Kosovo And The Great Air Power Debate, Daniel L. Byman, Matthew C. Waxman Jan 2000

Kosovo And The Great Air Power Debate, Daniel L. Byman, Matthew C. Waxman

Faculty Scholarship

The following section provides an overview of how to think about air power and coercion, addressing several key limits of the current literature. We next examine NATO goals in Kosovo and the mixed success eventually achieved. Using that baseline, we explore various explanations for Belgrade's eventual capitulation and clarify how air power's role in each of them should be understood; we leave aside the issue of whether coercion was a proper strategy for addressing the Balkan crisis and focus instead on how to assess air power as a tool of that strategy. We conclude with recommendations for recasting the air …

Dignity And Victimhood, Kent Greenawalt Jan 2000

Dignity And Victimhood, Kent Greenawalt

Faculty Scholarship

If Sandy Kadish has reminded us of limitations of consequentialist approaches to the criminal law and has proposed persuasive resolutions of issues that deontological perspectives reveal, Meir Dan-Cohen has jarred us to rethink fundamental premises about rules in the criminal justice system. His Essay is an example of his ingenuity for unsettling understandings. The Essay reads easily and seems deceptively straightforward, but it is rich in nuance and its themes are complex. This Response identifies the various themes and evaluates their plausibility. I take Professor Dan-Cohen's Essay as a preliminary exploration of a major subject, and I have responded accordingly, …

A Philosophy Of Christian Librarianship, Gregory A. Smith Jan 2000

A Philosophy Of Christian Librarianship, Gregory A. Smith

The Christian Librarian

While a number of Christian librarians have explored the implications of the Christian world view for particular issues in library practice, few have attempted to develop a thoroughgoing philosophy of Christian librarians/zip. Those who have done so have generally failed to center their proposals around the Christian view of truth. The knowability, objectivity, unity, practicality, and spirituality of truth should impact the way librarians at Christian colleges carry out major library functions, including collection development, reference services, bibliographic instruction, research and publication, and management.

The Nature And Function Of Criminal Theory, George P. Fletcher Jan 2000

The Nature And Function Of Criminal Theory, George P. Fletcher

Faculty Scholarship

The practice of teaching and writing in the field of criminal law has changed dramatically in the last half-century. In the United States and England, and to a lesser extent in other English-speaking countries, we have witnessed a turn toward theoretical inquires of a greater depth and variety than had existed previously in the history of Anglo-American law. The subjects of this new literature include the nature and rationale of punishment; the theory of justification and of excuse, that is, of wrongdoing and responsibility; the relevance of consequences to the gravity of offenses (the problem of moral luck); and the …

(Baby) M Is For The Many Things: Why I Start With Baby M, Carol Sanger Jan 2000

(Baby) M Is For The Many Things: Why I Start With Baby M, Carol Sanger

Faculty Scholarship

For several years now I have begun my first-year contracts course with the 1988 New Jersey Supreme Court case In the Matter of Baby M. In this essay, I want to explain why. I offer the explanation in the spirit of modest proselytizing, recognizing that many of us already have a favored method or manner into the course: some introductory questions we pose before leaping into (or over) the introductions already provided by the editors of the many excellent casebooks available. But I have found that Baby M works extremely well in ways that others may want to consider. …

Perceptions Of Clinical Psychologists Relative To Other Mental Health Providers, Glenora Nelson Jan 2000

Perceptions Of Clinical Psychologists Relative To Other Mental Health Providers, Glenora Nelson

Psychology Theses & Dissertations

There is a myriad of job titles that exist within the mental health profession. Public perception about the differences between these professionals has been the focus of many studies and the results generally suggest that the public cannot clearly distinguish among these mental heath professionals. The present study is also concerned with perceptions about the various mental health professionals, in particular, perceptions of clinical psychologists relative to other professionals in this field. Undergraduate psychology students age 18–47 participated in a study of perceptions and attitudes about the qualifications and competence of clinical psychologists, professional counselors, psychiatrists and clinical social workers. …

Toward A Model Of Team Situation Awareness, Alexis Anne Fink Jan 2000

Toward A Model Of Team Situation Awareness, Alexis Anne Fink

Psychology Theses & Dissertations

Situation Awareness (SA) is a construct that is considered important to safety in dynamic, risky, time-constrained and complex environments, such as military aviation, nuclear reactors and emergency management. Research consideration of SA is complicated by the fact that there is no clearly superior methodology for SA measurement. Typically, SA is considered at the individual level; however, the nature of the SA context often requires more than one individual for safe and effective operations. Team SA is a qualitatively different phenomenon than individual SA. Few models of team SA have been proposed. The primary purpose of this paper was to develop …

Increasing Readiness To Change Among Smokers In A Primary Care Setting, Sheila F. Collicott Jan 2000

Increasing Readiness To Change Among Smokers In A Primary Care Setting, Sheila F. Collicott

Psychology Theses & Dissertations

This study compared the effectiveness of two brief interventions, direct advice and motivational interviewing, for increasing motivation to quit among male smokers in the pre-contemplation and contemplation stages of change who were primary care patients at an Eastern urban VA medical center. Contrary to expectations, participants receiving motivational interviews did not increase more in readiness to change, motivation, and actions to quit, than those receiving direct advice or a control conversation, nor did they smoke fewer cigarettes per day. As expected, contemplators reported more cutting down and quit attempts than pre-contemplators. Factors that may have limited the effectiveness of interventions …

The Brandeis Legacy, Mary Murphy Schroeder Jan 2000

The Brandeis Legacy, Mary Murphy Schroeder

San Diego Law Review

Louis Brandeis was the greatest lawyer of the early twentieth century, and perhaps of the entire century. He was brilliant, driven, charismatic, and absolutely devoted to improving the lives of the common people of the United States. Put in more contemporary terms, he was committed to the notion that technological and economic advances should not widen the gap between the haves and the have-nots. His causes were the environment, citizenship, freedom of expression, quality of life in the workplace, protection against increasing power wielded by large corporations, and protection of individual privacy. All were issues that emerged at the beginning …

Deontology At The Threshold, Larry Alexander Jan 2000

Deontology At The Threshold, Larry Alexander

San Diego Law Review

In his 1989 law review article, Torture and the Balance of Evils,' later republished as Chapter Seventeen in Placing Blame, Michael Moore declares himself to be a "threshold deontologist." What he means is this: There are some acts that are morally wrong despite producing a net positive balance of consequences; but if the positive balance of consequences becomes sufficiently great-especially if it does so by averting horrible consequences as opposed to merely making people quite well off-then one is morally permitted, and perhaps required, to engage in those acts that are otherwise morally prohibited. Thus, one may not kill or …

Unsafe Injections And The Transmission Of Hepatitis B And C In A Periurban Community In Pakistan, A J. Khan, S P. Luby, F Fikree, A Karim, S Obaid, S Dellawala, S Mirza, T Malik, S Fisher-Hoch, J B. Mccormick Jan 2000

Unsafe Injections And The Transmission Of Hepatitis B And C In A Periurban Community In Pakistan, A J. Khan, S P. Luby, F Fikree, A Karim, S Obaid, S Dellawala, S Mirza, T Malik, S Fisher-Hoch, J B. Mccormick

Community Health Sciences

Following reports of frequent deaths associated with jaundice and chronic liver disease among adults in a periurban community of Karachi, Pakistan, an investigation was conducted to evaluate the relationship between injections and viral hepatitis infections, to identify the reasons why patients received frequent injections, and to observe the injection practices employed in clinics. Two hundred and three adult patients were interviewed as they left each of the 18 area clinics. Practitioners were interviewed and three consecutive injections were observed at each clinic. Eighty-one per cent of patients received an injection on the day of the interview. Of the 135 patients …

The White Rose: Judges And Justice In The Third Reich, Matthew Lippman Jan 2000

The White Rose: Judges And Justice In The Third Reich, Matthew Lippman

Connecticut Journal of International Law

In recent years there has been an increased interest in the Holocaust.' One concern has been to explain the willingness of ordinary Germans2 and highly educated medical professionals' to conform to the draconian dictates of the Third Reich.4 This scholarly effort largely has ignored the complicity of lawyers and judges in the Nazi's depredations.5 The lack of academic concern may be based on the belief that the Reich was a "lawless" regime in which legal professionals performed a limited role. Most studies accordingly have centered on the extra-judicial and summary exterminations carried out by the Nazi government. 6 However, the …

The Efficacy Of Strasbourg Law, Mark Weston Janis Jan 2000

The Efficacy Of Strasbourg Law, Mark Weston Janis

Connecticut Journal of International Law

This article explores what we seem to know and what it might be useful to know about the efficacy of the 1950 European Convention for the Protection of Human Rights and Fundamental Freedoms.' It concludes that, though we know quite a lot of detail about compliance with Strasbourg law, we should be a little more careful about claiming too much success for the system. For an international legal system, Strasbourg law is, from what we can tell, remarkably efficacious, but it is far from (anything but relatively) perfect.

The Roles Of Motivation And Ability In Controlling The Consequences Of Stereotype Suppression, Na Wyer, Jw Sherman, Sj Stroessner Jan 2000

The Roles Of Motivation And Ability In Controlling The Consequences Of Stereotype Suppression, Na Wyer, Jw Sherman, Sj Stroessner

School of Psychology

Two experiments investigated the conditions under which previously suppressed stereotypes are applied in impression formation. In Experiment 1, the extent to which a previously suppressed racial stereotype influenced subsequent impressions depended on the race of the target who was subsequently encountered. Whereas impressions of race-unspecified targets were assimilated to the stereotype following its suppression, no such effects were observed when the target belonged to the racial group whose stereotype had been initially suppressed. These results demonstrate that when perceivers are motivated to avoid stereotyping individuals, the influence of a stereotype that has been previously activated through suppression is minimized. Experiment …

Integrating Spiritual Perspectives With The Law School Experience: An Essay And An Invitation, Lucia Ann Silecchia Jan 2000

Integrating Spiritual Perspectives With The Law School Experience: An Essay And An Invitation, Lucia Ann Silecchia

San Diego Law Review

This Essay will reflect on the ways in which the traditional life of law schools may be colored by a new emphasis on spirituality. 10 This Essay will not delve into an extensive theological thesis about the definition of spirituality or the practical and philosophical nuances of the spiritual life. Rather, the pages that follow are an invitation to begin a discussion of spirituality within the life of American law schools. This Essay begins with a discussion of spirituality in professional life generally. It will become apparent very quickly that there are difficulties in defining what spirituality is and in …

The 1960 Presidential Election In Florida: Did The Space Race And The National Prestige Issue Play An Important Role?, Randy Wade Babish Jan 2000

The 1960 Presidential Election In Florida: Did The Space Race And The National Prestige Issue Play An Important Role?, Randy Wade Babish

UNF Graduate Theses and Dissertations

The landmark launch of Sputnik on October 4, 1957, and the subsequent perception that the United States trailed the Soviet Union, not only in space but also in missiles, plagued the Eisenhower Administration for the rest of the decade. The Democratic Party strategy for the 1960 presidential election included using the space race, the alleged missile gap, and declining American prestige abroad to illustrate the need for new leadership in the White House. Senator John F. Kennedy, the Democratic nominee, effectively raised these issues throughout the general election to support his "New Frontier" program and won by the narrowest popular …

Death Anxiety In Young Adults: The Predictive Role Of Gender And Psychological Seperation From Parents, Kimberly Dehate Chelgren Jan 2000

Death Anxiety In Young Adults: The Predictive Role Of Gender And Psychological Seperation From Parents, Kimberly Dehate Chelgren

UNF Graduate Theses and Dissertations

This study examined the predictive role of gender and psychological separation in the death anxiety of young adults. A total death anxiety score and eight psychological dependency scores, four for mom and four for dad, were obtained from male and female participants between the ages of 17 and 26 years old. Females were found to have significantly higher total death anxiety than were males. Females also had significantly higher emotional dependency on mom than did males. Regression analysis revealed that gender and emotional dependency on mom account for 14% of the variance in total death anxiety. Additional results with males …

Individual Differences In Cognitive Performance Relating To Non-Pathological Sleep Parameters In The Presence Of A Stressor, Theresa Marie Lagman Jan 2000

Individual Differences In Cognitive Performance Relating To Non-Pathological Sleep Parameters In The Presence Of A Stressor, Theresa Marie Lagman

UNF Graduate Theses and Dissertations

Non-pathological sleep parameters in relation to cognition among individuals who do not qualify as having sleep disorders or who are not subjected to extended periods of total sleep deprivation have not been adequately investigated in previous studies. The current study investigates the influence of circadian typology (morning-type vs. evening-type individuals), time of session (AM vs. PM), habitual sleep practices (sleep hygiene), sleep quality, life stress, and the presence of an acute stressor on sustained attention, memory, and mental rotation performance. Several main effects emerged for individual variables above; however, the data failed to reveal significant interactions among these variables. The …
