Speaking Law To Power: Popular Sovereignty, Human Rights, And The New International Order, Paul W. Kahn

Chicago Journal of International Law

Hegemony is a concept of political power. It speaks to a global order structured by asymmetries of power. Modern law, in contrast, begins with an idea of equality among subjects. For domestic law, this is an equality among individuals; for international law, it is an equality among states. Legal outcomes are determined by identifying claims of right, not by measuring assertions of power. In the domestic order, we understand law by contrasting it with politics; we speak of the courts as the nonpolitical branch of government. Similarly, international institutions with legal responsibilities distinguish themselves from political decision-makers. The Security Council …

Sheriff Or Prisoner? The United States And The World Trade Organization, Paul B. Stephan

To understand these claims about U.S. hegemony, we need some perspective. I would like to compare two competing accounts of the U.S. role in the global economy. In one version, the United States has built an international system that replicates its ideology, culture and values. This is a unipolar world where a broad range of fundamental choices about political and economic structure reflect Washington's preferences. The United States may not make every meaningful decision in administering the world economy, any more than the headquarters of a multinational corporation dictates precisely what its local managers must do. This Article explores the relationship between the institutions of civil society and our government. Although it is said that the institutions of civil society can act as a check on government power, this Article explores the paradox implicit in that notion: the boundaries of these institutions are defined by the government directly or indirectly. The Moral Exclusivity Of The New Civil Society, Dorothy E. Roberts

Chicago-Kent Law Review

While commending civil society revivalists' commitment to freedom and equality, this Article argues that the revivalists' moral vision is marred by exclusivity. Roberts locates this moral exclusivity in a flawed account of the relationship between social inequality and moral decline. By discounting the importance of social justice for creating civic faith, involvement, and solidarity, the revivalists' proposals tend to benefit society's most privileged families.

Feeding Habits Of Young-Of-Year Striped Bass, Morone Saxatilis, And White Perch, Morone Americana, In Lower James River, Va, Paul J. Rudershausen, Joseph G. Loesch

Virginia Journal of Science

A total of 188 young-of-year (YOY) striped bass, Morone saxatilis, and 199 YOY white perch, Morone americana, were collected by pushnet, seine and trawl during 24-hour periods from June through August, 1992 in lower James River, Virginia. The purpose was to identify prey and temporal and spatial feeding habits. Copepods were the most numerous prey of both species. Fishes and mysids comprised the largest volumetric percentage of diets of striped bass and white perch, respectively. Using an index of relative importance, leptodorids and copepods were the most important prey of striped bass and white perch, respectively. Both species …

Civic societarians view deviance from the traditional two-parent family as the root of all social problems in the United States. Growing income inequality is central to understanding social decline as many families with young children are struggling financially to provide for their families. The real problem, then, is not with family form, but with the lack of support for dependency relationships.

Some critics have charged the Council on Civil Society with longing for a society that excludes entire categories of persons from membership, with being blind to "abuse and violence" within marriage, and being blasé about growing social and economic inequalities. This Article responds to these and other critiques from McClain and Fleming, Fineman, and Roberts by arguing that A Call to Civil Society clearly demonstrates not only a commitment to the morality and dignity of all human persons, but also a prohibition against any institution that promotes "invidious distinctions between men and women." Mental Health Parity: National And State Perspectives 2000: A Report To The Florida Legislature, Bruce Lubotsky Levin, Ardis Hanson, Richard D. Coe, Sara A. Kuppin

By failing to appropriately treat adults and children with severe mental illness, we incur enormous social costs through payments for disability benefits (Medicaid, SSI, SSDI), increased medical expenses, accidents and suicides, avoidable criminal justice proceedings, lost productivity, and increased need for homeless shelters and services. People who are underinsured are forced by arbitrary caps and limits to increasingly rely on the public sector. By providing parity for mental health, Florida will bring mental health into the mainstream of health care and become a leader in dispelling the prejudice that surrounds treatment of persons with severe mental illness.

Satellite Observation Of El Niño Effects On Amazon Forest Phenology And Productivity, Gregory P. Asner, Alan R. Townsend, Rob Braswell

Earth Sciences

Climate variability may affect the functioning of Amazon moist tropical forests, and recent modeling analyses suggest that the carbon dynamics of the region vary interannually in response to precipitation and temperature anomalies. However, due to persistent orbital and atmospheric artifacts in the satellite record, remote sensing observations have not provided quantitative evidence that climate variation affects Amazon forest phenology or productivity. We developed a method to minimize and quantify non-biological artifacts in NOAA AVHRR satellite data, providing a record of estimated forest phenological variation from 1982–1993. The seasonal NDVI amplitude (a proxy for phenology) increased throughout much of the basin …
