The Use Of The Cognitive Status Examination In Detecting Cognitive Impairment In Elderly People, Geoff Mccann Jan 2000

The Use Of The Cognitive Status Examination In Detecting Cognitive Impairment In Elderly People, Geoff Mccann

Theses: Doctorates and Masters

Dementia is a growing social problem in Australia because as the population ages, the incidence of dementia increases. While the prevalence rates are only about I% at age 65, they double every five years until by 85 years of age the rate is over 24%. It is expected that by the year 2030, the number of elderly people with dementia will increase by 200%. Dementia is easily recognized in its advanced stages but can be overlooked in the early phase. Family members, care-givers and even the treating medical practitioner may mistakenly attribute the early decline in mental function to the …

Delgado, Hegel And The Rodrigo Chronicles, George A. Martinez Jan 2000

Delgado, Hegel And The Rodrigo Chronicles, George A. Martinez

Faculty Journal Articles and Book Chapters

Richard Delgado has made path-breaking contributions to the literature on race and American law. His Rodrigo Chronicles are already classics of the Critical Race Theory genre. It is, therefore, wholly appropriate that the Harvard Latino Law Review dedicated a symposium issue to an examination of the Rodrigo Chronicles and Delgado's other work. In this symposium essay, the author attempts to illuminate Delgado's project in the Chronicles through an examination of various aspects of Hegel's philosophy. Hegel's philosophy allows us to better understand Delgado's work in the Chronicles and elsewhere.

Disappearing Acts: The State And Violence Against Women In The Twentieth Century, Michelle Fine, Lois Weis Jan 2000

Disappearing Acts: The State And Violence Against Women In The Twentieth Century, Michelle Fine, Lois Weis

Publications and Research

As children we held our breath, our senses filled with the musty smells of elephants, the staccato flashes of twirling plastic flashlights, the terrors of trapeze. With mystery, moustache, and elegance, the magician waved a wand, invited a woman, usually White, seemingly working class, into a box. She disappeared or was cut in half. Applause. Our early introduction to the notion of the sponsored disappearing act. So, too, at the end of the twentieth century, we witness poor and working-class women shoved into spaces too small for human form, no elegance, no wand. And they too disappear. Disappearing from welfare …

Preserving Indigenous Paradigms In An Age Of Globalization: Pragmatic Strategies For The Development Of Clinical Legal Aid In China, Michael William Dowdle Jan 2000

Preserving Indigenous Paradigms In An Age Of Globalization: Pragmatic Strategies For The Development Of Clinical Legal Aid In China, Michael William Dowdle

Fordham International Law Journal

This Essay uses the experiences of international efforts to promote clinical legal aid in China to explore one such unexpected consequence of globalization: international assistance's understandable focus on more familiar kinds of legal aid institutions and activities can unintentionally impede the development of indigenous legal aid practices and institutions that might ultimately be better suited for the particular domestic environment. Part I of this essay will discuss international efforts to promote clinical legal aid in China, Part II will discuss reductive strategies for promoting legal development and the problems they present, Part III will discuss pragmatic strategies for promoting legal …

Welcoming Remarks: The Paris Bar: Access To Justice And Access To Legal Advice, Franics Teitgen Jan 2000

Welcoming Remarks: The Paris Bar: Access To Justice And Access To Legal Advice, Franics Teitgen

Fordham International Law Journal

Francis Teitgen, Batonnier of the Paris Bar Assocation, gave welcoming remarks on April 7, 2000, and discussed France's system for provision of legal aid services. He began by describing the history of legal aid in France. He then discussed the role of the Paris Bar Association in providing access to legal representation to those who could not otherwise afford it. Mr. Teitgen then discussed the process by which incarcerated individuals access lawyers. He also described a free legal consultation system run by the Paris Bar. He concluded by discussing new initiatives the Paris Bar is spearheading to increase access to …

Crossing The River Of Blood Between Us: Lynching, Violence, Beauty, And The Paradox Of Feminist History, Emma Coleman Jordan Jan 2000

Crossing The River Of Blood Between Us: Lynching, Violence, Beauty, And The Paradox Of Feminist History, Emma Coleman Jordan

Georgetown Law Faculty Publications and Other Works

Understandably, early feminist legal theory and history focused almost exclusively on establishing white women's autonomy against white male dominance. The vehicles of nineteenth century women's liberation included elements of public equality such as ownership of property, the right to vote, access to male dominated occupations, equal education and employment opportunity. Twentieth century feminists extended the equality project by penetrating the "private" sphere and attacking the very notion of a separate zone of family relations which was immune from government intervention to protect women from male abuse. Cultural feminists like Carol Gilligan took another approach, arguing that women's experiences as sexual …

Evidence Issues In Domestic Violence Civil Cases, Jane H. Aiken, Jane C. Murphy Jan 2000

Evidence Issues In Domestic Violence Civil Cases, Jane H. Aiken, Jane C. Murphy

Georgetown Law Faculty Publications and Other Works

This article is intended to assist practitioners in anticipating and responding to some of the evidentiary challenges in civil cases in which relief is sought for the victims of domestic violence. First, expert testimony is often necessary to dispel common myths about battered women and to educate judges and juries about the dynamics of domestic violence. Recent case law, however, has limited the admissibility of "non-scientific" expert testimony and may make it difficult for practitioners to use experts in their cases. In addition, particular evidentiary issues arise when victims are pursuing both criminal and civil remedies against the batterer. This …

Relationship Between Body Image Dissatisfaction And Fear Of Fatness To Severity Of Smoking Behavior In A Non-Clinical Adolescent Population, Louis J. Bevilacqua, Jr. Jan 2000

Relationship Between Body Image Dissatisfaction And Fear Of Fatness To Severity Of Smoking Behavior In A Non-Clinical Adolescent Population, Louis J. Bevilacqua, Jr.

PCOM Psychology Dissertations

Smoking is the most preventable cause of death in the U.S., yet it continues to kill more people than AIDS, automobile crashes, alcohol and drug abuse, murders, suicides, and fires---combined! In addition to a higher risk of dying prematurely, those who smoke are much more likely to experience numerous health problems. Other associated problems include dependency and tolerance to nicotine. Frequently, those who smoke are also more likely to use other substances such as marijuana, cocaine, heroine, and especially alcohol. These findings are frightening considering that it is estimated that 4.5 million are adolescents. The reasons why adolescents smoke range …

Case Study Of A Cognitive Behavioral Intervention For The Problem Of Marital Division Of Labor, Lily Woo Bollinger Jan 2000

Case Study Of A Cognitive Behavioral Intervention For The Problem Of Marital Division Of Labor, Lily Woo Bollinger

PCOM Psychology Dissertations

This clinical dissertation concerns an evaluation of a Cognitive-Behavioral Marital Therapy intervention designed to help resolve the issue of division of household labor and thereby increase marital satisfaction. There were six ninety-minute group marital sessions. There were 3 couples in the group. The sessions contained interventions to increase communication skills, problem-solving skills and raise empathy for the spouse who did more chores. The case study couple's score indicated that the husband had a higher level of marital satisfaction. The wife's final score indicated a small increase in marital satisfaction. Both had an increased score in being more self-centered.

Foreword: Law, Psychology, And The Emotions, Heidi Li Feldman Jan 2000

Foreword: Law, Psychology, And The Emotions, Heidi Li Feldman

Georgetown Law Faculty Publications and Other Works

Given that law is made by and for people, the relatively little attention lawyers, judges, and legal scholars have paid to human psychology is surprising. Too often, legal writers have either presupposed or borrowed impoverished conceptions of human nature, erecting legal theories for people presumptively possessed of the requisite nature, regardless of the psychology of the actual persons who make and live under the law. Even when they do attend to human nature, legal scholars tend to ignore the centrality of emotions, dispositions, fantasies, and wishes to human psychology. The articles in this Symposium are united by their authors' resistance …

Prudence, Benevolence, And Negligence: Virtue Ethics And Tort Law, Heidi Li Feldman Jan 2000

Prudence, Benevolence, And Negligence: Virtue Ethics And Tort Law, Heidi Li Feldman

Georgetown Law Faculty Publications and Other Works

Tort law assesses negligence according to the conduct of a reasonable person of ordinary prudence who acts with due care for the safety of others. This standard assigns three traits to the person whose conduct sets the bar for measuring negligence: reasonableness, ordinary prudence, and due care for the safety of others. Yet contemporary tort scholars have almost exclusively examined only one of these attributes, reasonableness, and have wholly neglected to carefully examine the other elements key to the negligence standard: prudence and due care for the safety of others. It is mistaken to reduce negligence to reasonableness or to …

Deconstructing Section 11: Public Offering Liability In A Continuous Disclosure Environment, Donald C. Langevoort Jan 2000

Deconstructing Section 11: Public Offering Liability In A Continuous Disclosure Environment, Donald C. Langevoort

Georgetown Law Faculty Publications and Other Works

This article is an effort to rethink civil liability in capital-raising transactions by large capitalization issuers. After a brief digression about who should set liability standards, the article then addresses two related questions. The first deals with a natural question: Should not the primary regulatory effort for large issuers be to assure continuous disclosure in the secondary marketplace, given the far larger volume of such trading in that market compared to that in primary transactions? Second, if we have developed a satisfactory regime of disclosure responsibilities for this setting, what more, if anything, in terms of liability protection, is needed …

Taking Myths Seriously: An Essay For Lawyers, Donald C. Langevoort Jan 2000

Taking Myths Seriously: An Essay For Lawyers, Donald C. Langevoort

Georgetown Law Faculty Publications and Other Works

The specific idea I want to explore has to do with the motivational power of myths and illusions on a personal level. To take a mundane example, people are often told to "believe in themselves." The underlying idea seems to be that high self confidence is an important motivator, especially in competitive settings like school, sports, business and the professions. This is not the idle talk of family and friends; millions of dollars are spent each year by people and their employers on motivational books and programs that offer endless variations on this simple theme in an effort to bolster …

When Winning Isn’T Everything: The Lawyer As Problem Solver, Carrie Menkel-Meadow Jan 2000

When Winning Isn’T Everything: The Lawyer As Problem Solver, Carrie Menkel-Meadow

Georgetown Law Faculty Publications and Other Works

Today I want to address the question of what the modern lawyer needs to know and what the modern lawyer must know how to do to be good at what he or she does, to be helpful to clients, to lead a fulfilling life, and hopefully, to leave the world a better place than he or she first found it. I went to law school to work on that illusive jurisprudential concept - justice. On the outside walls of the Edward Bennett Williams Library where I work in Washington, DC, is a quote, which we attribute to a former Georgetown …

Telling Stories In School: Using Case Studies And Stories To Teach Legal Ethics, Carrie Menkel-Meadow Jan 2000

Telling Stories In School: Using Case Studies And Stories To Teach Legal Ethics, Carrie Menkel-Meadow

Georgetown Law Faculty Publications and Other Works

In this Foreword I will explore why we use stories and case studies (and whether stories and case studies are equal to the task) to examine ethical and moral issues in the practice of law and provide an introduction to the interesting tales which will enfold in this Symposium issue. I conclude with some thoughts about how stories and cases should be used to teach legal ethics.

Defending Defending: The Case For Unmitigated Zeal On Behalf Of People Who Do Terrible Things, Abbe Smith Jan 2000

Defending Defending: The Case For Unmitigated Zeal On Behalf Of People Who Do Terrible Things, Abbe Smith

Georgetown Law Faculty Publications and Other Works

Although defending defending may be an endless pursuit, I cannot help taking it on. I am, after all, a defender myself, and defending fellow defenders seems to go with the territory. Of course, attacks on criminal defenders do not come out of nowhere - difficult and complex questions often arise in criminal defense work. Unfortunately, the questions that are raised in the aftermath of a high profile case such as the Abner Louima case are usually the easy ones - questions that have more to do with the nature of the adversarial system than with the values or ethics of …
