Representational Standing: U.S. Ex Rel. Stevens And The Future Of Public Law Litigation, Myriam E. Gilles

In May 2000, the Supreme Court handed down its decision in Vermont Agency of Natural Resources v. U.S. ex rel. Stevens, a seemingly predictable 11th Amendment case. In upholding the plaintiff's Article III standing to bring that case, however, the Court suggested a theory of "representational standing" that holds the potential to radically transform the entire body of law governing the ability of private citizens to seek, through the federal courts, the vindication of broadly-held public interests.

Over the past 30 years, the Court's increasingly restrictive standing jurisprudence has effectively precluded private citizens from playing a meaningful role in public …

This paper traces the transitions of first year students and other adults of the university as they partake in an intergenerational shared inquiry at a common table. My transformative research invites students, faculty, and staff to attend to (eat) and transform (digest) the moral and political encounters in successive becomings from their speaking positions at a common table. This dialogical partaking of words disrupts the market discourse of student as consumer and re-stories the university as a service organization where all organizational actors are consuming and being consumed. The Troubling Influence Of Equality In Constitutional Criminal Procedure: From Brown To Miranda, Furman And Beyond, Scott W. Howe

Vanderbilt Law Review

This Article identifies and critiques a view of the criminal-procedure clauses in the Bill of Rights that is revealed in Supreme Court decisions after Brown v. Board of Education. Professor Howe argues that the Court has gone astray in constructing these clauses by focusing on equality. He contends that the criminal-procedure clauses are better understood as discrete protections of individual liberty than as reflecting a unified theory or separate theories about equality. Building on this perspective, the Article proposes a reformulation of doctrine in varied realms of constitutional criminal procedure, including police -interrogation, capital sentencing, and administrative searches and seizures. …

Throughout the world, new techniques are developed to test and evaluate systems. The Department of Defense and the US Air Force conduct numerous studies into the reliability and maintainability of current and future weapons systems in an effort to understand the reliability, maintainability, and availability (RM&A) costs of these systems. Furthermore, they must verify RM&A characteristics of systems, which are still in the development phase. The Air Force Operational Test and Evaluation Center (AFOTEC) is responsible for testing new equipment to ensure their RM&A characteristics meet specifications. Chronic human exposure to nonovertly toxic doses of arsenic is associated with an increased risk of cancer. Although its carcinogenic mechanism is still unknown, arsenic does not directly cause DNA damage or mutations and is therefore thought to act principally as a co-mutagen, co-carcinogen, and/or tumor promoter. Previous studies in our laboratory demonstrated that effects of low-dose arsenic (III) (arsenite) on expression of the hormone-regulated phosphoenolpyruvate carboxykinase (PEPCK) gene were strongly associated with the glucocorticoid receptor (GR)-mediated regulatory pathway. We therefore examined specifically the effects of arsenite on the biochemical function of GR in hormone-responsive H4IIE rat hepatoma cells. Completely …

Lifecycle Energy And Air Emission Differences Between Electric And Internal Combustion Vehicles, David L. Mccleese

The U.S. Federal Government has encouraged shifting from internal combustion engine vehicles (ICEVs) to electric vehicles (EVs) with three objectives, reducing foreign oil dependence, greenhouse gas emissions, and criteria pollutant emissions. This thesis uses Monte Carlo simulation to predict lifecycle emissions and energy consumption differences per kilometer driven from replacing ICEVs with three EV options: lead acid, nickel cadmium (Ni-Cd), and nickel metal hydride (NiMH). All three EV options reduce U.S. foreign oil dependence by shifting to domestic coal. The probabilities that lifecycle energy consumption per km driven improve are lead acid 76%, Ni-Cd 64%, and NiMH 90%. The probabilities …

Spray painting operations using chromate-containing primer paints produce particles which may expose workers to strontium chromate. Chromate contains hexavalent chromium (Cr(VI)) which is a confirmed human carcinogen. It is suspected that the smaller particles contain disproportionately less Cr(VI) than larger particles. In order to determine if a bias in chromate content exists, paint particles were collected and separated based on particle size and the Cr(VI) concentration was determined. Aviation primer paint from the DeSoto and Deft companies was sprayed in a booth and seven-stage cascade impactors were used to separate particles.

Predicting high pilot mental workload is important to the U.S. Air Force because lives and aircraft can be lost when errors are made during periods of mental overload and task saturation. Current research efforts use psychophysiological measures such as electroencephalography, cardiac, ocular, and respiration measures in an attempt to identify and predict mental workload levels. The explosion in Internet technology in the past decade has drawn the Lanham Act into the realm of electronic commerce. Trademark owners seeking to register domain names have recently found themselves entwined in a number of disputes, such as disputes involving claims to multiple domain names and disputes over whether the domain name registration system is fairly administered. The United States Patent and Trademark Office (PTO) recently finalized its patent utility guidelines. Promulgated by the PTO, the new guidelines will be used by patent examiners in determining whether a claimed invention should be awarded patent protection ;and will be used by patent applicants and attorneys who file patent applications. The guidelines focus primarily on the utility standards for gene and gene fragment patents, an issue that was featured in the PTO's 1999 Revised Interim Utility Guidelines and has been the subject of considerable public debate.
