The Epistemic Contract Of Bisexual Erasure, Kenji Yoshino

In this article, Professor Kenji Yoshino seeks to explain why the category of bisexuality has been erased in contemporary American political and legal discourse. He first argues that the invisibility of bisexuality relative to homosexuality does not reflect the incidences of those orientations in the population. Defining bisexuality as the possession of more than incidental desire for both sexes, Yoshino shows that the major sexuality studies demonstrate that the incidence of bisexuality is in fact greater than or comparable to the incidence of homosexuality. Yoshino explains the erasure of bisexuality by positing that both self-identified heterosexuals and self-identified homosexuals have …

Professor Post does a thoroughly convincing job of showing how unhelpful the picture of equality as sameness has been. He urges on us an approach in which, rather than pretending that difference does not exist, we take on, in part through legal action, the social reshaping of identities. The cases he explores center on gender, though he makes important observations along the way about race; but the conclusion he wants to draw applies to both of them, and to other forms of identity, such as sexual orientation and disability as well. In contrast to Americans, there is a paucity of interest in economic theory among continental scholars. One view is that the explanation lies in another aspect of the civil versus common law distinction - a difference in the mode of reasoning which makes the formalism of certain kinds of economic theory more congenial to common law lawyers than to their civil counterparts. If this is true - if economic analysis appeals to American lawyers partly because of its kinship to common law methodology - then there are several implications for law and economics. This Article is part of a larger intellectual project to encourage a shift in-or at least a broadening of-our conceptualization of discrimination. With this Article, I hope to expand our notion of what it means to be a perpetrator of discrimination. Typically, we define a perpetrator of discrimination as someone who acts intentionally to bring about some discriminatory result. This is a narrow and politically palatable conception. Those of us who unquestionably accept the racial, gender, and heterosexual privileges we have, and those of us who fail to acknowledge our victimless status vis-i-vis racism, sexism, and homophobia, are also perpetrators …

Objectives: To compare the rates of domestic violence reported by mothers with those identified by physicians, to compare the rates of harsh discipline practices reported by mothers with the rates of abuse identified by physicians, and to examine the relationship between reported domestic violence and harsh discipline practices.
Design: Interviews with parents and pediatricians to compare pediatric detection of domestic violence and child abuse with parental reports of domestic violence and harsh discipline practices.
Setting: Community-based pediatric practices in the 13-town greater New Haven, Conn, area.

Electroporation Dynamics In Biological Cells Subjected To Ultrafast Electrical Pulses: A Numerical Simulation Study, R. P. Joshi, K. H. Schoenbach

A model analysis of electroporation dynamics in biological cells has been carried out based on the Smoluchowski equation. Results of the cellular response to short, electric pulses are presented, taking account of the growth and resealing dynamics of transient aqueous pores. It is shown that the application of large voltages alone may not be sufficient to cause irreversible breakdown, if the time duration is too short. Failure to cause irreversible damage at small pulse widths could be attributed to the time inadequacy for pores to grow and expand beyond a critical threshold radius.
