All-Inclusive List of Electronic Theses and Dissertations

In 1993, Rose-Hulman Institute of Technology became a member of the Foundation Coalition, one of six EngineeringEducation Coalitions sponsored by grants from the National Science Foundation. Experimental curricula were created, including the Integrated First Year Curriculum in Science, Engineering, and Mathematics (IFYCSEM) and the Sophomore Engineering Program (SEC). In this study, students who completed one or more of the Foundation Coalition curricula were placed in four-member teams and comparatively evaluated using qualitative research techniques for their abilities to work in teams, to solve complex, open-ended problems and to utilize technology. This study evaluated the outcomes for the students at Rose-Hulman …

The Process Geography Of Law (As Approached Through Andalucian Gitano Family Law), Susan G. Drummond Jan 2000

The Process Geography Of Law (As Approached Through Andalucian Gitano Family Law), Susan G. Drummond

Articles & Book Chapters

Comparative law and legal anthropology have for long theorized on the basis of a traditional geography which saw states, regions, locales and social fields as having durable boundaries containing stable and homogenous cultures. This idea of place is now undergoing a massive transformation in response to the effects of and theories about globalization. The emerging ‘process geography’ rejects these traditional ideas, arguing that they are not, and indeed have never been aspects of reality, which is better represented by an imagery of processes. However, it is argued here that globalization is not a synonym for homogenization, nor has place suddenly …

Bird In A Cage: Chinese Law Reform After Twenty Years, Stanley B. Lubman

Hong Yen Chang Center for Chinese Legal Studies

I am grateful to the editors of this journal for inviting me to return to its pages to help mark the twentieth anniversary of its inaugural issue. History now tells us that publication of that first issue happened to coincide with the beginning of an extraordinary period in Chinese history that has seen extensive reforms transform the Chinese economy and Chinese society. These reforms, no less dramatic than the revolutionary transformations of the 1950s, have caused law to gain unprecedented importance in Chinese society. The Journal's anniversary provides an opportunity to review some of the major characteristics of Chinese legal …

Imprecise Answers In Distributed Environments: Estimation Of Information Loss For Multi-Ontology Based Query Processing, Eduardo Mena, Vipul Kashyap, Arantza Illarramendi, Amit P. Sheth

Kno.e.sis Publications

The World Wide Web is fast becoming a ubiquitous computing environment. Prevalent keyword-based search techniques are scalable, but are incapable of accessing information based on concepts. We investigate the use of concepts from multiple, real-world pre-existing, domain ontologies to describe the underlying data content and support information access at a higher level of abstraction. It is not practical to have a single domain ontology to describe the vast amounts of data on the Web. In fact, we expect multiple ontologies to be used as different world views and present an approach to "browse" ontologies as a paradigm for information access. …

Optimization Techniques For Data Intensive Decision Flows, Richard Hull, Francois Llirbat, Bharat Kumar, Gang Zhou, Guozhu Dong, Jianwen Su

Kno.e.sis Publications

For an enterprise to take advantage of the opportunities afforded by electronic commerce it must be able to make decisions about business transactions in near-real-time. In the coming era of segment-of-one marketing, these decisions will be quite intricate, so that customer treatments can be highly personalized, reflecting customer preferences, the customer's history with the enterprise, and targeted business objectives. This paper describes a paradigm called “decision flows” for specifying a form of incremental decision-making that can combine diverse business factors in near-real-time.

This paper introduces and empirically analyzes a variety of optimization strategies for decision flows that are “data-intensive”, i.e. …

Qualitative And Quantitative Chances In Ubiquitin Transcripts During Dictyostelium Mucoroides Development., Vincent Van Rothe Jan 2000

Qualitative And Quantitative Chances In Ubiquitin Transcripts During Dictyostelium Mucoroides Development., Vincent Van Rothe

Student Work

The slime mold Dictyostelium mucoroides is an effective model for studying eukaryotic development because it exists as both unicellular and multicellular entities depending on the stage of their life cycle. Development is regulated by a number of proteins. During the transition from single amebas to a multicellular entity, developmentally regulated proteins appear. In the case of the microcysts, produced during sexual reproduction, proteins not only function in the formation of the cell walls, but also aid in the fusion of gametes, selective phagocytosis, cell to cell contact, and make up lysosomal enzymes. We have cloned a developmentally regulated gene whose …

Reforming The Thai Print Media, Duncan Mccargo Jan 2000

Reforming The Thai Print Media, Duncan Mccargo

Manusya, Journal of Humanities

The Thai language press perfonns an important political role. At salient junctures, such as the May 1992 protests against the Suchinda government, or the May 1995 no-confidence debate which brought down the Chuan government, the media can play an important role in infonning the public about political developments, or in tipping the balance of popular opinion. On occasion (as in May 1992), this role may correspond closely with that of an advocate of the public interest. At other times (as in May 1995), it may more reflect the partisan interests of elements of the press themselves. Hence the media is …

Lifting The Veil: The Arts, Broadcasting And Irish Society, Brian O'Neill Jan 2000

Lifting The Veil: The Arts, Broadcasting And Irish Society, Brian O'Neill

Articles

This article examines the role played by broadcasting in Irish artistic and cultural life from independence in 1922 to 1960 with the onset of formal modernization. It examines the cultural context for the arts in early independent Ireland in which a mood of ambivalence and sometimes outright hostility to high culture prevailed. Rather than a profound disjunction between pre- and post-modernizing phases of Irish history, however, this article argues that there were important lines of continuity in cultural experience, in particular middle-class experience of the arts, which continue to inform Irish cultural life up to the present. Such cultural experience …

Nlrb Remedies: Where Are They Going?, Leanord Page Jan 2000

Nlrb Remedies: Where Are They Going?, Leanord Page

Richmond Public Interest Law Review

The National Labor Relations Board's remedies are the vehicles through which the policies of the National Labor Relations Act are realized, and the means by which rights conferred by the Act are protected. Through the appropriate remedies, the Board ensures that conditions at the workplace are restored to those which existed before the onset of unlawful conduct. Effective remedies also deter unlawful conduct and promote voluntary compliance with the Act. Congress chose not to specify the precise remedies that would be available to the Board, understanding the Board's need for flexibility to meet diverse situations and those which Congress did …

Deregulation In Maine: The Why And How, William M. Nugent Jan 2000

Deregulation In Maine: The Why And How, William M. Nugent

Richmond Journal of Law & Technology

Maine's retail electricity rates - although (on average) the lowest in New England - were in 1997 (the year Maine passed its restructuring legislation) nearly 40 percent higher than the national average. Industrial customers paid rates 40.4 percent above the U.S. average; commercial 36.9 percent more, and residents (i.e., voters) a whopping 51.3 percent more than residential consumers across the country. Place the risks of investment decisions in the market, where they belong. Technological developments (paralleled by changes in national regulatory policy) have erased the natural monopoly nature of the general portion of the electricity industry. Since regulators are not …

Aclu V. Reno: Congress Places Speed Bumps On The Information Superhighway, Dharmesh S. Vashee Jan 2000

Aclu V. Reno: Congress Places Speed Bumps On The Information Superhighway, Dharmesh S. Vashee

Richmond Journal of Law & Technology

In 1996, Congress passed the Communications Decency Act ("CDA") in an effort to regulate indecent speech on the Internet. Through the CDA, Congress sought to protect children from easily accessible, harmful materials on the Internet. In spirit, the law had noble intentions; however, on its face, the CDA raised serious constitutional questions and was immediately challenged by First Amendment advocates in ACLU v. Reno ("Reno I"). Using broad and vague terms such as "indecent" and "patently offensive," the CDA threatened to restrict adult access to a tremendous amount of speech that was constitutionally protected. Additionally, through the imposition of criminal …

The Developing Legal Infrastructure And The Globalization Of Information: Constructing A Framework For Critical Choices In The New Millennium Internet -- Character, Content And Confusion, Tomas A. Lipinski Jan 2000

The Developing Legal Infrastructure And The Globalization Of Information: Constructing A Framework For Critical Choices In The New Millennium Internet -- Character, Content And Confusion, Tomas A. Lipinski

Richmond Journal of Law & Technology

This paper reviews recent attempts to extend traditional property rights and other information controls and regulations into new media, such as cyberspace, primarily the World Wide Web. It reviews developments in copyright, trademark, trademark dilution, misappropriation, trespass, censorship, tort, privacy and other legal doctrines as they are reflected in recent United States case law and legislation, and to a lesser extent, in international agreements. Legal problems often arise because there is a conflict of viewpoints in how to best characterize space on the Internet, specifically the World Wide Web. Some argue that traditional ownership rights should apply, or perhaps a …

One Professor's Approach To Increasing Technology Use In Legal Education, Shelley Ross Saxer Jan 2000

One Professor's Approach To Increasing Technology Use In Legal Education, Shelley Ross Saxer

Richmond Journal of Law & Technology

Legal educators must increase the use of technology in legal education today Although some legal educators may disagree vehemently with this statement, most have accepted the fact that technology has and will become an even greater part of the fabric of our learning institutions. Students in kindergarten spend some portion of their week in the computer lab. By the time kids reach their middle- and high-school years, many are well-versed in word processing programs, e-mail, and surfing the Internet. Elementary school teachers are trained and encouraged to use multi-media software, the Internet, and other technology in their classrooms because not …

Defamatory E-Mail And Employer Liability: Why Razing Zeran V. America Online Is A Good Thing, Michael H. Spencer Jan 2000

Defamatory E-Mail And Employer Liability: Why Razing Zeran V. America Online Is A Good Thing, Michael H. Spencer

Richmond Journal of Law & Technology

Electronic mail ("e-mail") has taken its place as an integral part of communication in modern society. Unlike other forms of communication, e-mail can cheaply and efficiently be placed in a public domain for literally the world to see. These public areas, otherwise known as bulletin boards, have expanded society's ability to communicate over vast distances. Individuals or groups can also engage in mass communication, which involves a myriad of topics and concerns. Nevertheless, such electronic communications, as almost any other form of communication, can become volatile and create animosity among users. Hence, many of the remarks made in such exchanges …

Praying For Relief: The Impact Of Secular Organizations On Internet And Trademark Law, Ramona Leigh Taylor Jan 2000

Praying For Relief: The Impact Of Secular Organizations On Internet And Trademark Law, Ramona Leigh Taylor

Richmond Journal of Law & Technology

"The creation and rapid growth of the Internet have been 'hailed' [as] one of the greatest technological advances in recent history,” remarked one scholar of Internet law and jurisdiction. The Ninth Circuit Court of Appeals characterizes the Internet as "a global network of interconnected computers allow[ing] individuals and organizations around the world to communicate with one another." It is, therefore, not surprising that the Internet impacts every aspect of our daily lives. The Web is the fastest growing part of the Internet, and thus, an important mechanism for commerce. Authors Joseph Zammit and Lynette Herscha explain, "[t]he rapid growth in …

Riaa V. Diamond Multimedia Systems: The Recording Industry Attempts To Slow The Mp3 Revolution, Taking Aim At The Jogger Friendly Diamond Rio, Stephen W. Webb

Richmond Journal of Law & Technology

The music industry may never be the same again. In recent years, the recording industry has faced an onslaught of advances resulting from digital technology. The record industry has battled the manufacturing and import industries over digital home recording since the 1980's. Digital technology initially manifested itself with the compact disc ("CD") and the digital audio tape ("DAT") in the early 1980's and generated greater tensions between the recording, electronics, and computer industries.

Update: Riaa V. Diamond Multimedia Systems - Napster And Mp3.Com, Jayne A. Pemberton A. Pemberton

Richmond Journal of Law & Technology

After the Recording Industry Association of America's ("RIAA") attack on the Diamond Rio proved unsuccessful, the music industry turned its attention to the companies enabling reproduction of copyrighted music. Two important cases appeared after the United States Court of Appeals for the Ninth Circuit held that Diamond Rio was not infringing on copyrights. These cases, A&M Records, Inc. et al. v. Napster, Inc. and UMG, Inc., et. al. v. MP3.com, Inc., will shape computer technology's effect on American copyright law. This update will discuss these two cases and give brief overviews of the courts' findings and conclusions. These findings will …

Alternative Dispute Resolution At The Environmental Protection Agency, Joel B. Eisen Jan 2000

Alternative Dispute Resolution At The Environmental Protection Agency, Joel B. Eisen

Law Faculty Publications

This chapter examines how the U.S. Environmental Protection Agency (EPA) uses alternative dispute resolution (ADR) methods to help resolve complex environmental disputes. In recent years, the EPA's use of ADR has increased dramatically in a wide variety of settings. The EPA has made ADR a central feature of its environmental enforcement strategy, encouraged its use in Title VI and environmental justice conflict settings, and turned to negotiated rulemaking as an alternative to the cumbersome notice-and-comment process for the development of new federal regulations. Other EPA programs, such as the Brownfields Economic Redevelopment Initiative, promote nonadversarial methods for tackling complex environmental …

Legal Knowledge For Our Times: Rethinking Legal Knowledge And Legal Education, Ruth Buchanan, Marilyn Maccrimmon, Wes Pue Jan 2000

Legal Knowledge For Our Times: Rethinking Legal Knowledge And Legal Education, Ruth Buchanan, Marilyn Maccrimmon, Wes Pue

Articles & Book Chapters

The essays gathered for this symposium reflect a number of overlapping concerns about contemporary legal knowledge and education.

Though they are considerably diverse in focus and subject-matter, ranging from admissions to films to "marketing" of law faculties, each of these articles addresses aspects of legal education, the construction of legal knowledge and the character of what Ian Duncanson calls "the law discipline." Educational practice, knowledge and disciplinarity are thoroughly inter-related. The contributors to this volume are all acutely aware that, as educators and researchers, we both:

participate in the construction of legal knowledge (for the readers of learned journals, for …

On The Stabilizing Action Of Protein Denaturants: Acetonitrile Effect On Stability Of Lysozyme In Aqueous Solutions, Evgenii L. Kovrigin, Sergey A. Potekhin Jan 2000

On The Stabilizing Action Of Protein Denaturants: Acetonitrile Effect On Stability Of Lysozyme In Aqueous Solutions, Evgenii L. Kovrigin, Sergey A. Potekhin

Chemistry Faculty Research and Publications

Stability of hen lysozyme in the presence of acetonitrile (MeCN) at different pH values of the medium was studied by scanning microcalorimetry with a special emphasis on determination of reliable values of the denaturational heat capacity change. It was found that the temperature of denaturation decreases on addition of MeCN. However, the free energy extrapolation showed that below room temperature the thermodynamic stability increases at low concentrations of MeCN in spite of the general destabilizing effect at higher concentrations and temperatures. Charge-induced contribution to this stabilization was shown to be negligible (no pH-dependence was found); therefore, the most probable cause …

Spontaneous deposition of copper seed layers from metal bearing organic based solutions onto sputter deposited titanium, titanium nitride, and tantalum diffusion barrier thin films has been demonstrated. Based on electrochemically driven cementation exchange reactions, the process was used to produce adherent, selectively deposited copper metal particulate films on blanket and patterned barrier metal thin films on silicon substrates. The organic solution deposited copper films were capable of acting as seed layers for subsequent electrolytic and electroless copper deposition processes using standard plating baths. Electroless and electrolytic copper films from 0.1μm to 1.0μm thick were produced on a variety of samples …
