Cultivating The Genetic Commons: Imperfect Patent Protection And The Network Model Of Innovation, Jonathan M. Barnett

San Diego Law Review

This Article enters this debate and argues the following position. Assuming that antitrust authorities persist in certain strategies to impede patent consolidation, the recent introduction of patent rights for certain biotechnological innovations is likely to encourage private investment in the genetic commons and reduce (or, at least, not enhance) the accessibility costs that could stunt technological advance. To reach this conclusion, this Article shows that the two leading theories of patent protection, the "incentive" theory7 and the "prospect" theory,8 do not explain private industry's willingness to sink significant investment capital into highly uncertain biopharmaceutical projects. The legal malpractice tort, however, has managed to withstand the winds of legal change. Particularly crucial has been the refusal to apply alternative causation doctrines. The refusal to apply causation doctrines that have been embraced in other areas has significant social effects. As a result, the consumers of legal services receive less protection from the courts than do the consumers of products or medical services.

Fecundity Of Litopenaeus Setiferus, Farfantepenaeus Aztecus And F. Duorarum, In The Southwestern Gulf Of Mexico, Martin Perez Velazquez, Adolfo Gracia

Gulf and Caribbean Research

Fecundity of white shrimp, Litopenaeus setiferus, brown shrimp, Farfantepenaeus aztecus, and pink shrimp F. duorarum and relationships to gonad weights and total and carapace length were estimated. Ovigerous females were collected in the southern Gulf of Mexico in February, May, August and November 1993. Fecundity was estimated by means of a gravimetric method. The equations relating fecundity to total weight and fecundity to gonad weight were linear in the 3 species. However, an exponential relationship was found between fecundity and carapace length in L. setiferus and F. aztecus. Of the relationships examined, gonad weight was considered a …

Stomach contents analysis was used to quantitatively describe the diets of juvenile lane snapper, Lutjanus synagris, and juvenile gray snapper, Lutjanus griseus, from the northern Gulf of Mexico. Juvenile snapper were collected by trawling at two estuarine, deep channel sites in Mississippi coastal waters from September 1996 to January 1997. Lane snapper (n = 53) and gray snapper (n = 12) both consumed a variety of prey organisms, but primary prey were amphipods, decapods (shrimp and crabs), and fishes. In the course of reaching its substantive conclusions, this article seeks to shed light on the theoretical and methodological requisites of a valid and fruitful application of literary sources in jurisprudence.

The article begins by explicating the original literary image of the pursuit of the hunt interrupted, within its thematic setting in Aeschylus. It then offers theoretical and methodological postulates for drawing out the fuller meaning for law and legal studies of the image. It explores variations on the same pattern of imagery in subsequent works of Western literature, and offers reflections on how these variations can enrich our understanding …

The slime mold Dictyostelium mucoroides is an effective model for studying eukaryotic development because it exists as both unicellular and multicellular entities depending on the stage of their life cycle. Development is regulated by a number of proteins. During the transition from single amebas to a multicellular entity, developmentally regulated proteins appear. In the case of the microcysts, produced during sexual reproduction, proteins not only function in the formation of the cell walls, but also aid in the fusion of gametes, selective phagocytosis, cell to cell contact, and make up lysosomal enzymes. In this Article, I will bring into view the family, or more explicitly, the dependency hidden within the assumed family. Policy development and social theory considerations should center on assessing the appropriateness of the aspirations and expectations we have for the family. This assessment is crucial to one of the most compelling problems facing society at the end of the Twentieth Century-the increasing inequitable and unequal distribution of societal resources and the corresponding poverty of women and children.

Synthesis, Characterization And Catalytic And Biological Activity Of New Manganase(Ii) Carboxylate Complexes, Vanessa Leon Salvadores

The aim of this work was to prepare a series of novel carboxylate and dicarboxylate complexes of manganese(II), to study their spectroscopic and physicochemical properties and where possible to fully structurally characterized them by X-ray crystallography. The catalytic and biological properties of the new compounds were also examined. Four new manganese(II) aliphatic dicarboxylate complexes of general formula [Mm(O2C-R-CO2)].xH2){R=CH2, (CH2)8,CH2-C(CH3)2-CH2and CH2-CH2-C(CH3)2, x=0-2} were synthesized by ligand exchange reactions between manganese (II) acetate and the appropriate dicarboxylic acids. The question and theme of the poetry of life reaches deep into the essential questions of human existence. In the sense that poetry is the central core of literature, it is essential to the meaning of our lives. This question does not necessarily place human life, nor indeed biological life at the center of inquiry. The focus of the work is to learn basic and advanced techniques in the preparation of plant and animal tissue for both the TEM and SEM. Techniques used would include fixation, critical point drying, heavy metal coating, and photography of the SEM samples as well as negative staining and shadowing for the TEM samples (e.g. collagen, bacteria). Electron microscopy work leads to exciting discovery about plant and animal tissues which would otherwise be beyond our sight. The basic motivation behind this project is a highly accurate representation of the human iris, to be injected into a virtual model of the human eyeball. A highly accurate brightness level recording can be easily obtained with a high quality digital camera. Color, however, is an entirely different matter. Photography in the traditional sense entertains all sorts of color inaccuracies, mostly related to the chemical process of development. Digital photography presents gamma and metameric problems, since the exact conditions of the capturing event cannot easily be duplicated.
