concerns about the loss of national sovereignty are exaggerated, there is a very real threat to the sovereignty of the States. Congress was aware of this danger and included a variety of provisions designed specifically to protect state sovereignty from federal encroachment in the Uruguay Round Agreements Act (URAA), the federal legislation incorporating the WTO …

This article deals with the working-level dispute-settlement apparatus of the World Trade Organization ("WTO"). In particular, it discusses the work of the Appellate Body and, functioning below it, panels established by the WTO to conduct proceedings in individual cases. It focuses on the relationship between the Appellate Body and panels, and on the responsibilities of the Appellate Body in the context of that relationship.

When jurors decide whether a putative patent infringer is liable under the doctrine of equivalents, Federal Circuit law requires that the patent owner’s trial presentation provide “particularized evidence” and “linking argument” with respect to each prong of the classic tripartite test for liability (i.e., substantial identity of “function,” “way,” and “result” between each element of the claimed invention and accused device). The court has recognized that absent such evidentiary roadmapping, jurors are “put to sea without guiding charts.” In its August 2001 decision in Monsanto Co. v. This Comment examines the newly revised PTO utility examination guidelines for biotechnology patents. The race for patenting human genes is well underway. When complete sequences of human genes are found, researchers have been quick to seek patents. This “patent grab” has been driven less by the expectation that a particular gene sequence will result in production of a useful protein and more by the idea that enough patenting will create a protectable “haystack” in which one will find a few “genetic needles of value.” The new utility guidelines may not completely aid the underlying and fundamental policies on patenting. Genetic Analysis Of Kafirins And Their Phenotypic Correlations With Feed Quality Traits, In Vitro Digestibility, And Seed Weight In Grain Sorghum, C. Hicks, S. R. Bean, G. L. Lookhart, Jeffrey F. Pedersen, K. D. Kofoid, M. R. Tuinstra

Twenty-three entries of grain sorghum (Sorghum bicolor (L.) Moench), including eight inbred lines (five males and three females) and 15 hybrids, were evaluated to determine the proportion of γ, αII, and β-αI-kafirins and their association with contents of crude protein, fat, and starch; protein digestibility; in vitro dry matter disappearance; and seed weight. The male lines included three normal-seeded lines (TX2737, TX435, and P954063) and two large-seeded lines (Eastin1 and PL-1). Female lines consisted of three common U.S. seed parent lines (Wheatland, Redlan, and SA3042). The lines and their hybrids were grown under dryland conditions at two locations in …

Comparing Two Methods To Determine Nest Location Of Golden Mice (Ochrotomys Nuttalli), Anita T. Morzillo, George A. Feldhamer

Fluorescent powder tracking was compared with radiotelemetry to locate nests used by golden mice (Ochrotomys nuttalli), a semi-arboreal species. Fluorescent powder was not a successful method for determining nest location or movement patterns for golden mice. Many golden mice immediately climbed trees, whereas white-footed mice remained on the ground. Weather conditions can negatively affect the success of powder tracking. Although radiotelemetry successfully determined the locations of occupied nests, precise estimates of movements within a microhabitat could not be made.

Altruistically Inclined?: The Behavioral Sciences, Evolutionary Theory, And The Origins Of Reciprocity, Alexander J. Field

Altruistically Inclined? examines the implications of recent research in the natural sciences for two important social scientific approaches to individual behavior: the economic/rational choice approach and the sociological/anthropological. It considers jointly two controversial and related ideas: the operation of group selection within early human evolutionary processes and the likelihood of modularity—domain-specific adaptations in our cognitive mechanisms and behavioral predispositions.

Experimental research shows that people will often cooperate in one-shot prisoner's dilemma (PD) games and reject positive offers in ultimatum games, contradicting commonly accepted notions of rationality. Upon first appearance, predispositions to behave in this fashion could not have been favored …
