Electronic Text Centers: Creating Research Collections On A Limited Budget, The Nebraska Experience, Joan Giesecke, Beth Mcneil, Gina L. B. Minks

In this article, we will describe a slightly different approach to building digital collections. The approach is that of building collections as a by-product of a service center rather than collection building being the primary purpose of the program activity. Specifically, we will discuss how an Electronic Text Center can enhance digital collection development in the humanities.

Laws of war have been carefully defined by individual nations’ own codes of law as well as by supranational bodies. Yet the international scene has seen an increasing movement away from traditionally declared war toward multinational peacekeeping missions geared at containing local conflicts when perceived as potential threats to their respective regions’ political stability. While individual nations’ laws governing warfare presuppose national sovereignty, the multinational nature of peacekeeping scenarios can blur the lines of command structures, soldiers’ national loyalties, occupational jurisdiction, and raise profound questions as to which countries’ moral sense/governmental system is to be the one upheld. The landmine threat to innocent civilians around the world is personally tragic, but it also represents a massive challenge to the development and infrastructure of nations at risk. Mine action is a series of activities which, taken together, attempt to ameliorate the effects of landmines. Mine action components include landmine clearance, mine awareness, and victim assistance and support activities. These diverse, and sometimes unrelated, operations are undertaken by numerous organizations, which are not typically under the control of any one organization. Coordination of effort, therefore is extremely difficult. The US government humanitarian demining program is predicated on providing limited support …

Although both constitutional theory and practical considerations offer powerful reasons for Congress and the President to prefer negotiation rather than litigation of separation of powers disputes, the Clinton Administration litigated and lost several important cases dealing with presidential power. Some commentators have suggested that these rulings will undermine the presidency for years after Clinton leaves office. Professor Entin assesses some factors, notably the phenomenon of divided government, that might have contributed to the difficulty of reaching interbranch accommodations in recent years and suggests that the long-term implications of the adverse judicial rulings may be less severe than the pessimists fear.

The 1999 U.S.-led, NATO-assisted air strike against Yugoslavia has been extolled by some as leading to the creation of a new rule of international law permitting nations to undertake forceful humanitarian intervention where the Security Council cannot act. This view posits the United States as a benevolent hegemon militarily intervening in certain circumstances in defense of such universal values as the protection of human rights. This article challenges that view. NATO's Kosovo intervention does not represent a benign hegemon introducing a new rule of international law. Section I of this Article reviews the facts of State v. Fly, North Carolina's law of indecent exposure prior to Fly and the Court of Appeals' decision. Section II analyzes the Supreme Court's opinion in Fly and the various rationales offered by the Court to justify its decision. Section III considers the plight of the trial judges in applying the principles, statements, and analysis announced in State v. Fly. Although trial judges must apply the rule of law, and therefore must abide by the "holding" in State v. Fly, this Article argues that trial judges have the same authority as …

Law and Contemporary Problems

In considering the guidance the executive branch of government has provided to resolve questions relating to religious freedom and the issue of church and state, Lee draws upon the positions of both the IRS and the President. Initially, he concludes that when the state requires churches committed to speaking truth in the public square to choose between publicizing their beliefs and remaining tax-exempt, it burdens the free exercise of religion.

Was Amerindian Dispossession Lawful? The Response Of 19th-Century Maritime Intellectuals, D G. Bell

In the half-century ending about the time of Confederation a dozen writers addressed awkward questions about an earlier generation's dispossession of Maritime Amerindians from land and resources: had it been lawful; if so, how; if not, what should be done? In the main they approached it as an abstract question, divorced from those particulars of local history that would become the focus of late-20th-century investigation.
