The 1960 Presidential Election In Florida: Did The Space Race And The National Prestige Issue Play An Important Role?, Randy Wade Babish
UNF Graduate Theses and Dissertations
The landmark launch of Sputnik on October 4, 1957, and the subsequent perception that the United States trailed the Soviet Union, not only in space but also in missiles, plagued the Eisenhower Administration for the rest of the decade. The Democratic Party strategy for the 1960 presidential election included using the space race, the alleged missile gap, and declining American prestige abroad to illustrate the need for new leadership in the White House. Senator John F. Kennedy, the Democratic nominee, effectively raised these issues throughout the general election to support his "New Frontier" program and won by the narrowest popular …
Understanding Internet Co-Branding Deals, Eric Goldman, Candice Lee
Understanding Internet Co-Branding Deals, Eric Goldman, Candice Lee
Faculty Publications
The Internet has spawned new business practices regarding the ways users access and obtain information and services. Because linking can create a network of web pages that appear integrated and seamless to users, many Internet companies enter what are known as co-branding relationships. This article addresses a common type of co-branding relationship in which a "provider" maintains a set of pages ("the co-branded site") that looks and feels like the "brander's" web site. The co-branded site is promoted on the brander's web site through linking.

Introduction: Tiger Woods And The First Amendment, Tyler T. Ochoa

Although the right of publicity has been recognized as a distinct common-law doctrine since 1953, only in recent years have courts begun to take the First Amendment seriously as a limit on the extent to which sports figures and other celebrities can use the doctrine to control the use of their images. It is widely recognized that the government may prohibit false and misleading speech, such as an advertisement that falsely implies an endorsement of a product by an individual, without violating the First Amendment. Similarly, it is generally acknowledged that the First Amendment protects the depiction of celebrities in …

Law, Ethics, And The Good Samaritan: Should There Be A Duty To Rescue?, Kathleen M. Ridolfi

The interdependence of law and morality, the circular influences of one on the other, puts us in a position to fear what we want the law to do. We embrace a legal system that promotes morality, that makes better citizens of us, but we worry that the law will cross an elusive line and infringe on individual rights. For this reason we are careful, and should remain so, in limiting enforcement of laws to reflect only those values that emerge from the overall agreement of the community where they will be enforced.
In this paper, I have focused primarily on …

Maternal-Infant Nurses' Knowledge Of Breast Feeding, Wendy S. Kershner
Maternal-Infant Nurses' Knowledge Of Breast Feeding, Wendy S. Kershner
Masters Theses
This study explored the level of knowledge related to breastfeeding among maternal-infant nurses. It also explored whether there was a relationship between nurses' breastfeeding knowledge and level of education, type of clinical experience, years of experience and personal experience with breastfeeding.
A convenience sample of 67 maternal-infant nurses completed a modified version of Leadley's (1994) Breastfeeding Knowledge and Attitudes Survey.
Descriptive and correlational statistics were used to analyze the relationship between the variables and the nurse's breastfeeding knowledge. Data analysis revealed a mean score of 13.2 out of 20 questions on nurses' breastfeeding knowledge. There was no significant difference in …
The Frequency Of Breast Self-Examination In Women Who Participated In The Breast Cancer Prevention Trial, Kelly J. Moore
The Frequency Of Breast Self-Examination In Women Who Participated In The Breast Cancer Prevention Trial, Kelly J. Moore
Masters Theses
This study used the Health Belief Model (HBM) to examine attitudes about breast health among women who had participated in the Breast Cancer Prevention Trial. More specifically, the purpose of this study was to identify the relationship between the HBM variables and the frequency of breast self-examination (BSE). A convenience sample of 80 women completed Champion’s (1993) HBM questionnaire.
It was hypothesized that the HBM concepts would significantly correlate with the frequency of BSE. However, only two significant correlations were found: a positive correlation between the frequency of BSE and perceived benefits (r=.37; p=.000) and a negative correlation between the …
The Effectiveness Of An Education Intervention Related To Knowledge Increase Among Adolescents Regarding Dietary Calcium And Prevention Of Osteoporosis, Deborah K. Fast
The Effectiveness Of An Education Intervention Related To Knowledge Increase Among Adolescents Regarding Dietary Calcium And Prevention Of Osteoporosis, Deborah K. Fast
Masters Theses
The purpose of this study was to assess the effectiveness of an educational intervention for 6th - 11th grade adolescents regarding dietary calcium and the prevention of osteoporosis. This was a secondary analysis of data from a study that used a pre-experimental pre-test-post-test; no control group design. Eighty-two boys and 102 girls completed the Healthy Bones Knowledge Questionnaire (HBKQ) as a pretest, received an educational intervention based primarily on dietary calcium intake, then completed the questionnaire again as a post-test.
As a group, the students demonstrated a significant increase in correct answers to calcium-related HBKQ items (t = 3.31, p …
Relationship Of Osteoporosis Knowledge And Perceived Susceptibility To Osteoporosis Among Hispanic Women, Johannie M. Troncoso
Relationship Of Osteoporosis Knowledge And Perceived Susceptibility To Osteoporosis Among Hispanic Women, Johannie M. Troncoso
Masters Theses
The purpose of this descriptive study was to examine the relationship of osteoporosis knowledge to perceived susceptibility to osteoporosis among Hispanic women. The Health Belief Model (Rosenstock, Strecker, & Becker, 1994) was the theoretical framework for the study. Data were collected from a convenience sample of 54 Hispanic women, ages 18 years and older, from two different areas in a Mid-Western state. The final sample, based on the inclusion criteria, constituted 41 subjects. The participants completed the Osteoporosis Knowledge Test (OKT) developed by Kim, Horan, and Gendler (1991) and the Osteoporosis Health Belief Scale (OHBS) also developed in 1991 by …

World Music On A U.S. Stage: A Berne/Trips And Economic Analysis Of The Fairness In Music Licensing Act, Laurence R. Helfer
Faculty Scholarship
This article analyzes the dispute settlement proceedings pending before the World Trade Organization (WTO) concerning the Fairness in Music License Act of 1998, a new provision of the US Copyright Act that exempts many bars, restaurants, and retail stores from paying license fees for performing broadcast music in their establishments. In May 1999, the European Community challenged the Act, and its predecessor "homestyle exemption," as a violation of the Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPs) and the Berne Convention for the Protection of Literary and Artistic Works (Berne). The FMLA dispute is the first time in …
A Traditional Lakota Zoological Folk Taxonomy : An In Depth Study Of Biological And Cosmological Views Of Animal Classification And Nomenclature Among The Lakota, Gerald R. Scott
Honors Capstones
The focus of this work is to record and clarify the traditional views of the Lakota People, in regards to how they name and classify their zoological world. The focus for many ethnozoologists is to study how mankind conceptualizes his natural environment. A number of scholars in ethnozoology have tried to show cross cultural links to possibly explain similarities in the way mankind names and classifies objects in his natural environment. The idea of there being recognizable groupings of animals is found in all languages. These are referred to as ethnozoological categories. According to some scholars (Berlin, Breedlove, and Raven …
Project Iris: Image Reconstruction Of The Iris Spectrally, Joseph Unander
Project Iris: Image Reconstruction Of The Iris Spectrally, Joseph Unander
Theses
The basic motivation behind this project is a highly accurate representation of the human iris, to be injected into a virtual model of the human eyeball. A highly accurate brightness level recording can be easily obtained with a high quality digital camera. Color, however, is an entirely different matter. Photography in the traditional sense entertains all sorts of color inaccuracies, mostly related to the chemical process of development. Digital photography presents gamma and metameric problems, since the exact conditions of the capturing event cannot easily be duplicated. However, the spectral radiance of an object can be captured, utilizing a spectrophotometer …

Field Evaluation Of Ultrasound Enhancement Of Permeable Treatment Walls, Aamod Sudhakar Sonawane
Field Evaluation Of Ultrasound Enhancement Of Permeable Treatment Walls, Aamod Sudhakar Sonawane
Retrospective Theses and Dissertations
The objective of this research was to demonstrate the application of ultrasound to field sites having problems with precipitation build up and corrosion. PTW s are passive reactive walls containing zero-valent iron metal for in-situ remediation of contaminated groundwater. However, loss of reactivity over time due to build up of corrosion and other precipitates on the iron surface is a major concern. Ultrasound energy has been established as an effective tool for revitalizing iron surface. This research applied ultrasound energy to a zero-valent iron wall constructed below the ground surface to remove precipitates and iron corrosion, increasing iron reactivity. Two …

The Effect Of Feedback At Test On Source Memory Performance, Shelby Kainani Morita
The Effect Of Feedback At Test On Source Memory Performance, Shelby Kainani Morita
UNLV Retrospective Theses & Dissertations
Previous research has demonstrated that witnesses can come to believe they saw details that were only suggested to them after the witnessed event. For both theoretical and practical reasons, there is interest in developing techniques that reduce the effect of misleading post-event information. The present study examined the effect of receiving feedback at the time of retrieval on eyewitness suggestibility. All participants watched a videotaped crime of a home burglary and then answered questions that contained misleading information. On a final source memory test, participants that were provided with feedback as to the accuracy of their attributions during the first …

Traditional Vs Nontraditional Gendered Roles In Instant Relay Chat, Jennifer Audrey Del Quadro
UNLV Retrospective Theses & Dissertations
Communication technology, such as the Internet, reflects social norms in society, including gender roles. The author explored traditional and nontraditional gender roles in Instant Relay Chat (IRC) rooms. This quantitative study tested five hypotheses: H1: Participants who portray themselves as women tend to use more supportive language than men in IRC; H2: Participants who portray themselves as women tend to use more attenuated language than men in IRC; H3: Participants who portray themselves as women tend to use more graphic accents (GA) than men in IRC; H4: Participants who portray themselves as men tend to use more challenging language than …
Africanized Honey Bee Colonization In The Human Domain: Issues Of Environmental Anthropology In Southern Nevada, Daniel Edward Lebas
Africanized Honey Bee Colonization In The Human Domain: Issues Of Environmental Anthropology In Southern Nevada, Daniel Edward Lebas
UNLV Retrospective Theses & Dissertations
Environmental anthropology seeks to identify issues and propose resolutions when humans are directly affected by environmental consequences or indirectly by policies that may marginalize the concerns of certain populations. Africanized Honey Bees created both environmental and policy consequences in southern Nevada. Identification of the issues was accomplished with literature review, participant observation, informal interview, and conferencing with academic and agency officials related to the human/bee problem. The controversy in risk assessment has implications for urban residents in southern Nevada. Both agricultural and urban environments may be economically and politically impacted by the colonization of feral Africanized Honey Bees. Urban populations …

Gis-Based Evaluation Of Mid-Block Pedestrian Crossing Safety, Zhenzhong Cui
UNLV Retrospective Theses & Dissertations
Transportation related problems have become one of the most pressing and visible concerns of urban life. One major aspect of safety relates to pedestrian crossings, especially pedestrian crossings away from an intersection i.e. at mid-block locations. There is need to develop a program to address mid-block pedestrian crashes (MBPC) to better understand them. This thesis describes the development of set of tools designed to help better understand MBPCs. Included are general statistical methods, GIS database, and visualization interface software; This thesis evaluates the potential of spatial clustering techniques and nearest neighbor methods to identify areas where high concentrations of mid-block …
Tomorrow Never Dies: The Protection Of Fictional Characters Under The Federal Trademark Dilution Act, Kristen Knudsen
Tomorrow Never Dies: The Protection Of Fictional Characters Under The Federal Trademark Dilution Act, Kristen Knudsen
Vanderbilt Journal of Entertainment & Technology Law
A number of different protections are available for fictional characters under intellectual property law. These have traditionally included copyright, trademark, and unfair competition, or some combination thereof. Another avenue of protection can be found in state dilution statutes, which prohibit unauthorized uses of characters that could harm their reputations, such as by "blurring" their ability to indicate one source, or by "tarnishing" their commercial value. This harm may occur even where there is no likelihood of public confusion, and even where the use is on a noncompeting good. Many commentators have criticized state dilution theories, however, as contravening the purposes …
Pay For Play: An Old Tactic In A New Environment, Douglas Abell
Pay For Play: An Old Tactic In A New Environment, Douglas Abell
Vanderbilt Journal of Entertainment & Technology Law
Promotional strategies involving payola --the payment of cash, drugs, or any other consideration to radio stations and their employees in exchange for airplay-- are generally illegal under federal law. Theoretically, these laws prohibit only undisclosed payola practices. Payola scandals of the late 1980s, however, illustrate that such practices have not ended. In fact, the Telecommunications Act of 1996 (the "Act") created an environment in which pay-for-play, a disclosed and fully legal form of payola, could thrive. The possibility of returning to practices reminiscent of illegal payola has, however, sparked debate as to whether record labels should ever pay radio stations …

The Changing Role Of Agents In Professional Basketball, Bappa Mukherji
Vanderbilt Journal of Entertainment & Technology Law
This Article will discuss the status of agents for NBA players after the adoption of the new collective bargaining agreement (the "1999 Agreement"). First, this Article will summarize the relevant provisions of the prior collective bargaining agreement (the "1996 Agreement") and illustrate how application of these provisions led the owners to declare a lockout. Next, it will review key provisions of the 1999 Agreement. It will conclude by discussing how the new CBA and the recent consolidation in the sports representation business will affect agents.
Fighting The Phantom Menace: The Motion Picture Industry's Struggle To Protect Itself Against Digital Piracy, S. E. Oross
Fighting The Phantom Menace: The Motion Picture Industry's Struggle To Protect Itself Against Digital Piracy, S. E. Oross
Vanderbilt Journal of Entertainment & Technology Law
Digital technology, combined with the influence of the Internet, represents an increasingly dangerous threat to the protection of copyrights in the global marketplace. Industries like Hollywood with business models based primarily on selling and/or licensing intellectual property have much to lose if that protection falters.
Jack Valenti, the president of the MPAA, knows this all too well. In recent testimony before the House Subcommittee on Telecommunications, Trade and Consumer Protection of the Commerce Committee, he described how the growing availability of certain digital technology could turn online piracy into the bane of the motion picture industry. Noting that Internet pirates …
