Just after 9 p.m., I climbed abroad a Continental Trailways bus and stared through green glass as my parents watched the second of their two sons head off to college. Leaving the station, the bus moved into the bayous of south Louisiana along old Highway 90, then over the swamps and across rice and sugar cane fields and on through a night of small towns, finally climbing the Sabine River bridge into Texas, where a mileage marker announced New Mexico 878 miles. That should give any young man enough room.

Real learning gets to the heart of what it means to be human. Through learning we recreate ourselves. Through learning we become able to do something we never were able to do. Through learning we reperceive the world and our relationship to it. Through learning we extend our capacity to create, to be part of the generative process of life.

When faculty and administrators confront challenges of student persistence rates, cross-disciplinary learning, faculty roles and rewards, student needs for professional and civic education, they often look for "solutions" through curricular innovation. Learning communities, although …

Constituting Civil Society: School Vouchers, Religious Nonprofit Organizations, And Liberal Public Values, Stephen Macedo
Chicago-Kent Law Review
The renewed interest in civil society has given rise to a number of constitutional, political, and moral concerns. Critics of "civil society revivalism" worry that relying on local communities and institutions could come at the expense of overarching constitutional ideals of liberal justice. While some argue, for example, that channeling public monies to religious and other private schools would help invigorate the educational influence of families, churches and other communities in civil society, others argue that the flow of public funds to sectarian schools will undermine the public institutions that support citizenship and children's freedom. While acknowledging that there are …
The New Establishmentarianism, Michael W. Mcconnell
The New Establishmentarianism, Michael W. Mcconnell
Chicago-Kent Law Review
This Article responds to the notion that government should identify and enforce a set of common beliefs and values, which McConnell calls "establishmentarianism." McConnell argues that establishmentarianism is inferior to the view that the values of society must emerge from the free institutions of civil society (liberalism). In doing so, McConnell explores the irony that modern insistence on diversity can go beyond mere tolerance of dissenting viewpoints and undermine the diversity and pluralism of society as a whole. Pluralism consists of a variety of different groups; an insistence on pluralism within groups has a homogenizing effect. Specifically, the Article addresses …
Conscientiousness And The Prediction Of Task Duration: Evidence Of The Role Of Personality In Time Prediction, William Ernest Kelly
Conscientiousness And The Prediction Of Task Duration: Evidence Of The Role Of Personality In Time Prediction, William Ernest Kelly
Doctoral Dissertations
Accuracy in predicting the duration necessary to complete a task is an important dimension of daily fife. There exists a large degree of variation in an individual's accuracy in predicting task duration. One domain suggested to influence accuracy of predicting duration is that of personality factors and individual differences. Empirical and theoretical links were found in the literature between the personality factor conscientiousness, of the Five Factor Model of Personality, anxiety, and predicting task duration. The purpose of this dissertation was to empirically examine the role of conscientiousness and anxiety in the accurate prediction of task duration. Ninety-five undergraduate students …

Silence And Silencing: Their Centripetal And Centrifugal Forces In Legal Communication, Pedagogy And Discourse, Margaret E. Montoya
Silence And Silencing: Their Centripetal And Centrifugal Forces In Legal Communication, Pedagogy And Discourse, Margaret E. Montoya
University of Michigan Journal of Law Reform
Language and voice have been subjects of great interest to scholars working in the areas of Critical Race Theory and Latina/o Critical Legal Theory. Silence, a counterpart of voice, has not, however, been well theorized. This Article is an invitation to attend to silence and silencing. The first part of the Article argues that one's use of silence is an aspect of communication that, like accents, is related to one's culture and may correlate with one's racial identity. The second part of the Article posits that silence can be a force that disrupts the dominant discourse within the law school …

Franco's Spain, Queer Nation?, Gema Pérez-Sánchez
University of Michigan Journal of Law Reform
This Article discusses how, through its juridical apparatus, the Spanish dictatorship of Francisco Franco sought to define and to contain homosexuality, followed by examples of how underground queer activism contested homophobic laws. The Article concludes by analyzing a literary work to illustrate the social impact of Francoism's homophobic law against homosexuality.

Fear Of Law: Thoughts On Fear Of Judging And The State Of The Federal Sentencing Guidelines (Sentencing Symposium), Frank O. Bowman Iii
Faculty Publications
To understand Fear of Judging and the debate over the Federal Sentencing Guidelines requires some familiarity with the sentencing reform movement that led to the adoption of the Federal Sentencing Guidelines in 1987, as well as at least a rudimentary grasp of the structure of the Guidelines themselves. For those readers who require an introduction to both subjects, the next section of this Article attempts to provide one. Those already familiar with the Guidelines and their history can skip to Section III, where the discussion of Fear of Judging begins in earnest.
Bottom Line Feminist Theory: The Dream Of A Common Language, Barbara Stark
Bottom Line Feminist Theory: The Dream Of A Common Language, Barbara Stark
Hofstra Law Faculty Scholarship
Feminists working in the law need theory. First, we need theory as an intellectual tool, to critique the ways in which existing laws, as well as proposed reforms, perpetuate gendered norms. As Catharine MacKinnon insists, "Theory is not a luxury .... We need to analyze critically and systematically create new approaches together." Second, but equally important, feminists need theory as a political tool, to identify common goals and to generate consensus about how to achieve them. As Angela Harris reminds us, "Even a jurisprudence based on multiple consciousness must categorize; without categorization each individual is ... isolated ... and there …

Factor Analysis Of Theological Constructs Related To Fatalism And Free Will, M. Ardell Broadbent
Issues in Religion and Psychotherapy
A questionnaire was used to determine to what degree members of the Church of Jesus Christ of Latter-day Saints endorse doctrinal statements concerning foreknowldge and determinism. A factor analysis of the questionnaire results confirmed lay constructs about an apparent polarization between members who hold strictly literal interpretations of omniscience and omnipotence as opposed to those who hold interpretations further removed from mainstream Christendom but whose positions are validated by LDS doctrine. The relation of demographic variables to the constructs was explored. The existence of simultaneously held conflicting beliefs was confirmed. Some implications for LDS therapists are discussed. A historical overview …

A Case Study Of The Effects Of The Strategic Planning Process On The Trust Level Of Administrative Staff In A K - 12 School District, Michael F. Paskewicz
A Case Study Of The Effects Of The Strategic Planning Process On The Trust Level Of Administrative Staff In A K - 12 School District, Michael F. Paskewicz
Dissertations
Strategic planning is a process that has been used in the business world since the 1960s as a tool to build employee trust through the development of a shared vision and goals. Public education and other government agencies began to use the strategic planning process in the mid 1970s (Herman, 1994).
The study used data collected by a K-12 school district, two years into the strategic planning process. This study sought to determine if the trust level of administrators would be impacted by the level of participation in the strategic planning process. Trust level was defined by self rating by …

Implementation Of Empirically Validated Interventions In Managed Care Settings: The Premarital Relationship Enhancement Program (Prep), Kieran T. Sullivan, Dalia Goldschmidt
Implementation Of Empirically Validated Interventions In Managed Care Settings: The Premarital Relationship Enhancement Program (Prep), Kieran T. Sullivan, Dalia Goldschmidt
Psychology
In an age of managed care, how does the clinician best help couples in marital distress? Do the short-term protocols developed and tested in the laboratory really work in the average clinical setting? This project examined the feasibility and effectiveness of implementing a laboratory-based program designed to prevent the development of relationship distress within a health maintenance organization. Both men and women reported high satisfaction with the program and a subjective sense that it was helpful for their relationships. Specific suggestions are made for assisting therapists in using effective treatments for couples in managed care settings.

Alcohol Intake And Mortality: Findings From The National Health Interview Surveys (1988 And 1990), Youlian Liao, Daniel L. Mcgee, Guichan Cao, Richard S. Cooper
Faculty Publications
The authors used prospective data from two supplemental studies of the National Health Interview Survey, the 1988 Alcohol Supplement and the 1990 Health Promotion and Disease Prevention Supplement, to examine the relation between alcohol intake and mortality. Their study included 17,821 men and 25,874 women aged 40 years or older at baseline; during an average of 6 years of follow-up, 5,540 deaths occurred. The alcohol-mortality relation was U-shaped for men and J-shaped for women. On the basis of categorical analyses adjusted for age, race, smoking, and baseline diseases, men who drank 2 drinks per day had a significantly lower risk …
